    They’re advertising an ****** **** *** **** Legacy tour, and not clearly disclosing that this is not the actual band. It’s a cover band consisting of a member that may or may not have played with the original band. the real Earth wind and fire band is actually suing and has active litigation against his legacy touring company because it’s misleading. Santander arena is not clearly disclosing that this is a cover band and lets them use language that the original band uses that’s misleading to the consumer you think you’re buying tickets to see the actual Earth wind and fire band when what you’re getting is a cover band with none of the original members.

    The venue is placing blame on the promoter, ************************* with ************************ LLC. While it is true that the promoter plays a significant role in marketing and organizing such events, it is also important to acknowledge the legal and ethical responsibilities that the venue holds in ensuring transparency and compliance.

    During the *** Legacy Reunion show, it was evident that the band on stage was not the genuine ****** **** * **** Legacy band but rather a tribute or cover band. This was a crucial piece of information that was not adequately communicated to attendees in the event's promotional materials.

    I would like to emphasize the following points:

    Legal Obligations: Venues have a legal obligation to provide accurate and transparent information to consumers. This includes ensuring that attendees are aware of the nature of the performance, especially when it involves tribute or cover bands.

    Copyright Compliance: Tribute or cover bands often need to adhere to copyright and licensing agreements, which can vary from one performance to another. The venue should have ensured that all necessary permissions and licenses were in place for the event.  There is pending litigation with regards to this cover band and copyright fraud, they do not have licenses to perform this music.

    Consumer Trust: Maintaining consumer trust is paramount. Attendees have a reasonable expectation that the venue will deliver the experience they paid for. When there is a discrepancy between the advertised act and the actual performance, it erodes that trust.

    Given these concerns, I kindly request that the venue takes the following steps to address the situation:
    a. Acknowledgment: Please acknowledge the venue's responsibility in providing accurate information to consumers regarding the nature of the performance and provide the cover bands licenses to perform songs by ****** **** *** **** band.
    b. Review Procedures: Consider reviewing your event approval and oversight procedures to ensure that the content presented aligns with the promotional material and contractual agreements.
    c. Transparency: Going forward, ensure that your venue is transparent about the nature of the performance when tribute or cover bands are involved, both in promotional materials and during the event.
    d. Compliance: Confirm that all necessary copyright and licensing agreements are in place for future events to prevent potential legal issues.

    e. Ensure my full refund from ************ is processed.
