I have received two parking violations from Metropolis/McKinley Payments for circumstances where Metropolis' app was not fully functioning. The first was on 8/18/2022 when I parked in a lot in *********, opened the app to pay, and after selecting my license plate number it never progressed to the next step. I did this multiple times, verified the license plate, looked for a person to speak to or a physical pay station and found none. Weeks later I received a $78.25 parking violation in the mail which I disputed and was denied. The second was for 9/14/2022 when I entered a parking garage in *********, scanned the ** code, confirmed the license plate, was met with a screen to proceed and I would be charged upon exit. I was never charged nor provided with a receipt, and received a parking violation in the mail for $51.25. I also disputed this claim and was told twice to "submit a receipt," after having explained that I never received a receipt. I have called multiple times to speak with somebody and have been repeatedly told that all disputes are handled online and there is no number to call. I have tried in ******* to pay for parking and use the Metropolis technology. There is no reason for a company who cannot support their own technology or provide responsible customer service to be delivering parking violations to customers, especially when the parking violations are due to lack of effective/functioning payment portals.Business Response

I parked in the *********** (600 **************) on 9/18/22 and could not get the app to work. I couldn't tell if my parking session had started. I continued to scan the ** Code and the app would not go past the screen where you choose your license plate number. I was selecting it, but it continued to stay locked on that screen. Later that day I emailed Metropolis to try tell them what happened. They replied and told me they saw where I entered and exited and would charge $26.99 to the card on file. I replied that the fee should have' been under $10 and I did not receive a reply. My card was never charged for $26.99 and on 10/7/22 I received a violation for $76.25. My parking fare was $6. I have no problem paying the $6. But to receive these extra fees and violations for their faulty technology is absolutely unacceptable. How can this city allow this to continue? If I had a way to pay the $6 I would, but I certainly am not paying a $76.25 violation for something that wasn't my fault and I contacted that afternoon about. It's also time for the city to step in here. This company is ripping people off. As a 19-year resident of *********, I'm now thinking twice before I go visit a business because I don't want to deal with this parking hassle. It's the small businesses who will ultimately suffer from this company's greed. That's not fair and it's certainly not very "*********."Business Response

I experienced trouble with the parking app at the *********** (600 **************). Repeatedly I tried to get my session to start but couldn't tell if it had or not. I was going to a work shift and continued to check the app over those 4 hours to see if my parking session started. I was unable to tell. It was stuck on the screen where I choose my license plate. I also wasn't sure if the garage was still working as it was when it was Uber Parking - you drove in and the session started and drove out and the session ended. A few weeks later I received a violation for $82.25. My parking fare was only $12. I tried to appeal this as I wanted to pay the $12 I owed, but my claim was denied. I was emailed that my claim was closed. Any subsequent emails I sent were never replied to. I have zero problem paying the $12. That's what I owe. To charge me an additional $70.25 when there was a problem with the app is extremely unfair. I have used this app prior to and since this incident and it's about a 50/50 chance that the app works. It's not fair that the consumer is being penalized for faulty technology. I paid this fine because out of fear of what might happen if I didn't pay it. I am asking for a refund of the $70.25.Business Response

On August 27,2022 my son and I attended a Titans pre-season game. We parked in the METROPOLIS **************** facility. Upon entering the parking lot, two men in uniforms (matching shirts with a logo) ask for payment to park. He said that we could give him $40 cash and they would enter our plate and we could go park. He did say we could pay through the ** code but it would be more expensive. We paid them $40 cash and they took a picture of our TN license plate. Hindsite, we should have asked them to text us a receipt, but the line of cars trying to enter was long, so we went and parked. On event nights, I have seen facilities have people taking money so I thought nothing of it and went and enjoyed the game with my son. We left the facility at 9:50 according to METROPOLIS. METROPOLIS can know the exact time of entry and exit but Metropolis will not go back and look at camera footage to see that there were two guys there taking payments. To my surprise, I received a ticket in the mail for non-payment including a ***** parking fare and a $70.25 ticket fine. Beyond upset when I received this because I IN FACT paid the attendants that were on the lot. Stupid me. I have reached out to METROPOLIS to dispute this ticket and fine since we paid $40 to their attendants but my dispute was denied. I have until 10/15/22 to pay the ticket and fine. This is ludicrous to charge me twice plus a fine. I can provide copies of all emails and the ticket I received in the mail. I just want this ticket dropped since we in fact paid the attendants cash. I know they are normally a self park, but I though nothing of attendants taking money because there were two events that night, ****** ****** was at Bridgestone and the Titans game. They told me to look at the signage. When someone is there to take your money as soon as you enter the lot, then I don't look any longer about payment.Thanks,************************* ************Business Response

Metropolis sent me a ticket in the mail for parking on 9/7/2022 ***********************************************************. I was traveling out of town and could not have been at that parking garage . I sent Metropolis an email stating such and they sent me an email stating my reasons were not justified and they closed the cased with case. I had asked other questions and they did not respond. I told them I was going to report them to the BBB and they seemed unphased. The total of the ticket is $86.25 and I have no intention of paying the ticket.Customer Answer

