On March 29th my vehicle was gone and i called and they said it was repossessed. I never got any voicemail, no letters or signed anything. I left my asthma pump in vehicle, wallet, work equipment. Paperwork for my sleep apnea, air pods, Sun glasses, shoes. Putting my life at risk. I demand Original Validation proof that the repossession of the subject vehicle was legal in accordance with the following UCC: • § 9-506. EFFECT OF ERRORS OR OMISSIONS. • § 9-611. NOTIFICATION BEFORE DISPOSITION OF COLLATERAL • § 9-612. TIMELINESS OF NOTIFICATION BEFORE DISPOSITION OF COLLATERAL. • § 9-613. On 04/08/2023 I got an credit alert stating that I am passed due on a car note of a totalled car. **** sent a check for about $17,570 about 02/20/23 and on 03/30/23 my account was sent to a different department in Flagship where we have payment arrangement scheduled for $200.00 beginning 04/14/23. The reason I called on 03/30/23 was because I was sent an email stating that they tried to contact me was a lie. The last phone contact was on 02/15/23 when I called to find out my options before I took the settlement. Then I received a letter stating sorry about your accident but you still need to pay your car note not even knowing whether or not I was injured which I was.Business Response

Attempted to log onto our account April 6, 2023 to make car payment. The account was locked out. Called the company to get access to account information, we were told that the account was locked and reported to collection as of April 2, 2023. We aren't allowed access to our account unless we continued to process the payment over the phone. We are attempting to take care of this payment, but yet now this is in collections and no one there is willing to cooperate.Business Response

I had an auto loan with Flagship acct *********** and my car was totaled on Dec 12, 2022. *********** insurance paid my car in full leaving a zero balance. I had additional Gap, scratch and dent insurance on the car. Since the car was totaled the policies were also canceled and a refund was sent to Flagship. Since my account was zero the refund was to be sent to me. I have made several attempts to obtain a status on my refund. The first check in the amount of $459.82 was cashed by then on 02/07/2023 and the second check in the amount of $93.60 was cashed by then on 03/15/2023. This is a total of $553.42 that is due to me. I’ve called several times and they stated they have not received the checks even though I’ve emailed them copies. On Friday March 31,2023 I was able to obtain a fax number which I faxed the checks. When I called today I spoke with a supervisor named ***** who stated the copies of the cashed checks were received but she cannot tell me when I will receive my refunds. Again I was told I have to call back. When asked if I could speak to a manger she said no she would take a message and have someone call. This is unfair that my car was paid off and I’m still waiting for my refunds and no one can help me.Business Response

We purchased a newer vehicle, January 17th 2023 and the very next day a payment was due on January 18 flagship pulled the entire payment out and ****** paid them off on 1/17/2023 we notified them and advised them on the 17th that we had paid off that truck. They advised us they would have to issue a set back once I got the payout. Then they realize they **** the full payment and said they were going to mail it to us and sent it to the wrong address. We call them and advised they stop payment and Reissued us a second check this check we live in Florida they sent to someone in Arizona at a different house location everything they had a tracking number. We looked it up and advised them it went to a ********* They are now stopping payment on that check and reassuring. Yet a third check. This is been going on since January 18 unresolved multiple weekly phone calls and still no payment for the overpay.Business Response

Re: (Account# *********** ***********************)Less than a month ago, I called Flagship informing them I would like to have my interest rate dropped, so my payments would decrease from the record, $1255 a month I was forged into. My complaint was with the South Clearwater ********* Dealership and Flagship accepted the illegal term of a record high 17% on my loan. The loan was originally supposed to be at 10%, but I was threatened with no car if I didn't sign the loan. I bought the 2023 ***** ****** in Oct of 2022. Since than, I have been unable to make the record payment due to the issues all Americans are suffering with inflation. I called Flagship hoping to lower that payment, but I was immediately denied and told, "Too bad". So, I asked them to repossess my car voluntarily. Upon stating that choice, I was asked 100,000 questions of why and why I couldn't make the payment. After an hour, I was finally able to get the representative to calm down and he agreed the car would be voluntarily repossessed within a few weeks time. He also stated I would hear from someone within 7 days. Since than, I have heard nothing and it is now going on 4 weeks. I have called several times and sent several emails, but I have been ignored. I have taken the advice of an attorney and am cancelling the car insurance as of March 31st and the plate will be removed. All I want is an apology from this business in accordance to my anxiety and stress they are causing by not sticking to their plan. Also, I would like them to pick up the car immediately at the following location as previously mentioned: **** **** **** Zephyrhills, Fl ***** They were not willing to decrease my payments, so I am asking them to stick to their agreement and repossess the vehicle.Business Response

