While visiting Toledo the week of June 2nd, I received two parking tickets issued by Parksmart. The tickets give two different amounts for the fine - one says it's $10 per ticket, the other says $20 per ticket. Note, please, that the 2nd ticket I received was issued while I was within the time I'd paid online using the mobile app.I tried to call the telephone number on the ticket, but the phone was disconnected. The company's website says it's a division of the Toledo ***************************, so I called that office but THAT phone number was disconnected. I then tried to complete the "contact us" foirm on the port authority website, but it was malfunctioning.I emailed someone from the company who told me that they are not affiliated with the Toledo ***************************. I told her I was afraid this is a scam trying to get my credit card information, and that since their phone numbers are disconnted, and their website claims falsely claims to be under the authority of the port authority, I would like the tickets cancelled. She did not respond to this request.Ultimately, I learned that the phones at both organizations were temporarily down. I asked about disputing the tickets and was told I would have to file an appeal based on their website instructions. Not wanting the tickets to go unpaid since that would be communicated to my car rental agency, I paid the tickets. I then contacted ParkSmart to ask how to appeal and I was told that since I paid the tickets, I could no longer appeal. Nothing in their appeals instructions does it say I forfeit my right to appeal if I paid the ticket.Given that their ticket information was unclear, that their phones and contact us form were inoperable, and that I was unaware of the forfeiture of my appeal rights, I would like either a refund of the $20 for the tickets, or the option to meet with their appeals attorney. I have attached Mr Kurts first email and the receipt that he sent to us showing the time he paid was outside of the time of the ticket which is why he had to pay both tickets. I also have a attached the ticket listing showing two different tickets on two different days. He was given the appeal process because he did not want to pay the tickets because he assumed this was a scam. When we informed him it was not a scam he continued to believe it was so he talked to and emails numerous people in his quest to prove his assumption correct. When he finally realized it was not going to be proven a scam he reluctantly paid the tickets and sent us an email to that affect. I recently purchased a home in Toledo that is located on an extremely narrow street. Toledo police advised that it was OK to park parallel to my garage on my land. ParkSmart has decided otherwise. Their ticket says to bring or mail in. It is a lie. Their office isn't ever open, only by appointment. That should be stated on their ticket clearly instead of wasting people's time and parking meter money trying to get into their closed office. I had to pay $ for parking on my own property and as you can see, I am nowhere near their ******** *****. I regret moving to the area and will sell my house and find a better city to live in. ParkSmart forces you to print out documents and won't take payments online. They are trying their best to get extra fines and fees by making their processes impractical and they set you up with misinformation.Business Response

***** was issued a ticket by the Toledo Police for Alley Parking. For clarification we manage the parting ticket payments and appeals for the Toledo Police. She was offered an appeal and we do mail appeal forms to those who do not have a printer at home or nowhere to print or they can come to the office to pick one up. She clearly was able to get one because it is filled out and signed in her appeal folder. She was informed after her hearing that the hearing officer had reduced her fine from $25 down to $5/within ***************************************************************************** our drop box and making an appointment to pay in the office. She chose to send cash and change in the mail and we only received 3 dollar bills and 1 quarter, the other 7 quarters were not in the envelope.Initial Complaint

I received a par**** ticket on or about August 7, 2024. I requested to appeal the ticket. On 9/11/24 I was provided a letter from ******* **** scheduling an appeal hearing on September 25, 2024 with a call-in phone number (************) for 10:30 AM. When I called in at that time, I got a voicemail message stating to call Park Smart. When I called Park Smart, I had to leave a message at that time.
******* **** called me back and stated I would have to speak to a manager. The manager called me back later that day and identified herself as "******" but stated she would not provide a last name. When I asked why the hearing was not held, she stated "no one was in the office." I asked for further clarification, but she did not offer additional information.
The letter I received on 9/11/24 stated "Hearing dates and times cannot be rescheduled. You are not permitted to attend the hearing, only call-ins will be permitted, but remember this is your only chance to speak with the Hearing Officer." When I brought this up, ****** stated that that language only applied to me and not Park Smart. I asked if the Toledo City Ordinance 309.06 stated anything about rescheduling hearings, and ****** admitted it did not. She stated my only recourse was to reschedule the hearing.Business Response

I am rejecting this response because:The letter I received offered no countermeasures for rescheduling the hearing and specifically stated hearings could not be rescheduled. I wasn't even given the explanation there were "unforeseen circumstances," but simply that "no one was in the office." It was a rude and humiliating experience.

