    We bought a 1998 Dodge 3500 Pleasure Way from ***************, owner of Ryans **s LLC on 4/22. We then scheduled with ********************* to conduct an inspection of the vehicle. ******* statement is attached complete with the photos.What the ad said/we were told prior to purchasing the ** * Both **** and his mechanic said many times that all new brakes were installed * The ad stated that the vehicle was recently serviced including fluids changed along with transmission service and this vehicle runs and drives excellent, very strongWhat inspection uncovered: * Disks were not new (re-used/recycled parts)* Their mechanic over-torqued brakes and damaged bearings and drums * Spindle not made for this vehicle so the metal was ground down until it could fitcaused overheating and made the vehicle very unsafe to drive.* ********** is black * Transmission fluid black/potential leak Conclusion: * Ryans **s misrepresented the services they performed, did not disclose material non-conformities and defects prior to the sale, made false and incomplete statements of fact regarding rust damage and new brake installation (we fear there are a number of other things weve yet to discover that werent disclosed), mechanic negligence/incompetence and use of incorrect/modified parts. These all resulted in a vehicle that put our safety at risk. **** initially agreed to send us $2000 to cover repairs/make things right. Sent us the first $1000 immediately, but went back on his promise to send the other half. When the spindle issue was discovered we requested a buy-back. He became aggressive, refused to help or apologize for the vehicle being unsafe, and hung up on us. We sent a letter detailing the OR statues violated but **** ignored that email. We are requesting that Ryans **s LLC refund our money/buy back the vehicle for the $19,900 we paid for it, plus reimburse us the $500 we spent in labor to discover the issues detailed above.

    the vehicle I sold was sold asis the customers were more than welcome to get the vehicle inspected before they purchased it, they choose not to, they had the van inspected and they said the brakes need to be done and there was some other issues I made a agreement to refund them $2000 dollars and both parties where satisfied, then the next day they changed there tune and just wanted a full refund, I suggested taking the van to *************** tire company that would be a mutual place because for all I know there mechanic could just be trying to milk them for more money, I was willing to replace whatever *************** recommended regarding the brakes and they just declined, so I have not been in contact with them since, I've sent them $1000 already and did not send the other remaining $1000 because they where threatening my business, customer service is my number one priority I have lots of happy customers, thank you for your time

    I am rejecting this response because: The response is not adequate as Mr. ****** does not address the complaint at all, in fact it appears that he has not read it. He does not address that he violated the following OR statues:
    Oregon Administrative Rule (OAR) Chapter 137, Division 20: Misleading Price Representations, 137-020-0020 Motor Vehicle Price and Sales Disclosures
    (o) Disclosure of Material Nonconformities and Defects
    p) False or Unsubstantiated Representations
    Oregon Revised Statutes Chapter 646: Trade Practices and Antitrust Regulation sections ******* Unlawful business, trade practices and ******* Additional unlawful business, trade practices; proof; rules.
    Mr. ******* willfully ignorant and defiant interpretation of what is legally protected under an As is contract makes him a danger to the community as he has no hesitancy or regret about selling a vehicle that is unsafe/ not road worthy.

    -The issues found would not have been discovered during a regular inspection as they were hidden deep within the brake system. **** and his mechanic assured us multiple times that the brakes were completely new before we agreed to purchase the vehicle. And again, per the statues above, the kind of mechanical problems discovered are far beyond what is legal, even for an as-is sale agreement.

    -Mr. ****** conveniently does not state that the initial issue found were found:  Their mechanic illegally used previously used brake parts for the "new brakes" they claimed to have "replaced" prior to, and as a condition of, our agreement to the sale. Mr. ******** mechanic also over-tourqued the brakes causing damage and making the vehicle unsafe to drive. The transmission and engine oil were both found to be in need of replacement despite the ad's claim and Mr. ******** insistence that the fluids had all been changed. Furthermore, we never agreed that we were satisfied with his solution of $2000 as we wanted to have the work completed prior to confirming. We have email proof that we did NOT say this agreement was sufficient.

    -The condescending comment of our tune change Mr. ****** is referring to, occured when our independent mechanic went to perform the brake repairs and discovered that Mr. ******s mechanic also had illegally used a spindle meant for another vehicle and recklessly ground it down until it could be jammed into place. This altered spindle with material nonconformities and defects made the vehicle even more dangerous and eroded our trust in the entire vehicle and Mr. ******s business due to the deceptive nature of the issues our mechanic uncovered. This vehicle was not roadworthy when it was sold to us, invalidating any "as-is" agreement.

    -Mr. ****** was oddly insistent on this very specific ******************* but we did not want to give the vehicle to him or trust that he does not have an accomplice of sorts at that location. The vehicle was open and available for him to look at/bring his own mechanic for a week. We also sent many photos and were provided with a summary document from our mechanic detailing these problems. The vehicle is NOT safely driveable for any real distance so we couldn't drive it around to various mechanics in an attempt to appease Mr. ****** who had already proven to not be trustworthy. Also, we declined to take it to ******************* because Mr. ****** said that even if they confirmed the spindle issue that the best hed do is pay for that to be repaired. Due to the blatant lies and sketchy mechanical work that our mechanic uncovered we dont trust this vehicle as it is not roadworthy and our right to ask for a buy-back is fully supported by Oregon statutes. We did not decline, we simply moved communication to these more formal avenues since Mr. ****** was verbally abusive and hung up on us after we told him the vehicle was unsafe last time we spoke on the phone. We have a recording of this phone conversation.
    -the implication that our mechanic was trying to milk us is absurd as we never asked for him to pay for these issues. Mr. ****** is the one who kept offering to give us more money, resulting in more of a financial loss to his business than if he were to buy it back and regain his asset to do with as he pleases. We are requesting OUR money to be returned to us in the form of a buy-back of the original sales price. Mr. ****** is the one who is withholding funds that he is not legally entitled tohis insinuation that were greedy is a projection of his own immoral actions. In fact, his refusal to buy back the asset and his preference to take more of a monetary loss seems to prove that there are more issues with the vehicle that have been concealed/misrepresented since it sounds like his worst case scenario is to have to re-sell the vehicle.

    -At no point did we threaten Mr. ******s business and we have voice recordings of the conversations to prove it. His going back on an agreement only proves that he is NOT committed to customer service. If Mr. ****** was as committed to customer service as he claims to be, he would be eager to remedy his faults. If Mr.****** actually cared about his customers or business, he would immediately fix the mistake of selling us this unsafe vehicle that would have put our lives at risk had we trusted him.
