      I joined ********************** officially on April 16 2024 when I paid for our membership (check # *** for $3,743.93). At that time I was told boats would be ready in May. When the boats were not ready in May I sent a notice of default and request for a refund on June 24 2024. At that time I was contacted again and I was told I misunderstood when I was told that boats would be ready by May and instead, boats would be ready by July. First - I did not misunderstand. Boats were promised to be ready by May and before Memorial Day. We specifically had a conversation about this. Second - Boats were not ready in May nor were they ready in July. As far as I know they are still not ready and its now late October.I sent a second letter on Oct. 11th officially demanding a refund and contract cancellation due to not meeting the agreed dates, not communicating and defaulting on the contract intent and terms. A copy of that letter is attached. To date I have not received my refund. I do not want any other resolution other than a refund. I do not trust anything this business communicates or promises and have no interest in continuing a relationship since all terms and conditions have been missed and ignored. A refund and cancellation of goods and services NEVER provided is the only resolution.

      To whom it may concern,

            I have attached a copy of the executed contract between ********************** ***** and Destination Boat Club.  The contract states that No monthly dues are payable until the Club opens this particular location.  The process that was explained at the time of signing was the ******* are one of Ten members needed to open this location and no payments would be due until then.  In the last three months we have reached out to the ******* multiple times regarding the upcoming opening of this location, and they have not responded until recently when we became close to opening and fulfilling our commitment to all of our members.  Training has begun for all members who have also signed similar contracts with the exact wording and understanding of the process.  We have not required any of our members (regardless of when they signed) to begin their monthly payments until December 1st of this year.  

          *********** has 18 current active locations that all went through the same process when each of them opened. Each with the same contract wording, same start up process and same timeframe from initial members to fully operational. Exactly like new housing developments have "Pre-Construction"  pricing, receiving deposits, and pre-selling before construction begins. 

          We have been doing business this way since our inception and never had any type of complaint or issue with any of our Members.  We will continue to satisfy our commitment and contractual obligation to all of our members.  ******************** are not in any violation of their contract as long as they begin their payments "As Agreed" on December first.

      I am rejecting this response because:

      To start - there was NO discussion whatsoever about opening in December.  The ONLY discussion had was a May 2024 date. THAT is when we were promised the club would "open".  I was specifically told "by Memorial Day".  We even talked about the new boats already being purchased and delivering to the ****** in "just a couple of weeks".

      Additionally - there has not been a bit of communication since I joined.  The only time I heard from the office was when I asked for a refund the first time (in June after not hearing anything for 2+ months) and after I filed this BBB complaint in October, because I had not heard back from anyone after sending a second notice.  I would ask to see 1 email with an update to me.  Please.  If its an email, the records exist.  Please provide the emails.  I promise there isn't one.  They have had almost $4K of mine since April with virtually no communication at all unless I request a refund - then I hear from someone with unfulfilled promises.  

      Opening in December, in the middle of winter, after holding my money since the prior Spring, is completely unacceptable.  I have no desire to continue as a part of this club.  No communication.   No fulfillment of any commitments.  I do not have time for this.  I have lost trust.  Either a refund gets issued or I will file in the local court.

      It is now Nov. 13th 2024.  Per the BBB response, the club is opening in December and dues will be collected starting Dec. 1st, yet I do not have 1 single update that this is the case.  Nothing.  

      Not that there is anything I can do about this part, but to make it worse, the "special one time only" price that paid $3,743.93 and $399 + tax in fees, is now being advertised for everyone else at $1,999 and $379 month (see attached).  So yet again, a promise that I was getting a special deal, is untruthful as they are now advertising prices cheaper than I paid and they've had my money since April.

      Good Afternoon, 

          In response to this latest customer rejection, we reiterate our position that we entered into this contract with Mr. ***** in good faith with regards to the ********* opening.  The owner has had many attempts to reach out to Mr. ***** by phone in the past months and being avoided by him on every attempt.  Even one time finally getting Mr. ***** to answer the phone and probably realized he had answered by mistake knowing the owner was reaching out and immediately was told he would call back because he was in a meeting.  We still have not had Mr. ***** reply to us by phone..  

           At this time, all of our other members to the club have been properly trained and have begun boating. If Mr. ***** no longer wants to be a member of the club he must reach out to us stating as such and follow protocol as per the contract we agreed together and signed.  There are two options to get out of the club, as understood by both parties at signing..  First, The member must be current in payments for one full year, at that time they can choose to either pay the early termination penalty of "20% of the remaining dues", or the member may choose to sell the membership and receive a partial refund based on how long he is in the club.

          Please don't hesitate to reach out with any other questions or concerns.  We look forward to resolving this matter as per the completed and signed contract.

      Boating has NOT started at the ***************** location.  That is clearly noted in the ads they post where they are still looking to hire people AND by the fact that not one single email was sent to me to alert me that the club is now open.  Its not open.   If it is open, please.....PLEASE send me one communication from DBC stating this fact.  You won't find it because it doesn't exist.  Not one single update. 

      One attempt to call/text was made since I filed the BBB complaint.  Outside of the fact that I am very busy and often don't have time to talk, I don't want talk.  I want action.  I want to read things and I want to clearly understand them.  I have lost trust since nothing that was communicate via "talk" has been true.  They NEVER respond in writing because that will meant they are accountable to what's in writing.  I tried sending emails prior, but those went unanswered.  Its very suspicious when someone sends an email, but the response is via a call.  I fell for that more than once when I first expressed my concern in June and again in July.  I sent an email and the response and promises were via a phone call.  Something I can't document.  Something I can't share with you to help with accountability and resolution.

      I attached the email from back in April showing CLEARLY that I was signing up for the "2024 boating season" on Lake ******.  Even if they did launch a boat in December of this year, that is NOT the 2024 season.  They have now had my money since April with not 1 thing to show for it.  The entire 2024 boating season is long over.  Exactly the opposite actually as you can see again via the 2nd attachment that not only is the initiation fee lower now, so are the monthly dues.  So all those promises that I was buying into a reputable club and at a promotional rate that nobody else will get because I was one of the early members, were simply not true.
