Upon arriving for my consultation, the receptionist collected $95 and reassured me it would be applied to my services. I was not told at any point during the process that there would be a possibility I would be denied services due to my weight. This would have been a simple question asked of me over the phone when I scheduled the consultation. There was no indication I would be spending $95 to then be denied services. Dr. Giacobbe spent a total of 7 minutes with me and denied me services. I am requesting a refund of $95.

Patient privacy laws prevent us from discussing the treatment and care of any patient.  Because we take complaints to the BBB seriously, we will respond in general terms about our policies and hopefully this will be enough information to function as our response.  By responding to this complaint, we are in no way agreeing that this individual is a patient of ours. The purpose of a consultation for a surgical or non-surgical procedure is to determine whether the patient is a good candidate for the procedure.  We look at the patient’s medical history, review their request and make sure that a procedure would be appropriate.  Not all patients are good candidates and that determination is made during the consultation process..  While weight can certainly be a factor, we also look at other things like medical history, skin laxity, source of motivation, realistic expectations, etc.   Our receptionists are able to gather information from the patient, but they are not medical professionals.  They do not have the skill set necessary to review the patient’s information and evaluate the many factors that go into the determination of a patient’s appropriateness for medical procedures.   After the receptionist has the patient fill out a number of forms, she reviews the forms for completeness and then prepares the patient’s chart.  Then, a nurse or medical assistant will assist the patient to an exam room and prepare the doctor for the visit.  The doctor reviews the chart and then enters the exam room where he may ask further questions, examines the patient and then discusses options with the patient.  After the visit, the exam room is cleaned and prepared for the next patient.Medical offices charge for physician visits and our cosmetic consultations with a board-certified plastic surgeon cost $95.  The patient is made aware of this fee when they call to make their consultation appointment and they are charged the fee before the consultation takes place.  We require all patients to have a consultation with the doctor before we will schedule any procedures.  A consultation does not guarantee that a physician is going to perform a procedure for a patient, nor does it obligate the patient to have a procedure.   If both the patient and the surgeon agree to move forward with a procedure, our practice credits $95 towards the cost of the procedure as a courtesy to the patient.  We do not offer free consultations and we do not offer refunds to patients who have had a consultation.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  Dr. Giacobbe did not look at other things like my medical history.  He did not check my skin laxity.  He did not ask me one single question about my source of motivation.  He did not ask me about my expectations, etc. He simply took a BMI chart out of the folder on the table, looked at it, and told me to lose 20 pounds.  And that was it.  He kept looking at the BMI chart and did not even look at me for the seven minutes I was in the room.  He did not ask further questions.  He did not examine me at all for even a single second.  He did not discuss options with me.  I did not get the consultation and examination I paid for and I continue to expect a full refund.  Regards,

Dear Better Business Bureau:Due to HIPAA patient privacy laws, we are precluded from commenting on patient treatment.  However, we are always available to discuss concerns with our patients.  Patients are welcome to contact us directly. We can assure you that every patient who is seen at our office for a consultation fills out a medical history form which is reviewed by our medical staff.  It is necessary to review this information prior to offering any medical advice to the patient.  Our medical staff reviews the patient’s past medical history and current medications, etc. for the safety of the patient and this information becomes part of the patient chart.  This information helps the doctor decide if the treatment or procedure will help the patient reach their goals with safety as a priority.  Many patients come prepared to a consultation with a list of questions and sometimes patients leave a consultation wishing they had asked additional questions.  We are always available to patients who have had a consultation and have follow-up questions.  Our patients are welcome to call me directly at our office at ###-###-#### or email us at **************************Sincerely,Nancy J****, RNOffice ManagerWNY Plastic Surgery###-###-####