On the weekend of 9/10/22 and 9/11/22, I was visiting *********. I parked in parking garages in the Gulch, icon and public square. I followed all directions asked to pay for parking. It included name, number, License plate number, and credit card information. There was no other way to pay for the parking (no attendant to ask any questions either). There was a sign on the way out of garage that's stated "we will bill you after you leave". A month after our visit we were back home in ******** and received 3 Ticket Summary's asking for unpaid parking fee and an added ticket fine. I was shocked and tried disputing through there portal that was given which was payments.metropolis.io. It was unsuccessful so I proceeded to try and contact someone for customer service. The only representative's available we're not able to help with the violations but did tell me that I should not have been charged any violation because they had all my information on file with debit card information for payment. Which made things more frustrating because the only information I get from Metropolis is that my claim is denied and can not be appealed. I received a parking violation from this company in ********* because I parked in a parking garage. When I pulled into the parking garage, there was no arm to stop me and no ticket booth to get a ticket and no one to pay on the way out. Also, no signs anywhere as to who could or couldn't park there or how much it would cost. After parking there for 1 hour and 5 minutes, I received a violation in the mail. The violation includes, the $6 parking fee and the $70.25 violation fine, making it a total of $76.25.I would be willing to pay the parking fee, but I am not going to pay any part of a fine. This is something that can be paid on line, but there is no way to pay the fee without paying the fine. I never got a bill in the mail for the parking fee.Business Response

On 9/22/22, I went downtown to attend a Pred's preseason game. I found packing in this garage (220 ****************, *********, ** *****) at 6:51 PM. When I pulled into the garage, there was an attendant running the gate and ticketing. My passenger in the back on the driver's side paid the attendant. The attendant then handed us a ticket and lifted the gate. We then entered the parking garage. We then left the game and pulled out of the parking garage at 9:09 PM. The gate was open when we were leaving. I braked to see if it was going to close but it appeared just to be set to open; so, I exited the ********* thought there was no issue as everyone had to pay to enter. The company sent me a statement today saying that I owe an unpaid parking fare of $18.00 and a ticket fine for $70.25 for a total of $88.25. This is ridiculous!Business Response

I parked at the *********** in the Gulch operated by Premier Parking. No gate. No ticket dispenser. No signs re: prices or late payment fees. Only a QR Code and signs about "joining". I parked to meet a friend and then exited the garage - unsure if I would be in a free hour or if they would mail/give me a parking charge. The terms of the parking garage were so confusing and vague - I was unsure. Then, after a few days, in the mail I get a letter from McKinley Payments (not Premier Parking - but by something that sounds like a collections agency) with a picture of my car and demand I pay an $8 parking charge AND a $70.25 fee - with further threats of action if I do not pay. This feels like extortion and the $ fees and costs were not posted or made available to anyone parking or searching otherwise. I appealed per instructions in the letter - and was (surprise) quickly denied. With no explanation. I followed up and asked for info and I have not received a reply. The terms of their parking contract/terms were not posted (I took pictures after getting the letter) and at best maybe terms are hidden behind QR codes and "joining" online. I would not know because access is limited and behind "joining" something. I don't want to join anything from Premier Parking. Hiding contract terms is not the meeting of the minds / offer-acceptance required for contracts to be valid. I will begrudgingly pay the parking fee of $8 as a cost of parking. But, paying $70 is almost tenfold the $8 charge and feels like an extortion scam. No one would pay $78 dollars to park in the Gulch to briefly meet friends. If this $70 charge was actually posted - people would back up fast to get out of this garage. If I end up paying the $78.25 - then this will be the last time I go to businesses in the Gulch or park in a Premier Parking spot. If McKinley Payments accepts me paying the $8 parking charge only - then I may go back to the Gulch but never park in a Premier Parking spot.Business Response

I am rejecting this response because:The mentioned connection I received from Metropolis was an automated denial response sent 7 min. after I emailed appealing to only pay the $8 parking fee owed vs the additional $70.25 arbitrary charge. I was told my request was denied due to ample signage in the garage. The signage that I could find was only a QR Code asking you to scan to join. I saw no signage detailing the $8 parking cost, or any costs for that matter, and certainly saw no signage about a $70.25 fee. I replied to that automated denial email and never got any further response. An automated reply sent in 7 min. was not a true appeal - it was a sham. I ended up paying the $78.25 in protest only to not get turned over to collections, and to prevent Metropolis from adding an additional $70 made up charge or worse (if they can pull $70.25 out of the air - then what prevents their next made up fee to be $7,000.25?). I have decided that I will let everyone on my various neighborhood/group/church ******** pages know about this practice and recommend they avoid parking with Metropolis, Premier Parking, or any of the businesses that use their lots.
