Contracted with this company mid October, 2024 to build a new *** compliant bath and renovate existing bedroom for $97,076.77. ALL fixtures were included even the washer/dryer. Any fixtures I purchase would be deducted. There was a side walk added for $2500 and a kitchenette was added for $7,453.00. A total of $99,274.57 was paid by the end of January even though there was a payment schedule for 2/3/2025 and 3/3/2025. I also paid for nearly all fixtures totaling approximately $5,525.00. The contractor kept telling me that if I dont give these draws he cant pay for materials, etc. February 5, 2025. ****** and ***** ******** came to my home to meet with me and a contractor friend of mine to see how we can get this job done. ***** ******** brought a document she titled Outstanding Payment Agreement that states there is $36,426.23 still owed to their subcontractors and if I did not sign this they will stop work on this project. Of course, I could not sign so ***** ******** stormed out of my home. ***** ******** returned to my door three times where there is a Ring doorbell, screaming, swearing, name calling. Police report filed and temporary protective order issued. They have refused to complete the contract. The consensus is the job is roughly 40% incomplete. They have also refused to pay me back and refuse to pay the sub contractors they hired.

    Business Response

    Date: 02/20/2025

Thank you for the chance to respond to this very untrue review of our company. We hold ourselves to a very high standard of integrity. ******* *. reached out to us to do a few small projects around her house. We complete several of these projects without issue. Her being very happy with our work.  She even made comments about how she was not happy with the individuals that sold her the home and the contractor that they bought the home from. The previous contractor had made several unsafe and costly mistakes. However, during the process of doing the small projects she reached out to us about doing a remodel of her master bedroom area. She first inquired about turning a closet into a bathroom. However, after discussing this project with other subcontractors we discovered that the plumbing would be a big issue within and that we could tap into the main lines much easier and cheaper than going into the 8 inch slab and all the work around that we would have to do.  She also wanted to make the lower area of the home a place she could live and rent out the upper section so it needed to be **** So,  She was all on board with the project of doing a small add-on that would allow the bathroom/master mother in law suite she was after.  After some back and forth of the details to do the add-on 16x16 all custom double shower, bath, washer and dryer, hot water tank,  *** compliant bathroom we worked up an estimate for *******. This would be a custom 800 sq ft area from the master to the bathroom area. With a 5x5 rain texture window and two small windows. The estimated total worked up to the amount of $99,746. Much of the estimate stated that items are an allotment and if items were above the allotment the customer was responsible for.  She gave us the go ahead with the project. She had a planned cruise trip that she was going on. She left us the keys. After doing a site survey etc. She was able to get all the required permits for the project. We started the project on or about Nov 10th with our first inspection requirement of the footers on Nov 14th. We passed the required inspection to pour. This brought on the very first change order by the client. She wanted a sidewalk poured from the back door of the garage to the area were the french door would be added to the master remodel. Apx 50x4 feet of new  area. This total was about $2500. As the project progressed a few examples of change orders came in. She wanted to add a kitchenettes with gas stove, upper and lower cabinets, dishwasher, sink and fridge to area. It would have custom upper and lowers to match the cabinets in the bathroom area.Cabinets alone added around $5000.  Granite countertops along with backsplash that matched the shower wall. As we removed sheetrock she stated that she did not like the heavy texture that was on the walls and wanted the whole room to match and be level 5. I explained to her the extra cost this would add. She agreed to the extra cost and wanted to move forward. Once we removed the sheetrock it was discovered that previous owners had covered up bad insulations and leaks. We made a choice to remove all insulation. We explained to her the extra cost of doing foam insulation vs *****. However, the cost was not a big differents and she wanted to go with it. This was a new added cost of around $3700 dollars for the whole 800 sq ft area. At this same time we removed sheetrock from an interior wall. It was discovered that the previous owner and contractor had put a main lug breaker box in a closet with sheetrock screws apx 4 inches away from the main lug wire coming into the box where the previous contractor had done the fit in for the breaker box. Even the city inspector view the box and questioned who had added the box without permit.  