      I hired JMR construction to do an addition on my house...We started talking to them June 2024. At this time, we told them we only have $100,000 for this job. (That was my first mistake.) They told us they could definitely do that in our price range because my husband is doing the inside of the renovation. They came in October 2024 and started digging. After digging a huge whole in my front yard causing us to have to enter and exit out of our back door, they left it like that for months. From July 2024 - October 2024 **** and ***** (Owners of ***) were always asking us for checks. $10,000 here $10,000 there until I felt like something wasn't right. By October 2024 I gave them $55,000 and still only had a huge hole in my front yard. At this point I asked them for a break down because it didn't seem like we would have enough money to finish the job if we paid more than half of the job and still only had a hole. I had to ask them for WEEKS before they finally gave me a break down. The breakdown said $174,000! I obviously couldn't afford that since I told them up front I only had $100,000. At this point we had to get another loan to make this work but are definitely getting a different contractor to finish but *** owes us money back. they charged us for a drain that they didn't put in and backfilling that they didn't finish. I am still in the process of trying to get the money back, but they won't answer the phone and text me saying they will come but then don't show. **** has also threatened to sue us. (not sure for what...) I don't have the money or energy to fight with them so I'm hoping there is something you can do to help stop them from doing this to other people. I also just found out the guy they hired to do the digging for our job is also trying to reach them because they didn't pay him his full amount for the job, and they won't answer him either. If there is anything you can do to stop them it would be very much appreciated.

      Hello, we at *** regret having to go through this dispute with the client. However the truth is different from what has been told in the complain. We responded to a call for an estimate on April 22, 2024. Talking with the client (***** *******, the husband) it was stated that they wanted a 2-car garage addition with a playroom above conjoined to the house from the existing driveway side. The rough dimensions of the perimeter were determined approx. 20ft x 12ft from right side of the house to the existing porch, with minimal digging for foundation/leveling and attachment to the porch. The approx. square footage of the addition used for the estimate was 500 and the estimate of $100k was based on it. After the client saw our estimate they inquired about next steps and we referred them to an architect with whom we had collaborated in the past. They dealt directly with each other and came up with a different set of plans from what was used in the estimate and they proceeded with submitting for and obtaining the permits. Upon seeing the plans we noted that this is more expensive than what was originally discussed as the house dimensions had grown to 26ft x 26ft or close to ******************************************************************************************* concerns at the time. As we started excavating we encountered significant difficulties with the terrain geology (very rocky and with huge boulders) which slowed down the process. It also was discovered that the existing house was of "slab on grade" construction and had no foundation footings which prompted us to pause original construction schedule and address the issue through additional concrete shoring and building of bulkheads and underpinnings to secure the house. This process was done in coordination with the Town DOB and professional engineer. We started excavation on October and the concrete work was done in November, with foundation walls completed on early December after which the weather deteriorated to the point where we could not work outdoors. We returned on ******* to backfill entire garage footprint with aggregate (not earth as originally planned) as well as installing drainage under the garage slab. We poured the slab and completed the first phase by end of ******* at which point we were told that our services are not needed any longer and we would be taken off the permit. We started discussing the breakdown in December and it was provided in early ******* showing the magnitude of the work and associated costs. The breakdown showed the amount disbursed was sufficient to cover the 1st phase up to the garage slab. There is a $515 surplus payment which the client is claiming as well as the portion of the foundation drainage outside of the garage perimeter which was not installed although the materials are purchased and delivered on site. We are willing to refund the surplus amount but feel that the rest of the payments have been justified by the services completed. The claims towards our subs (the excavation guy) are unfounded and illegal as we have executed those contracts under our procurement process. We do not wish to engage on hearsay claims as we have provided our rationale for the charges and have performed the services covered by those charges despite the client bringing in outside contractors to work on the job site covered by our insurance and in breach of governing construction regulations. We have all the dates and documentation to back up the above timeline and wish to resolve this matter peacefully.

      Hello,

          I filed a complaint against JMR construction. My case number is ********. *** responded to my complaint on March 3rd, and I was unable to see this until March 9th because I was on a cruise ship with no service. since I didn't respond fast enough the case was closed but I would like to reopen this case since *** did not resolve this with us. In fact, the response JMR gave was full of lies and I have proof......

