      A Caller name Victor contacted me today about a personal loan that I am seeking, but how they got the details of my application is unknown. Stating that I have been approved for a loan and if I am still interested in getting the loan and that i have been approved for $2500 and up to 8,000 and I told them I would like the full $8K. Victor then connect me with his Account Team Manager who she call herself by the name of Sharon C****** Sharon sent me some documents to review and sign and I told her that I am not signing any documents and giving out my account login or password and told her this company name she is using is a Fraud and I will report her and told her to get the F... off my phone and never called me again and hung the line. Caller Sharon C***** as she calls herself calls me back and starts threatening me.

      In
      the complaint, ****** ****** states they were approved for a loan, “…for $2500
      and up to $8000 and I told them I would like the full $8K.” ****** ******
      states they were provided documents to sign, however, they would not sign them
      or provide any further information. ***** ****** provided the documentation
      received from “**********************************” and “Cash Advance America”
      with their complaint.

      After
      a diligent search of our records, there are no accounts using the personal
      information provided by ****** ****** in their complaint. Advance America
      employees do not utilize email address on the server “@gmail.com” for business
      purposes. Advance America does not offer loan amounts of eight thousand dollars
      ($8000) in the state of Texas. Lastly, Advance America is not affiliated with
      the business name “Cash Advance America.”

      The
      actions complained of appears to be part of an effort to defraud consumers,
      like ****** ******, by falsely claiming to represent Advance America. Advance
      America has previously communicated similar efforts to state and federal
      regulators as well as the Federal Bureau of Investigation and local law
      enforcement agencies.

      states, “Cash advance America scam me out of 5,000 they promised a loan instead
      they took money out my account and then overdraft it with false checks please
      get my money back his name is **** his number is ************** thank you I
      just want and need my money back please”.

      According to our records, ****** *****
      entered into a Customer Loan Agreement (“Agreement”) with Advance America on
      November 19, 2014. Pursuant to the Agreement, ****** ***** agreed to repay an
      amount of three hundred sixty-six dollars ($366) on or before November 27,
      2014. On December 24, 2014, an ACH debit was presented to ****** *****’ bank
      account, however, returned unpaid on December 26, 2014, which resulted in a fifteen
      dollar ($15) returned item fee. After multiple unsuccessful attempts to contact
      ****** ***** regarding their past due balance, their loan was sold to Quantum 3/Sandino
      Funding on July 20, 2015, with a balance owed of three hundred eighty-one
      dollars ($381). We recommend ****** ***** reach out to ******* ********* ******* at ************ to discuss mutually agreeable payment options.

      With regards to ****** ***** assertions
      above, Advance America is not affiliated with the business “Cash Advance
      America”. Additionally, Advance America would never deposit funds into a
      customer’s account only to request their immediate return. Advance America

      I made a payment on my line of credit loan, on 2/15/2024 I made a payment above what was due. This made my balance 1077.10, my next due date was to be on 2/29/2024 , everyday the high interest loan accures interest, the lady working today told me since 2/15/2024 I had accured 28.14 intrest which would make my total pay off 1105.24, I told her I wanted to pay it off today, she said well it's gonna be 1167.99 to pay it off today because your next due date shows this amount, yes it would have been with accumulated interest if I didn't make my payment til 2/29/2024. , but I wanted to pay what I owed as of today off. The lady working in the store totally agreed with me and said. They can't continue to charge you interest accruing if you pay it off today as banks can't do so if you pay off early, she called her manager and explained what was going on and her manager said he has to pay the amount that would be due on the 29th in order to pay it off, the charged me the additional amount 1105.24 should have been today's pay off but I had to pay 1167.99 to close out the loan cause the actual due date wasn't til 2/29/24. I payed that amount today 2/21/24 so that my account would get closed and payed off and no other interest could accur, I told the lady working there today after I payed it off that I was filing a complaint with BBB. And they will have to answer to that they made me pay 62.75 more then what should have been owed as of today's date. You can't keep charging daily intrest if you pay off loans early

      paid off the LOC in full in the amount of one thousand one hundred sixty-seven
      dollars and ninety-nine cents ($1167.99).

      We have reviewed
      ***** ******’ complaint with our branch team to ensure accurate information is
      provided to the customer. We apologize for the inconvenience and appreciate
      ***** ****** bringing it to our attention. ***** ****** will need to visit the

      records, ***** ****** entered into a Customer Loan Agreement (“Agreement”) with
      Advance America on June 26, 2021. Pursuant to the Agreement, ***** ******

      before July 7, 2021. In accordance with the assignment clause outlined in the
      Agreement entered into by ***** ******, Advance America has the authority to sell

      In
      the complaint, ****** ******* states, “This company sent my information to
      credit bureau this information is false I never took out any loans with this
      company’s (sic) in December of 2023.” ****** ******* states, “This company
      would not allow an individual to have multiples loans if they were not paid
      these are fraudulent charges, I want this off my credit report.”