This added an additional $2500 to the cost for the move of the breaker box to a safe area. The customer added a change order to the cedar 8 in siding because she wanted the natural look instead of us just painting the section we added. This change order added around $2200. The customer added a split unit head to the bedroom area, this added around $1100. She wanted a big grand entrance into the bathroom by adding a big custom stain to match the book shelf. She picked out at the store herself with price on it, tile, that added an additional cost of $3800. Some things changed that was not in her control such as the breaker box and the rotten wood discovered when  the two skylights that the previous contractor covered up were taken out. These things had to be addressed at the time they were discovered and cause a safety concern. Things that were sight unseen and unknown.  The customer added several other change orders I.E. Windows to the east wall, a stained wall of car siding, heated floors for the bathroom, shaker doors that would be stained, custom kicklights under the cabinets. These are just a small view into the change orders and add-ons that ******* made. At no point did she speak of not being able to pay for these items, even stating that when she goes to court with her soon to be ex husband that she would have plenty of money after he had to pay alimony. Once things started to get odd with her I requested that all subs wait to go to project until we figured out an agreement to continue with the homeowner. She went around town telling everyone that our company fired contractors and that we stole $40k from her and we refused to finish the project.
The client did pay for some of  the project. She did pay the draws as I requested. However, we have receipts for everything that we paid for with the money that was given to us. There was no money to add.  She did not think she had to pay for the change orders that she collect on.  All contractors and materials were paid for up to the point of were she was set down to go over the budget and overages. We tried to explain this on several occasion to her through out the project. Once she realized that she was not going to have the money to finish she started to be a different person. I may add that during this time my daughter had and emergency room stay, my grandmother had a two week stay in the hospital that I was dealing with, and my mother in law went to the emergency room and never went home after passing away on Dec 26th. I was available to ******* during this whole time. There was not issue with anything going on. She was also very involved with everything going on. Walking around the construction site very willing and without issues. We even had given her advice that she should maybe think about getting a lawyer to go after the old homeowner and contractor that sold her the house she bought sight unseen. For not disclosing the issues that we found and they had knowledge of.
    The protective order issue:
On or around Jan 28th. I spoke with her about the overages of the project. I tried to explain to her that the change orders that were made with agreement during the project added up to the overage amounts. I explained to her that these items still had to be paid. I explained to her that the change orders early on had to be paid for during that time of the work done. Many of these change orders were due to the lack of knowledge and understanding by the contractor of the previous work and person that sold her the house. She was very upset with those people even sending me text messages at the time talking about not using these people for any jobs in ******* and that we should definitely make sure the city inspector knows who did it. She also explained, she was upset that the previous owner did not tell her about things that were wrong that they knew about.  A few of the change orders were due to unsafe situations that as a contractor have to be addressed. The city inspector also required that these changes be made. At the time of our conversation she had requested the hardcopies of work done. A couple days go by as work is being done I was getting phone calls and text from contractors asking why she is going around saying that I fired them and that she needs all the paperwork from them for the job. She also asked these same contractors if I had paid them or owed them money. I owed no money to them. At that time around Feb 4th  I requested that the sub-contractors please not go to the project until I was able to meet with ******* the next day and get a clear direction forward. So, I spoke with her about needing to set up a time to go over everything so that we can move forward with the project. We decided to meet on Feb 5th at 11:30.

