One of Better Business Bureau's roles in the marketplace is to ensure the public's confidence in advertising and promote trust in business. On January 9th, 16th, and 21st of 2015, Better Business Bureau corresponded with Inola Portable Buildings regarding the company's advertising after BBB reviewed a print advertisement in the January edition of the Value News newspaper on page 27. On February 13th, the business visited BBB offices and spoke with a BBB representative regarding clarification of the review. BBB subsequently followed up to ensure compliance and discovered that the business had failed to comply, resulting in attempts to communicate on June 4th and 10th of 2015 and lastly on July 9th, 2015. The company's advertising contained numerous claims of a warranty or guarantee, none of which included a disclaimer. Specifically, BBB found the business's advertising violated the following BBB Code of Advertising guidelines:
Guarantees / Warranties
When the term "guarantee" or "warranty" is used in product advertising, the following disclosure should be made clearly and prominently: a statement that the complete details of the guarantee (warranty) can be seen at the advertiser's store prior to sale, or in the case of mail or telephone order sales, are available free on written request.
BBB's Code of Advertising states, "The primary responsibility for truthful and non-deceptive advertising rests with the advertisers. Advertisers should be prepared to substantiate any claims or offers made before publication or broadcast, and upon request, present such substantiation promptly to the advertising medium or Better Business Bureau." To-date the business has not complied with BBB's requests regarding this matter.
