I took out a payday loan from this company late last year. I had taken out several before with this company and paid them all back. Suddenly I lost my job, and was unable to keep making payments. Advance America sent me some texts and emails, I replied to them about my situation. They never followed up with me, never tried to get me on any hardship plan, never checked in with me, and now they're wasting their money and everyone's time by having Enterprise Recovery harass and threaten me. ******** close this, I am not paying some scummy collection company because you guys chose to ignore when I reached out for help during one of the most difficult periods of my life I've ever had. I almost got evicted.Business Response

RE: ***** ****** - Complaint
ID: ********
Dear Cindy:
Advance America, Cash Advance Centers of Colorado, LLC (“Advance
America”) is in receipt of a complaint filed by ***** ******. We have
thoroughly reviewed and appreciate the opportunity to respond.
In the complaint, ***** ****** asserts they had originated a new
loan last year; however, lost their job and was unable to continue satisfying
the required payments. ***** ****** states, “Advance America sent me some texts
and emails, I replied to them about my situation” and “They never followed up
with me, never tried to get me on any hardship plan, never checked in with me,
and not they’re wasting their money and everyone’s time by having Enterprise
Recovery harass and threaten me.”
Our records indicate that ***** ****** entered into a Customer
Loan Agreement (“Agreement”) with Advance America on August 10, 2023. Pursuant
to the Agreement, ***** ****** agreed to repay an amount of one thousand two
hundred dollars ($1200) in twelve (12) bi-monthly installments of one hundred
dollars ($100) due on January 19, 2024. ***** ****** made total payments of one
hundred dollars ($100) as agreed. After multiple unsuccessful attempts to
collect and contact ***** ****** regarding their past due balance, their loan
entered default on October 2, 2023, which halts all interest from accruing.
When no further payments were received, ***** ******’s loan was sold to
******** **** ******** on February 25, 2024, with a balance of one thousand
eighty-five dollars and eighty-nine cents ($1085.89). We recommend ***** ******
reach out to ******** **** ******** at ***** ******** to discuss mutually
agreeable payment options.
Upon receipt of ***** ******’s complaint referencing Advance
America not checking in with them nor answering emails sent, we are truly
perplexed. We do not have a record of ***** ****** emailing Advance America or
calling to discuss their situation. Advance America sent multiple emails and
texts with instructions on how to cure their past due balance and provided
phone numbers ***** ****** could contact to discuss their situation and request
further assistance. Unfortunately, at this time, Advance America no longer
holds the loan, therefore, ***** ****** will have to contact ******** **** ********.
This letter is written under a full reservation of rights and is
not intended to be, nor should it be construed as, any admission of liability
or as a waiver of any rights afforded Advance America, Cash Advance Centers of
Colorado, LLC under any applicable laws, statutes, or procedures.

In Ohio, Advance America was registered as a Credit Services
Organization. They assisted customers by gathering information for NCP Finance
Ohio, LLC (the "Lender"), which used this information to decide
whether to issue a loan. Approval or denial of the loan was based on the
Lender's criteria. If approved, the Lender funded the loan as specified in the
Promissory Note. Upon the customer's request and in exchange for the loan,
Advance America provided a guaranty to the Lender for the amount specified in
the Promissory Note. If the customer defaulted, the Lender demanded payment on
the guaranty for the outstanding amount. Consequently, due to the customer's
non-payment and the Lender calling the guaranty, the customer would owe Advance
America the unpaid loan amount initially provided by the Lender.
According to our records, ******* ****** entered into a
Promissory Note with the Lender on December 6, 2017. Pursuant to the Promissory
Note, ******* ****** agreed to repay an amount of one thousand twenty-three

If ******* ****** did not originate the loan discussed above,

whether to issue a loan.
As stated in the May 17, 2024, response, according to our
records, ******* ****** entered into a Promissory Note with the Lender on December
6, 2017. Pursuant to the Promissory Note, ******* ****** agreed to repay an
amount of one thousand twenty-three dollars and forty-nine cents ($1023.49) in
thirteen (13) bi-weekly installments of seventy-eight dollars and seventy-three
cents ($78.73) due on June 8, 2018. We have mailed the agreement to ******* ****** for their review as well as attached it to the response. ******* ******
made total payments of two hundred two dollars and twenty-three cents
($202.23). After multiple unsuccessful attempts to contact ******* ****** and
collect their past due balance, their loan was sold to ***** ******** on June
10, 2022, with a balance of eight hundred eighteen dollars and thirty-five
cents ($818.35).
If ******* ****** did not originate the loan discussed above,
they may send in a Police Report or FTC Identity Theft Report to [email protected].
We recommend ******* ****** reach out to ***** ******** ** ***** ******** to
discuss mutually agreeable payment options and concerns related to their credit
report.

RE: **** ****** * ********* *** ********
Dear Cindy:
NCAS of Delaware, LLC (“Advance America”) is in receipt of a complaint
filed by **** ******. We have thoroughly reviewed and appreciate the
opportunity to respond.
In the complaint, **** ****** asserts they are no longer in a
position to pay anything on their loan as they are not employed or have a
residence.
According to our records, **** ****** entered into a Consumer Loan
Agreement (“Agreement”) with Advance America on October 28, 2014. Pursuant to
the Agreement, **** ****** agreed to repay an amount of six hundred sixty-nine
dollars and thirty-four cents ($669.34) in nine (9) bi-monthly installment payments
of sixty-six dollars and ninety-five cents ($66.95) and one (1) final
installment payment of sixty-six dollars and seventy-nine cents ($66.79) due on
March 13, 2015. **** ****** made total payments of three hundred thirty-four
dollars and seventy-five cents ($334.75). **** ****** had a remaining balance
due of three hundred twenty-six dollars and thirty-seven cents ($326.37). No
further payments were received to date.
As a courtesy and with no obligation to do so, **** ******** past
due balance of three hundred twenty-six dollars and thirty-seven cents
($326.37) was waived; therefore, **** ****** no longer owes a balance to
Advance America.
This letter is written under a full reservation of rights and is
not intended to be, nor should it be construed as, any admission of liability

applicable laws, statutes, or procedures.