      In
      Ohio Advance America was registered as a Credit Services Organization. Advance
      America assisted customers in gathering information to provide to NCP Finance
      Ohio, LLC (the “Lender”), so that the Lender can make a decision whether to
      issue a loan to the customer.  The
      customer was approved or denied based on the criteria set by the Lender. When a
      customer was approved, the Lender then funded the loan in the amount identified
      in the Promissory Note. At the customer’s request, and in consideration of a
      loan extended by the Lender, Advance America issued a guaranty to the Lender in
      the amount identified in the Promissory Note. In the event the customer
      defaulted, the Lender called for payment on the guaranty to the extent that it
      is outstanding. Due to the customer defaulting on the loan for non-payment, and
      the guaranty being called by the Lender, the customer will then owe Advance
      America the unpaid loan amount, which was originally loaned to the customer by
      the Lender.

      According
      to our records, ****** ******* entered into a Customer Installment Loan
      Agreement (“Agreement 1”) with Advance America on August 25, 2017. Pursuant to Agreement
      1, ****** ******* agreed to repay an amount of one thousand one hundred thirty
      dollars ($1130). ****** ******* made total payments of six hundred eighty-eight
      dollars ($688) as of January 27, 2018. When no further payments were received, the
      loan entered default on February 23, 2018, which halts interest from accruing.
      ****** ******* made a payment of one hundred twenty dollars ($120) on February
      24, 2018. No further payments were received after that time. After multiple
      unsuccessful attempts to contact ****** ******* regarding their past due
      balance, they loan was sold to ***** ********* *** on March 10, 2021, with a
      balance of four hundred thirty-six dollars and ninety-one cents ($436.91).

      According
      to our records, ****** ******* entered into a Customer Payday Loan Agreement
      (“Agreement 2”) with Advance America on December 30, 2017. Pursuant to Agreement
      2, ****** ******* agreed to repay an amount of nine hundred thirteen dollars
      and thirty-one cents ($913.31). After multiple unsuccessful attempts to contact
      ****** ******* regarding their past due balance, their loan was sold to ***** ********* *** on March 10, 2021, with a balance of nine hundred eighteen
      dollars and twenty-seven cents ($918.27).

      If

      a copy of their police report or FTC Identity Theft report to

      loan agreements executed by ****** ******* on August 25, 2017, and December 30,
      2017, are no longer within our records. They were executed over six (6) years
      ago, under the jurisdiction of Ohio law. Ohio’s regulations mandate that
      licensees retain loan documents for at least two (2) years after the final
      entry or revision (Ohio Rev. Code Ann. § 1321.422). As a licensee, we adhered
      to this requirement and duly maintained the agreements. Nevertheless, after
      more than 6 years have elapsed, the loan agreements are no longer on file with
      us.

      Advance America, Cash Advance Centers, Inc., (“Advance America”) is in receipt of a complaint filed by ***** *******. We have thoroughly reviewed and appreciate the opportunity to respond.

      In the complaint, ***** ******* states, “This company has sent me an email stating that I owe money for a payday
      loan that I never applied for and is being threatened by the company.” ***** ******* states, “I have reached out to the company and they are stating they
      cannot find anything on file for me.” ***** ******* provided the email from “Cash
      Advance America Payday Loan” and “[email protected]” with their
      complaint.

      After a diligent search of our
      records, we could not locate any accounts using the personal information
      provided by ***** ******* in the complaint. Advance America would never
      threaten a customer with legal action that could not lawfully be undertaken,
      nor would it condone such behavior by third parties acting on its behalf. Further,
      Advance America is not affiliated with the company name, “Cash Advance America
      Payday Loan”. Advance America employees do not utilize email addresses on the
      server “@gmail.com” for business purposes. Lastly, Advance America does not
      operate any brick-and-mortar storefronts in the state of Illinois, nor does it
      offer online services to Illinois residents.

      The actions complained of appears
      to be part of an effort to defraud consumers, like ***** *******, by falsely
      claiming to represent Advance America and further using what appear to be
      improper and illegal collection practices while doing so. Advance America has
      previously communicated similar efforts to state and federal regulators as well
      as the Federal Bureau of Investigation and local law enforcement agencies.

      We recommend ***** ******* continue to document all details of any such actions and communications
      in the future, not disclose any personal information to the individuals, and,
      if appropriate, report such communication to law enforcement or other proper
      regulatory authorities for further investigation.