I was given a ticket even though my handicap placard was in my car. I also disputed with the hearing officer letting him know that as well. My meter wasn't expired not to mention as well. I turned in the registration as well that they are registered to me. Then again my friend used my truck and had the handicap placard in the window at his job at Amazon on private property and was given a ticket for no reason. Again I disputed this. I feel at this point I am being targeted and discriminated against due to my disability and they are preying on handicap individuals to get money out of them. They have now issued a warrant block on my registration due to this. I have spoken to 2 people in this office and to no avail i have gotten nowhere. Both someone by the name of ******* and ***** have been no help with this situation and been very rude. They stated Because the ticket was given you have to pay it and theres nothing you can do about it. I would like to bring attention to the fact that they are getting over on people and something needs to be done about it. I even had broken meters and was given tickets because of this and they don't want to take any responsibility or accountability for anything they just want money. ***** ******* has two outstanding handicap tickets, has gone through the appeal process and received a reduced amount of $35 within 30 days but did not pay either ticket at the reduced amount.($100 down to $35) After 60 days one ticket was taken out of appeal status thus allowing the late fee to be assessed making it $150 and then it was sent to the DETER section of the BMV and her registration was blocked. Once she was blocked she called into the office to complain about the Hearing Officers ruling and told us she would take this to Municipal Court after both Jessica and I talked to her and explained the Hearing Officers ruling is final. We have followed our procedures for appeal and she was informed of her appeal date and time and was informed of the outcome of that appeal with instructions to pay within 30 days.

I am rejecting this because both of the tickets were given unlawfully and discriminatory due to the fact I have handicap placard. I provided proof of that. Also one of the tickets were given at one of my friends borrowed my vehicle at his place of employment at Amazon in a private parking lot with the placard right in the windshield. The placards are registered under my name and I provided that proof to the office prior to the hearing. So that makes no sense why I was still told to have to pay anything. The hearing officer even said he would call me back because that made no sense as well. The other ticket I didn't have a expired meter or anything so at this point I feel that u am being discriminated against due to my disability now. I only spoke with the lady ***** one time and she was very unpleasant as well. As for the girl ******* she has been very unprofessional and rude since the beginning and shouldn't be doing this type of job.

Her registration is now blocked and they are considered judgments against her and must be paid to unblock her registration. She was offered an appeal and has gone through the appeal process and the hearing officer was given all of the information that we had on both tickets and ruled a reduced amount giving credence to the fact that the officer wrote the ticket because they did not see the handicap placard hanging from the mirror. There is no appeal for the appeal in this office nor is there an appeal after your registration is blocked.

I am rejecting this response because: it still makes no since that I would be paying anything considering the fact that information of a placard was sent over as well as handicap placard itself. I feel that I am being discriminated against due to my disability. Because I am being charged an astronomical amount of about 150 per ticket now because of this. And registration block. I received all of the reduced amount stuff late due to the fact of my mail being forwarded and also I never received the email regarding thus since my mailbox was full. So I am not willing to pay anything more than the original reduced amount due to the discrepancies of me receiving my emails and postal mail. Since I shouldn't be paying anything when I am handicap and have a handicap placard on file with the bmv.

The below is copy & paste from communication mailed to ParkSmart. This is my 3rd attempt / 3rd method of contact; both of my 2 previous appeal attempts followed the company's instructions on how to do so, but were not acknowledged. "I am sending the following letter and supporting documents in response to your Past Due Notice as my appeal efforts via both phone and through your website have not been acknowledged. Thus, I am now contacting you via physical mail as a third effort at generating customer service activity from your company.I received a parking ticket on my windshield on 11/6/2023, which I appealed on that exact same daynotifying your company via both phone and your website. (Exhibit A attached serves as proof of my online appeal an email from ParkSmart from that day.)I parked on the 300 block of Michigan outside of my workplace (Toledo Library) as our parking garage was full when I arrived to work. I immediately went to your website and paid for two hours of meter parking, from 12:14pm to 2:14pm. (Exhibit B is a visual timeline of the experience I am appealing; in this document you will see text messages from ParkSmart confirming that I paid to park for this full timeframe.)My car was moved to our Library garage prior to the 2:14pm meter expiration (see Exhibit B), but despite paying in full, I received this parking ticket. In preparing for this appeal I gave ParkSmart the benefit of the doubt and even checked to be sure my credit card was in fact charged. It was charged and did clear (see Exhibit C, which is a printout from my credit card companys website), and thus I am furthering this appeal.I am extremely disappointed in ParkSmarts lack of response, lack of customer service, and lack of synchronicity between your virtual platform and your ticketing street team. ******************************* received several replies from our office, 3 emails(attached) and a voicemail left on the phone number that she left on our voicemail box. Our office replied on November 6th to her original email request asking for the payment receipt and ticket to be sent to us for confirmation of her parking payment, we did not receive a reply. We then received a phone call from her on December 6th leaving a voicemail to call her back at the phone number ************ and we returned her call but she did not answer so we left her a voicemail asking for her to email us a copy of her payment receipt and ticket and also immediately emailed her asking again for her payment receipt and ticket so that the ticket could be voided. Complainant received parking tickets for 3 different vehicles on her premises, complainant said they were 18 hr parking tickets. Complainant argues that the tickets are invalid as she provides community service/beautification services for the City of Toledo/Communities and should not have received these tickets. The vehicles were parked in complainant's residence/driveway and supposedly obstructed view of fairway, thus the tickets. She has had multiple communications with ParkSmart, in fact she has successfully appealed two citations that were voided and appealed another one that she paid and just recently appealed two more. She has called and left messages and received a calls back and has emailed and received an email back with the appeal form requested which is how she was able to appeal her previous citations and have a hearing and this is how she has *******'s first and last name as it is in her signature line. Her current citations are 18 hour parking citations on two different older model cars that are parked on Yondota where she lives and as we have explained the Toledo Police must respond when someone calls to complain about cars sitting on city streets. We have also explained to her due to staff shortage we are by appointment only, as our voicemail states and the sign on the door states but she continues to just stop by and knock on the door for assistance. We have also explained that she can print off multiple copies of the appeal form she does not have to come to our office to obtain one. We have also explained that she can make an appointment to pick up one. I am not sure how all of this constitutes "no communication".Customer Answer

