    My son, *********************, signed up for a 3 month gym membership, that we tried to cancel w/in 3 days of signing up. We explained to the manager about the law that allows cancellation w/in 3 days, which they claim to know nothing about. They agreed to cancel the membership, but did not refund the $75.00 we paid for the first month. We want the refund.

His mother came into the facility outside of the 3 day window (that does not apply to gym memberships). Please inform *************** that her son is an adult and should be able to handle these issues like so.

    I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

    We did go into the club within the 3 days to cancel the membership in person.  We went on Monday, 7/3.  The manager was not on the premises, so we were told to come back Wed 7/5/23 after the July 4th holiday.   It was documented that we did ask for the cancellation within the 3 days. We are not asking for anything we are not legally entitled to. We are trying to be respectful, and would appreciate the same.  You know nothing about my son, so please do not make assumptions on why I am stepping in to help.  Again, we are not asking for anything we are not entitled to.   We want the $75.00 refunded.

     As stated, we physically went to your establishment within the 3 days to cancel and the manager was not in.  We then gave you back the *** and cards.  We are not letting this go as we would expect the right thing to be done here.   Our next correspondence will be from our lawyer if our $75.00 is not refunded.

    While we understand your frustration, again we have no record of the ACTUAL DATE you and your son claim to have come in, only your word. When a contract is signed by an individual we can not allow that signee to use our facility (which apparently your son did) then have another individual come in to cancel his/her contract.  That is not a valid revocation of the contract between our facility and your son.  If your son wanted to terminate his contract, legally he has to let us know that he is delegating or assigning his consideration in the contract to you. Since he failed to do so this is a valid contract and not considered revocable.  

    In light of wasting anymore of our time..feel free to come into the facility with your son to have a $75 refund issued. Consider the one day of training a gift from us. We wish you much success in your future fitness journey.
