    This business removed our sand mound and filled our yard . When we hired them, they were to remove dirt away from our house and level the yard to be even and nice with proper water run off. The business left our yard with ruts from equipment and didn't complete the job like requested. He stated that removing the sand mound would help with water runoff, that we didn't need to do more. Discussed this with the business in great detail and he said he would come back and do what we originally asked, quoted us 5-6 thousand dollars. Business came back to re-do work. Stated in the bill that he removed 30 loads of dirt and brought in 9 loads of soil. Left our yard looking like we were placing a swimming pool. We asked him to stop and we would finish. Business sent us a bill for  11,400 . Tried to speak with business about the bill and what he did. Asked if he could prove the amount of dirt that was taken out and brought in and why would you take out that much dirt to bring more in. Business has not been eager to talk to us or rectify a solution. This project started early spring 2022 and business was just at our residence 7/2022. He placed a silt fence per our township, charged us 650. when the kit at ***** is 97$. For less than hour of work.

    Hi I received a letter in the mail from the better business bureau about a complaint at the **** and ********** ****** job reading this paper about the complaint I am honestly kind of confused last November the homeowner **** called me and asked me about removing a Sandmound in his backyard I told him it would be about 15 tri-axle loads that would be hauled away they also said about putting in a small swale in the backyard to help with water runoff and that is what we did when we did the job it was in February and the ground was still a little mushy we grass seated and spread straw and I told my customer the yarddidn’t get 100% perfect because how the ground was so mushy and it left indents of the tracks of the machine I told my customer it would be best if he has a lawn roller to roll over and he said that would be fine they also questions they thought I was going to lower the yard level with the back of the house and I said well we’re gonna need to lower the yard about 3 feet to do so and I did not quote you to do that I quoted to remove a Sandmound I said that is almost a whole Nother job he agreed and said that is OK write me up an estimate to perform lowering the yard roughly 3 feet and making it close to a “putting green” I said OK sounds great so I wrote up a new contract for the new job stating all the costs and what would be done and at the bottom of the contract it signed by ******** the wife. There’s really no way to prove that I took 30 loads out of the yard but that doesn’t really matter because whether if it was five loads or 100 loads the price was still the same because that’s what I quoted it the nine loads of topsoil that I brought in the explanation of that is the homeowner did not have good topsoil in their yard to make a nice yard and I told them we will just haul that out which might’ve only been 2 1/2 loads and instead we will haul in nice topsoil to make a nice thick layer of topsoil to make a really nice yard so all the material that was hauled out was subsoil which is not material that you used to make a yard and then I hauled in nine loads of topsoil for seating grass there’s really no way to prove that unless you go out and measure the depth of the topsoil and make a calculation The customer never asked me to stop and they never asked me any questions actually the wife ******** text me the night after I was done and said how good it looked A few days later I emailed **** the bill and he replied that it was almost double of what we originally talked about and I responded and said what do you mean The job was never going to cost $6000 I have everything written out on the contract of what it would be with their signature at the bottom when the job was getting finished up and we were grass seating **** the homeowner said don’t worry about grass seating because he wants to redo the front of the yard and he will just do it all at once and I actually had the township engineer call me asking why it wasn’t seeded and I responded and said the homeowner told me he was going to do it himself at this time there was no bill or anything made up on the contract I have stated it was going to be roughly around $350 for the grass seed and straw and I only build them for the bag of grass seed that I already had on the lawn when I was told they were just going to do it themselves I then contacted the homeowner **** to let him know that the township engineer said something about their yard not being seated he replied OK thank you for letting me know I will get it done this letter is kind of a shock to me because they never said anything to me about having any problems if you need to please give me a call at ###-###-#### I am going to Scan and attach the contract and the bill four remove in the yard also along with a couple pictures I took during the job and a screenshot of ******** the wife texting me that night saying how good the yard looked And also I can guarantee other excavator was in there it would have cost much more

    This will be my last rebuttal to this claim. I wanted this to be professional and respectful but it's turning south.
    My text message was not complimentary in the least but passive aggressive, the video was of the hole left for our yard and the soil with rock and garbage.  We brought in 9 loads of screened soil to complete our yard along with a week off work and the help of another excavator for 2 days for another 9500$. Our neighbors did the same.job and added a new drive way for less than what we were charged . So no favors were really given there,like he stated. If his work past and present is on the up and up then shame on us. We want this behind us ,the time and effort isn't worth it anymore. We also "seeded" and placed straw for an additional 900$. Civil court is an option to us from a more legal stand point.  We arent interested in putting out anymore of our money towards

    After I receive the first complaint I emailed it to **** which is the husband and asked him what it was about giving him the benefit of the doubt I think he maybe he didn’t get that email I text him and asked him what was wrong and the message says that he read it but he never replied. Like I said before in my past email it didn’t seem like there was a problem with the work or anything until they got the bill I think they’re just mad because they thought it was gonna cost $6000 when obviously that was not the case which it was stated in the contract I just think they’re mad at their self because they didn’t read the contract and I had an itemized out perfectly for them honestly I think this claim is a bunch of garbage if they want to take it to court let them because it would never stand I did exactly What was stated on the contract in the second letter I received it states that they bought nine loads of screened topsoil screen topsoil in this area runs for about $650 a load delivered and if they would’ve had nine try axles of topsoil delivered that would run them around $6000 in about $3500 for excavating work to spread that out which is a pretty high price just to spread topsoil out and rake it off also they stated they paid $900 for Grass seed and straw but are in the original contract I only charge them 350 for that which I ended up not even charging because they wanted to grass seed it themselves because they wanted to do the front yard in the backyard all at one time and they were not ready to do anything with the front yard yet And as far as the nine loads of topsoil they brought in I drove by the property the other week just to take a look and if there were nine tri-axle loads of material in there I would’ve been able to see quite a difference in the grade because that comes out to an extra 225 yards that they would’ve brought in and it seemed to be that there was no change other than there was grass planted and say for example it was nine loads of a smaller truck like a tandem axle or a single axle dump truck that just shows how much they got ripped off by somebody else I did not charge them for screen topsoil because I did not bring screened topsoil even though the topsoil that I brought was very nice material and I took a prepper raider over it when it was finished I don’t think they would be very happy if I brought in screen topsoil and charge them $650 for a load but giving when I drove by the property the other week and seen that the grade was virtually unchanged it leads me to believe that it was not a tri-axle that delivered the nine loads of topsoil from the other excavator if they paid $9500 for someone else to come in and finish that that’s ridiculous the pictures that were attached in this letter did not come through in the beginning of this second letter I received the customer stated that this is turning south? My question is how is it turning south I think they just realize they don’t have any standpoint at this I did exactly what the contract stated I would do and the bill was 100% within the Parameters of that Bill
