On September 25, 2007, BBB contacted the company regarding its TV commercial offering "free popcorn." Per one customer, the ad did not disclose a shipping & handling fee. According to the BBB Code of Advertising, the word "free" may be used in advertising whenever the advertiser is offering an unconditional gift. If receipt of the "free" merchandise or service is conditional on a purchase: - the advertiser must disclose this condition clearly and conspicuously together with the "free" offer (not by placing an asterisk or symbol next to "free" and referring to the condition(s) in a footnote); - the normal price of the merchandise or service to be purchased must not have been increased nor its quantity or quality reduced. The company responded that the shipping and handling fee is not stated in a footnote, but directly below the phrase "FREE." Upon review of the TV commercial on www.myfreepopcorn.com, BBB noted that the site discloses the additional charge 7 lines below the "FREE POPCORN!" header. In addition, the commercial inconsistently notes the shipping & handling fee in superimposed graphics. The TV ad never verbally states the shipping & handling fee. The firm responded that "Out of the 6 times 'free popcorn' is mentioned in our ad, 3 of the times do show the disclaimer '*Plus Shipping and Handling.'"