After a few text between ******* and I, I learned that she was going to have another man there that she gave me no information about. I, at that point, decided that I should also take someone with me to the meeting. We decided as a business  that we would have my wife also my  business partner go with me so that she could help explain things to *******. One main reason, due to ******* stating when the project started that she loves dealing with women owned businesss.  I had a little hesitation going by myself simply because I had no clue who the man was that was going to be there. We made a request to Rebecca  to have the meeting at the police station in the meeting room to ease everyone involved. However, ******* would not and did not want to do that. So, she requested that we just all meet at her house. Once we pulled up at Rebeccas home I told my wife I have no clue who that could be or whos truck that is. As we walked in the home I introduced myself to the man how called himself **** or ****** ****** I tried to shake his hand but he gave me a very dirty look and hardly shook my hand. I had never seen or met this guy. He said he was a big time contractor around town. I found very unusual because I know many of them. However, ******* asked if  he wanted to sit in the living room. We declined because we didnt want to get mud on her white carpet. ******* and my wife sat down. I stood behind my wife. As the women went to sit down ****** interrupted my wife and said that we had a contract with her (*******) and that we cant change things there. ***** started to explain to ****** that what he was holding was only an estimate, not a contract and things changed due to change orders. I told ***** to let me explain it to him. I started to explain the change orders, and how change orders were made due to code violation within the project. He stated to me that he has done this many years and that he has never had to change anything. He stated that good contractors dont change things and they just use the money they were given no matter what the situation was.  I told him that he was crazy and there is no way to be a contractor if you dont change things especially if they are code violations. At this time ******* said something to the nature of lets not talk about that we need to talk about the estimate. My wife stood up to show ******* the paper that we wanted her to sign saying that she would pay the subcontractors and that she did not have to give us any more money if she did not want to. The paper basically was asking her to just pay the rest of the contractors for the changes that were made. At this time ****** reached across the table point his finger in my wifes face to sit down and shut up dont say another **** word. ******* also stands up at the same time pointing in my wifes face that she only wants to talk to me and not ***** because she doesn't know her. ****** SLAMMED the paper down on the table telling me he doesn't give a s*** what happened that I dont change things from the original estimate. At this point my wife picked up all her paper work and walk outside. I was still in the house trying to explain that everything was accounted for and that they could not show me where I didnt pay someone or for something. At this time I started to walk away from the table and ****** came around the table with his fist clenched and chest bowed out in a pretty aggressive manner. Keep in mind, I have no clue who this guy is. He kept telling me that I dont do this type of s*** to someone. My wife had come back to the door she did not come back into the house but instead was yelling at me to come on let's go. I know she had feared for me being in that situation. She was basically yelling and crying for me to come on and stop wasting my time with these Idiots. ****** started to follow me towards the door. I left out he door and drove away.

Later in the day my wife called explaining to me that the ******* Police had called her from Rebeccas phone she thought at first it was **** ***** However, it was Officer ******, she stated that she told him that he could call her to the police station if he needed to talk to her. When I drove over to the police station and requested to talk to **** or officer ****** who was standing inside the dispatch room. Office ****** came out as I sit down in the lobby. He asked what he could help with. I explained to him that I needed to get mine and my contractors tools and items from the home or *******. He told me that I needed to speak with the Sheriffs department  the the city does not do escorts for property. I was told that I was not allowed to go to the property due to a protective order that ******* had on my wife. However, she still contact me (before I knew about the order), that I would need to leave her items in the mailbox. I told her that I could do that. However, I would need written confirmation from her that I could get my tools and trailer from her property. She refused to allow me to get my things.

I am rejecting this response because:   The response from the business is quite rambling and many untruths.  I can prove everything single thing that was discussed on February 5 because I recorded the entire meeting and my ring camera recorded the owners very bad behavior.  I am very willing to give this recorded evidence to the Attorney General.

The facts about the breach of contract are simple.  We had a contract to do work, I paid nearly $100,000 and the job is not complete.  The recorded meeting clearly show that the owner threaten to stop work if I do not sign her paper.  That is extortion.  They followed through with their threat and stopped work and kept my money.

This is obviously going to be a clear back and forth that we do not have the time to waist on. The customer simply does not understand that concept of how construction works and the safety and lability of change orders that where cause by a previous contractor. She was sold a house that was in very pour condition and the previous owner does not want her to know this or that she could sue them.

I am rejecting this response because:

Whomever did work previously before I purchased the property I now own has nothing to do with E&T Oasis breaching the contract we made for a NEW BUILD ADA ********* bathroom.

The attached recording is the February 5 meeting where the contracted work was halted because I would not sign the document presented to me by the owner stating that I have to pay their subcontractors and then finish the job myself.  I specifically asked her if I do not sign the document does that mean you will not complete the job?.  She clearly states that if I do not sign the job will not be completed under her company.  I think that may be illegal
