We purchased a home in early July 2023 and upon move in, items laid out in the sales contract, sellers disclosure, and addendum of repairs were not completed. We requested invoices for the repairs as they were not easily reachable, and they were provided from Pamela. Upon moving into the house, we had contractor's doing other various work, who noted that certain things included in the addendum of repairs were not completed. The AC was also not installed (per the sellers disclosure central air was included in the house). The thermostat was not even programmed to select cool air, only heat. (we still have the thermostat that had to be changed). Pamela A*** was the seller's real estate agent and refused to contact the seller about the issues, per our real estate agent. We attempted mitigation with the seller but since the seller set up a shell LLC, they "do not have money" to compensate for fixes and items that were supposed to be part of the house. Through several conversations with Pamela's Remax location, they were unable to help us. I want to file this complaint because Pamela is clearly working with sellers that are misrepresenting the houses they are selling. We have objective evidence to show this fact since there are things that were never completed, and invoices alleging the work were sent from Pamela, but the work was not done. Per Pamela the AC just "needs a copper wire plugged in". She is not an HVAC expert. We also have an invoice of the work that had to be completed to get the AC functioning. The real estate agent and corresponding brokerage should be just as responsible as the seller to compensate for such breaches of contract. Individuals and families should not be responsible for such misrepresentations on behalf of brokerages. This should serve as a warning to anyone that enters into a potential purchase from Pamela or Remax in Pittsburgh. We have endured a lot of trauma as a result, only to be told it's our fault we lost approximately $10,000.

    Business Response

    Date: 12/22/2023

RE/MAX Home Center has been made aware of the dispute between the Customer (Buyer) and the Seller and has made attempts to encourage a resolution between the parties. Since it is mandatory under the terms of their sales agreement that the Customer (Buyer) and Seller submit their dispute first to a Board of Mediation, which is currently pending at this time, it would be inappropriate for RE/MAX Home Center to comment, speculate or discuss their dispute in this public forum. Rest assured that RE/MAX Home Center has had numerous discussions with the parties, each of them, to attempt to facilitate a resolution, with no success. Moreover, any comment by RE/MAX Home Center would be improper since RE/MAX Home Center cannot speak on the Seller’s behalf and/or about Seller’s defense. RE/MAX Home Center will not make any statements regarding this Complaint since the dispute between the Customer (Buyer) and Seller has not yet been mediated or thoroughly litigated. RE/MAX Home Center has been informed of the parties’ intent to seek mediation as required, and also the Seller’s intent to defend this matter. Further, the Customer (Buyer) was independently represented by a separate real estate firm that worked on Customers’ (Buyers’) sole behalf during the entire process, including inspections, walk-through and settlement. Respectfully submitted.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

The seller refused mediation, the comment from ReMax is inaccurate. They’re just skirting liability.
