    Breach of Contract. Choose a design with exact measurements. A mistake was made with measurement. Company wants me to pay for fix!!

    Changes to the original design did happen, which is normal, but she approved of the changes. Mrs. ***** approved the final handrail design on April 26, April 28, and May 2nd. She only complained about the change in height, which she approved of 3x, after payment became due. 

    The pdf file shows that as our crew neared completion, she lodged a barrage of complaints which were all unsubstantiated except for her concern over finding a missing electrical outlet that wasn’t reinstalled. We were pro active on getting on site to find the missing outlet but she wouldn’t let us go get the issue fixed.

    She also withheld payment because she was supposedly getting an inspection done. She got the inspection done so we asked for payment. She stated she was waiting on a written “inspection report”. Turns out that she was never waiting on such report! 

    She then resorted to berating our workers in an attempt to not pay. We told her our workers are highly skilled and the end product was proof of that. 

    Mrs. ***** has no substance to her claim that we breached our contract as she approved the changes to the original agreement. Today we offered her a resolution that we thought was very kind. We offered to install a top rail for free with the condition that she buy material from a supplier of her choice. She declined. 

    She is not acting in good faith. To the contrary, she has shown a pattern of lying. We can not perform more work or furnish more material knowing that she will likely not pay even if the extra work is performed. That’s why we offered to do the labor for she with her buying material. If she was honest about her concern over the handrail height, she would’ve approached this offer seeing as she has no basis to withhold payment. Instead she declined because she doesn’t intend to pay anything. 

    we are going to file legal action against her soon.

    The Breach of Contract has been corrected. Once I involved my daughter to advocate on my behalf, a suitable railing height correction was quickly made. Please remove the Breach of Contract Complaint. Thank you for the assistance also of your Mediation, Ivy *****
