On August 13, 2012, BBB serving Eastern Oklahoma contacted Mary-Ruby Apparel concerning an advertisement the business ran in a local newspaper. The advertisement describes an "up to 50% off" offer. BBB sent an initial letter explaining that according to the BBB Code of Advertising: "advertised claims covering a group of items with a percent off range should state both the minimum and maximum savings." The business's response failed to indicate compliance to the initial letter and a subsequent letter was sent. The company again responded to BBB via fax and again the company's response failed to indicate whether or not the company would be modifying future ads to follow BBB guidelines. Furthermore, BBB staff contacted the company by phone to offer an explanation of the guideline and to determine if the company would voluntarily comply with the BBB Code of Advertising. The employee of the business was unwilling to listen to BBB staff and was unwilling to consider editing the ad to adhere to BBB guidelines.
