I signed up for a membership through 3 degrees in Sioux Falls. Due to unforseen circumstances I had to go out of town for work for nearly 2 months so I requested to cancel my membership knowing I wouldn't be able to use it for quite awhile. This request was made prior to my next monthly membership payment coming due. When I signed up for the membership I was advised I could cancel it at anytime for any reason and it would be over and no more membership fees would be due if done before the next billing cycle. That's exactly what I did.

3 degrees continued to try and charge my account after I made the request to cancel the membership so I contacted them and was told all membership cancelations had to be done in writing in their store which I was not told previously when I verbally requested the cancelation and was told it no longer going to be active. Due to being out of town for 60 days that wasn't an option for me. I was told they would accept a cancelation form by email, which I sent them however this business is still trying to charge my account monthly stating I owe them for multiple months. They are stating the account doesn't cancel until the final payment is received, even though I was told the account was canceled already and is inactive. I initially requested the cancelation prior to my next month coming due and was told it was canceled. Why would I have to pay for another month of membership dues at the time of cancelation when that's not how the membership was described to be when I signed up or I never would have signed up and not able to even use the membership due to being out of town. The team members tell you things verbally that are untrue to try and get you to get memberships and avoid having to deal with any conflict, but then the business does something completely different by stating its part of the contract. This is extremely deceptive and wrong. I want my account stopped and all membership dues stopped. This is insanity.

***** is completely inaccurate in this entire communication. Luckily our team takes excellent notes on his account per his conversations.

His request was not made prior to the next payment, in fact, his request was made after he already had a delinquent account from failure to pay. So his account was behind before he even asked to cancel which would mean he would need to catch up his account and make a final payment. All things our management team already communicated to Mr. ******.

He was never told he could cancel at anytime without a final payment. He signed his membership form which told him " you can cancel at anytime with a final payment." He signed that he understood that and yet here we are.

No where in the world do you get out of something by just emailing you are done. All we ask for is proper notice and final payment to cancel. There is no contract of 12 months to be completed. He signed all documents telling him that would be our policy. No employee told him otherwise as our whole staff has been here over 1.5 years each and all make sure to communicate that they need a final payment so that we don't have upset clients.

Our manager went out of her way to work with him giving him extra time to use his sessions other offers but he was not interested in hearing anything.

As far as ****** account we have handed it over to the proper lines to handle it now that it is delinquent.

    Complaint: ********

I am rejecting this response because:

The company is providing false information.  The girl I spoke with and who I requested to cancel the account with was working her third shift ever.  She told me that during our conversation about closing rhe account.  Also the last time I called them a few weeks ago the girl on the phone told me she just started working there a few weeks ago and she wasn't familiar with the account closure process.  No money will be paid to 3 Degrees and if my credit report isn't corrected and the account removed from the collection agency it was sold to, this will end up costing 3 degrees way more than the $150 they incorrectly say I owe them.  They have contacted me and sent me letters after a formal cease and desist request was received by them which I have confirmation of.  Each attempt to contact me after receiving this request is $1000.00 alone.

Their response is not truthful in the least bit.  Why would someone sign up for a membership and once they want it closed be required to pay for another month of the membership they no longer want or are able to use?

    Sincerely,

    ***** ******