We follow the same procedure each time an appeal is received by our office so just like the last time she had an appeal, she will receive an email and/or letter in the mail two weeks before her scheduled hearing. As in her previous hearing she received the notice two weeks before the hearing and received the results within a week of the hearing and paid her fine within the stated 30 days. I don't know what other communication she is expecting but everything has been communicated to her and she has already gone through the process once and it is the same process every time.
We received her appeal on August 1st and she is set for the September hearings as the August ones are already set for August 15th, she will receive her notice of the date and time of her hearing in September two weeks before her scheduled hearing. After the hearing she will receive the results within a week and will have 30 days to pay a fine if one is assessed by the hearing officer.

On March 8th of 2023 I walked into Parks Mart to pay citation and meter reader tickets I was told by the staff at parksmart at the time I had no holder on my license plates through the BMV and that the bill that I was there to pay which was $365 will not have to be compromised and can be paid at a later date and turned away by staff as of today I am following this complaint due to rude underminding lazy customer service I also couldn't reach a resolution and they have a debt collector by the name of sheer green and Burke I also corresponded with that group which is located in one Seagate Toledo Ohio and was treated very rudely and could not reach his resolution the payment of $365 went up within 2 days from 365 to 377.50 and as of Wednesday of this week $495 I find all activities suspicious and couldn't reach a resolution now I am being compromised with my transportation because they're holding these tickets we started in 2006 ask collateral for the citation and bills the customer service is very unruly they would not provide me with corporate number I had to obtain the corporate number from my bank which is located next door and the staff told me to either give them the money or get out also this place runs by appointment only so I was misinformed I was giving misinformation and I was compromised through the BMV because there is a holder 40 citations on my license plates so as of today I have purchased the car and cannot purchase tags for the car due to being turned away by Parks Mart when trying to pay the bill cash in hand and in full on March the 8th I have receipts following March 8th all the way to last year September of 2022 these citations did not exist until July of 2022 so when I question both companies and agencies they began to be agitated and turn me away for the several times so as of today I am questioning my own integrity is well as theirs and I'm also questioning the cash amounts it comes off as a pyramid scheme it doesn't make any sense and when you go to pay it you get very rude customer service......Business Response

Ms ******* came in on March 8, 2023 because she had purchased a new car and was told by the BMV that she had a D.E.T.E.R block preventing her from obtaining her registration and plate for her vehicle. At that time she was told by the ParkSmart customer service representative that she had 7 tickets for a total of $245.00 but she did not see a registration block. She was also informed that four of the tickets had been sent to collections with Scheer, Green and Burke, our collection agency. She could have paid those tickets but decided not to pay the tickets that had been outstanding since 2006 and left. She returned two weeks later with the same information but could not give us a license plate to look under so the customer service representative asked me to look for her block which I did find. There were 3 additional tickets for a total of $120.00 which included the block that she asked us to find and explained now her total was the original $245 that she received on March 8 but decided not to pay, plus the $120 from the block that originally brought her to our office, for a grand total of $365.00 because all tickets have to be paid in order to receive a registration release. She was then given the procedure to pay which is go to the collection agency and pay what is there and then make an appointment to bring the receipt and pay the balance owed to receive your registration release. We have apologized and told her that we are sorry we did not find her block on March 8, 2023 because her name was misspelled in our system(her first and last name was in the last name box) but that they are still her tickets and have to be paid in order to obtain a registration release. As for why she has never been blocked before, all of her past tickets are on different license plates, it wasn't until 2022 when she accumulated 3 on the same license plate and she met the criteria to be blocked in August 2022.
