My issue is that I made two purchases from Tory Burch and one of them was supposed to be delivered today but the delivery driver dropped it off at the wrong address. The picture that was sent to me as proof of delivery was from his car which he had taken and when I tried to contact the delivery support chat theyre telling me the driver cannot retrieve the package. So now I am out money and my package and someone else has it now and theres nothing that can be done about it. When I tried contacting Tory Burch all they could tell me was that I would have to file a claim and someone would get back to me in 8-10 days for a resolution. That is absolutely ridiculous they already know from their notes that the package was delivered to the wrong address and they couldnt give me a refund right away I have to wait 8-10 days for them to do an investigation??? I am extremely upset and out of money and my package as well.Business Response

On December 1, 2024, I purchased four items from the Tory Burch official website for a total amount of $566.08. The package delivered on December 4, 2024. However, I never received the package.I immediately contacted Tory Burchs customer service to report the issue and requested a refund. Unfortunately, their response was both unhelpful and dismissive. They refused to process a refund and insisted that I contact *** directly.I made attempts to reach *** but faced significant barriers due to their phone-only customer service system. As a non-native English speaker, I am unable to effectively communicate via phone. I requested that Tory Burch provide an email or text-based contact for ***, but they failed to assist and repeatedly told me to handle the matter on my own.Over the course of nearly two months, I have exchanged no fewer than 20 emails with Tory Burchs customer service team, but the issue remains unresolved. I made my payment directly to Tory Burch, not the shipping carrier. Therefore, the contract of sale is between me (the buyer) and Tory Burch (the seller). Thank you for your response regarding my complaint. However, I would like to address several important points and provide further clarification on my situation.
Firstly, I am currently outside ***************** and will not return for the next two months. During this time, it is not feasible for me to be available for communication with **** especially considering the time difference. *** typically contacts me at around 3 AM my time, and as a person with a hearing impairment, it is difficult for me to effectively communicate by phone, especially in English. This makes it impossible for me to follow up with *** as requested.
Secondly, according to both U.S. federal law and California state law, it is the responsibility of the seller (in this case, Tory Burch) to ensure that goods are delivered to the customer, even if the tracking shows the package as delivered. If the goods are lost, stolen, or misdelivered, the seller remains responsible for ensuring the customer receives their order, and the burden should not be shifted to the consumer.
Relevant legal principles include:
1.Uniform Commercial Code (UCC) Article 2 (Sales): Under U.S. law, even if the package shows as delivered, the seller remains responsible for delivering the goods to the customer. If the goods are lost or misdelivered, the seller is still liable for providing a solution to the customer, either through a refund or replacement.
2.California Civil Code - Section 1723: According to California Civil Code Section 1723, sellers are responsible for ensuring that the goods purchased by consumers are delivered to the correct location. If the goods are stolen or misdelivered, the seller must take responsibility for the loss and provide a resolution, including a refund or replacement.
3.California Commercial Code - Section 2313: This section requires that the seller provide goods in conformity with the contract. If the goods are lost, stolen, or misdelivered, it is the sellers responsibility to resolve the issue and ensure the consumer receives their purchased items or a refund.

I want to leave a review about your warranty service, which forced me to put my all-time favorite backpack in the back of my ********* Aug 2024, I visited the Tory Burch Clarksburg Outlet to ask if they could replace the clasp on my pink Tory Burch backpack. This backpack was my absolute favorite - beautifully made, with a soft powdery pink color that was perfect for summer. I received countless compliments whenever I wore it. Unfortunately, the clasp, made of poor-quality material, became scratched and peeled after less than a year of use (4 months of active wear, as I used it seasonally).The store associate reassured me that the bag could be sent to Tory Burchs repair service and that they would likely replace the clasp. I was relieved and left the bag in their hands. A few weeks later, I received a call that my bag was ready, and on Sep 8, 2024, I went to pick it up.When I opened the bag, I was shocked. The clasp hadnt been replaced as promised. It was only partially polished, leaving it even more scratched, and the top part was untouched. Worse, the repair team added a stronger magnet to the existing clasp instead of replacing it, and in the process, spilled glue on the bag.When I raised these concerns, the store associate explained there was nothing they could do because my one-year warranty had already expired. I was incredibly upset - after driving to the store twice, my favorite bag was returned in worse condition than before.I dont understand how something like this happens with a brand like Tory Burch. How could the repair team fail to protect a bag from glue stains or deliver a proper repair?At the time, I was so disappointed that I decided not to reach out, expecting it would only lead to frustration without results.
