      This company did not do the job properly. They took a garage full of items that did not belong to them and did not return them to us even though it was in the contract. They overcharged us for things they didn't even do and then signed another agreement with us for both parties to be done with all responsibilities and are now billing us more and sending us to collections. Their whole process has been dishonest. They charged for things they did not do and stole our property. This is a completely dishonest company and it needs to be addressed.

      We acknowledge the concerns you raised in your recent complaint with the Better Business Bureau and appreciate the opportunity to address the issues at hand.
      Upon thorough review, it is important to clarify the following points:
      1.) Final Credit and Agreement: Our records indicate that a generous credit was applied to your final invoice, reflecting a comprehensive resolution to the matters in question.  You stated that we, Palm Industries, would be paid directly for the remaining supplemental invoices for overhead and profit, and thermal fogging deodorization, by your insurance company.  (Which you later called your insurance company and requested they actually pay you, instead of us which the insurance adjuster confirmed was paid to you for our services.)  Additionally, a Certificate of Completion was signed, affirming your satisfaction with the resolution at that time.


      2.) Contractual and Financial Obligations: The terms outlined in our contract were followed, including the return of specified items.  Our contract states that the Homeowner/Policyholder is ultimately responsible for all services rendered, despite your refusal to pay for the estimating services we provided for you which supplied you with more than enough funds to complete the work yourself while still collecting contractor overhead and profit. 


      3.) Communication and Unresolved Matters: We have made repeated attempts to communicate with you via calls, emails, and notices to address the remaining balance. Unfortunately, our efforts have been met with non-responsiveness on your part, as is common with customers who fraudulently retain their insurance funds rather than paying the contractor who performed the work.  This not an issue about the quality of work, this about a customer who wants to keep the most amount of money from insurance as possible which is insurance fraud. 


      4.) Text Message Confirmation: We have documented evidence, in the form of text messages, where you acknowledged your understanding that the remaining funds were due to our company. However, despite this acknowledgment, the funds were not remitted, and subsequent attempts at communication were ignored.
      Given the unresolved nature of this matter and the lack of cooperation, we regret to inform you that your account has been forwarded to a collection's agency. They will be pursuing the outstanding balance in accordance with legal and regulatory guidelines.


      We understand that business transactions can be complex, and our intention is to ensure fairness and transparency throughout the process. If you have any further concerns or questions, we encourage you to contact the collections agency directly.
      We regret that our previous attempts to reach an amicable resolution have been unsuccessful, and we hope that future interactions can be conducted in a more cooperative manner.

      I am rejecting this response because:

      The certification of completion was signed by both parties even though the job was not satisfactory completed and our property was stolen from our home and not returned as agreed upon in the initial contract. It was very clear when we signed that we would not be paying any more to Palm industries.  There were thousands of dollars of item taken from our garage and not returned to us and we were tired of trying to resolve that issue and the issue of the horrible work performed and work not completed that was charged for. We made an agreement just to be done with the dishonesty of Palm Industries.  We do have all of the pictures and documentation to back up everything stated.  We do no owe palm industries any more, in fact we feel that we were completely taken advantage of and had requested that our insurance company investigate the fraudulent charges from Palm Industries. we were also informed that after signing the completion form that Palm Industries was paid an additional $10,000 from our insurance company.

      The ********** were offered more than enough time to pay us what was due. The only reason this conversation is being stirred up is because he is now being pursued by a collections agency, who thoroughly reviewed the claim and respective documentation and agreed to take on the account.  We do not have the time and energy to engage with this client and their juvenile arguments justifying their insurance fraud.  We have also been instructed by the agency to not engage as they will pursue the matter moving forward.

      I am rejecting this response because:

      We do not own this company anything. They have fraudulently billed for services that were not completed. I have contacted the collection agency personally and was informed that they weee given minimal information about this billing that we do not owe.  I have all of the pictures and documentation from the horrible cleaning that was not completed and also all of the pictures of all of the stuff in the garage that was stolen from us by Palm industries.  The only reason that a credit was given to us was to try to cover up the theft that was commuted by Palm Industries employees.  The contract was very clear that nothing was to be taken from our home or disposed of without being signed off by us.  The fact that our insurance company was billed an addition $10,000 by Palm Industries after both parties signed an agreement to settle just shows that this company is still trying to get away with whatever they can. The signed agreement clearly states that we were paid in full but not satisfied with the work performed.  We had to constantly babysit this company and prove that they had billed for countless item that were not completed.  I have all of the pictures that prove this and all of the revised estimates that they had to complete because we and the insurance adjuster proved to them that they were fraudulently billing for things that were not completed.

      5.16.2023 palm industries entered my residence and removed my personal items including my bed vacuum etc . I contacted police . Palm industries promise to replace my property. They ended up leaving a filthy moldy mattress in front leaning against the front for all to see. They said my things were thrown away.. and have taped and said my home is unoccupied.!!

      Palm Industries did not bring a mattress back. The location of the home is located in an area where many questionable individuals commonly pass through and loiter, leaving garbage. We were hired by the home owner to do a job and we did it according to standards. I have attached the notice to vacate to this response.  Thank you.