      JMR stated that we originally asked for a 2-car garage that was supposed to be 20' X12', This is a lie. You cannot fit 2 cars in a 20' X12' garage. (please find attached to this email, the old plans which shows we were always asking for a 2-car garage which is 25' X 25')

      Also attached to this email are screen shots of my text messages with **** and her husband ***** showing how many times and how long I was asking for a break down on where all the money they asked for was going and how much we had left to pay. I started asking for a breakdown on November 7th, 2024, and received a $100,000 estimate on November 18th. (The estimate I sent to you in first complaint.) This made me ask for a more detailed breakdown to which I received on January 5th, 2025. This is when the price jumped from $100,000 to $174,000. (I also sent that break down in the first complaint.) In this breakdown you can see that we paid for all of the backfill and drainage outside of the garage which was not completed. We feel that since they did not complete these tasks, we should be compensated for the remainder of these tasks. Thank you for your time and I look forward to hearing from you soon.

       They are now making up lies about me and I will not entertain this nonsense. I have provided all of my documents that proves they are lying. I also explained that I was not able to respond in time due to being away on a cruise. All of these new lies and made-up claims said in their last response are not even relevant. Also saying we lied about the amount to lower our taxes makes no sense because they are the ones who filled that out and filed with the town for us so anything that is wrong would fall on them. 

       

      Also, the company we had come work on our pipes was the company that was recommended by the town. I also had the okay from ****** husband ***** when she sent him in person to my house to check on the work. ***** also had no problem with the job that was done and JMR construction continued to work on my property for weeks after that happened so the fact that she even brings that up now also makes no sense. If it was a problem they would have stopped working for us, then. 

       

      Another thing they said was we have materials that they paid for and had shipped to my house. Any materials that was order and delivered to my house was paid for in the $55,000 that we paid them. You can see that all in their breakdown that I provided you.

      Well, it appears the client is determined to go back and forth no matter what, but this doesn't change the fact that:

      1 - construction estimate of $100K is dated 4/22 and was NOT based on 26'x26' garage with playroom AND side deck AND retaining wall for the full length of the driveway

      2 - estimate was based on JMR providing excavation, foundation footings + walls, garage slab + walls, structural supports, 2nd floor framing, roof extension, exterior windows and doors.... in other words the shell of the addition with the interior finishes to be done by others (owner or not)

      3 - estimate did not include additional costs for unforeseen difficulties of existing conditions encountered during construction (very rocky soil, huge boulders, bedrock breaking, missing house foundation footings, abandoned septic tank in front lawn, etc.) which also lengthened the construction timeline

      3 - the breakdown cost of $174k includes everything that is shown in the plans, which is NOT WHAT JMR agreed to complete, if we subtract the closing costs, the additional costs, and interior finishing costs it can be seen that revised costs of the work JMR was responsible for is closer to $125k (verifiable by the breakdown screenshot the Simpsons included in the complain). It stands to reason that $125k which is an actual construction breakdown is higher but in the ballpark of the $100k which is an ESTIMATE (by definition, not final)

      4 - As for communication, ****** has been more than rude and disrespectful on the phone and in person several times. Talking in loud voice, calling names, using sarcasm, and what not. The fact that they had to obtain additional funds based on other (I suppose honest) contractor estimates only validates the costs provided by ****

      5 - The materials left behind include what was needed for next phase of the job so they would not be covered by the $55k paid by the Simpsons

      6 - *** had paid non-refundable deposits to roofing and framing subcontractors and since the Simpsons "fired us" these deposits are lost. These losses also fall under the next phases of work not covered by the $55k paid.

      The above facts don't include the way ****** kept JMR in the dark after they planned to get other contractors to finish the job. *** asked several times what is the plan going forward while clearly working to finish phase 1 as PROMISED, and ****** waited until the final minutes of the job being finished before telling ***** in person "we do not need you anymore" thus unilaterally and illegally becoming in BREACH OF CONTRACT.