I am rejecting this response because: I did not electrically sign any agreement. I showed up at the dealership, with the intention of signing an agreement at 10% interest. When it was shown as different, I was promised the rate would be lowered upon leaving the dealership. A complaint to the state was made about the dealership and its horrible practices. Also, the 17% interest rate was reported as unfair credit practices and it was agreed by one of the Flagship advisors the loan should never have been approved. This was considered predatory, in which I still have the option of filing a complaint to the US Govt over these practices.

I am rejecting this response because: I have reported this issue with the State of Florida and the predatory practices of Flagship Credit are well documented throughout the United States. I don't see a fair investigation within the same company that provides false hope to those with low credit. In all honesty, you should have rejected the application, but instead you took advantage of a customer in this time of record inflation. I am unable to pay the record payment of $1255 and I stated that in the beginning of the loan. I did not sign any documents with my own hand and you are more than welcome to garner any video evidence that will support my claim. At this time, I afforded my right under the Fair Credit Act to have your company possess my vehicle without further payment. I am rejecting this response because: I don't agree with the decision, despite the current issue with the car that caused me to turn the car back in. The dealership in Clearwater was unable to resolve the deficiency of the blendor actuator and its ability to fog the windshield. The vehicle was checked on 2 separate occasions and I was told I would have to live with the fogging of the windshield, but there is a recall that was not performed. At this time, I am being represented by an Attorney against Flagship and Chevrolet.

Purchased a vehicle in CA with a "clean title" had it brought to Florida where I live ( I want a economic fuel rated vehicle from CA) . 1)The vehicle has evidence of being involved in an accident which was reported to me by my certified mechanic at ******* Collision. 2)Also, the contract was prepared improperly, for the finance and the vehicle was placed in my name instead of my company's LLC name for insurance purposes; Now the states on my behind about insurance, and I can't get it insured because of the name on the contract! I've called flagship 3x's in the last 3 weeks, my sales rep that sold me the vehicle has also called flagship to inform them of the mistake however, flagship has been ignoring me and seems like they're intentionally dragging this out, so the state defaults me and repo's the vehicle. I have reached out to FLAGSHIP CREDIT ACCEPTANCE. They have disregard my complaint, have failed to respond and have failed to validate the alleged claim pursuant Fair Credit Reporting Act 15USC §1681, you are required by federal law to verify, through the physical verification of the original signed consumer contract, any and all accounts that you post on a credit report. Also, they are reporting inaccurate and incomplete credit information. I demand these late payments be removed from my credit report immediately. At no time I have I given consent for my information to be published and it is a violation against my privacy, which is aggravated identity theft. You also do not have any permissible purpose to furnish my personal information to any third party. Your company is in clear violation of the law. Under 15 USC §1681b - permissible purpose of consumer reports, THE LAW CLEARLY STATES: a. IN GENERAL Subject to subsection (c) any consumer reporting agency may furnish a consumer report under the following circumstances and no other: (2) In accordance with the written instructions of the consumer to whom it relates. Yes I am a consumer or should I say my husband is. I am the one who handles the account most of the time. When have had a few issues since the beginning of the time getting the car from covid related to military moves. We have gotten behind and had to submit paperwork such as power of attorney that was not an east process. More recently we were told the account was charged off without email or written notice. I literally called the customer service number 50 or more times and sent several emails. I only got through three times in which no one could help due to "phone issues". When I got through to the last rep by the name of ******** she informed me she got ahold of another account manager that would be giving me a call before the night ended and that did not happen. I would just like better communication help or programs for people who serve the country when things get tough for them and their families. On top of this payments still have been taken although less than the amount of regular payment but nothing has been returned/refunded. Last payment being made in February.Business Response
