      We purchased a house from ********* on 3/2021. Weightman (previously Watson) provided the flooring and installation. At that point, we requested luxury laminate (LVP). Since buying the home, we have had issues with the flooring. Officially, in 10/23 we contacted Turnberry and Watson/Weightman for cracking and moving tiles. Watson spent 1.5 years, "evaluating," and diagnosing the issue. They finally sent a third party person in March of 2025 to evaluate the floor and it was determined that it was not installed properly, which is resulting in the cracking. Weightman offered a resolution that we would pay 40% material and installation labor, and the *** company would cover 60% under warranty. We contacted Turnberry as well, citing repeatedly that our flooring was never sound, and in fact, they had to bring a structural engineer at one point to brace the sub flooring because of warping/settling. Our complaint is that we purchased a high end home with luxury flooring that was installed incorrectly, and the parties who installed it are refusing to take responsibility. Damaged flooring can lead to damage to the subfloor and harm the structural integrity, which Turnberry also refuses to take responsibility for. In fact, our initial complaint about the flooring was on 3/15/2021, a week after we moved into the house, and it has only escalated since. We are now seeking replacement of the entire flooring.

      Weightman Family Flooring has strived to exceed its warranty commitments to better its name and standing with our clients.  We have a 1 year standard installation warranty with Builder clients.  ******************* is the client we did business with and not directly with the homeowner.  This work was performed in the house (Lot 5 Kingsbarns / 2017 Kingsbarns Drive) in question was completed in January of 2021 / with our final scope competed in February 2021.  We executed our one-year follow up a year later.  No issues were reported for the *** to us at this final visit.

      Only one item was repaired in the warranty period was a subfloor nail that had backed up through the finished floor damaging one plank.  This repair was billable to Turnberry Homes.

      In Late October, 2024 we were contacted and then arranged to meet with the homeowner on 11.05.2024 to evaluate and document reported issues with the ***.  This is already well beyond our warranty period with the builder / homeowner.  We reviewed the floor and sent the information on to the manufacturer as there remained a possibility of product warranty.  The manufacturer scheduled an independent inspector which took them until April of 2025 to execute which was beyond our control.  The issues at reported stemmed from binding at the trim which was installed by other trades through the homebuilder.  It was also noted that subfloor reinforcements were added after the fact by the homebuilder to correct unknown issues to us which may also have affected the floors performance.  The Manufacture denies there are product issues at hand and offered a discount on materials as settlement of the matter.  Weightman Family Flooring, out of no obligation, offered a discount as a courtesy to aid in the replacement of the floor.  We offer all our builder returning clients discounted labor rates to repair any out of warranty issues that may arise.

      I am rejecting this response because ultimately, the flooring installation was done incorrectly, as evidenced by the third party assessment. If Weightman is contracted to work with Turnberry, then either/or should be taking responsibility for the poor installation which resulted in the damage. Any modification to the sub flooring after the fact, should have extended the warranty in an appropriate fashion and/or resulted in a reassessment of the flooring. The company acknowledges that we had complaints about the flooring from the start. Our business is not with the *** maker, it is with Weightman, who null and voided the warranty when they installed the *** inappropriately.

      Weightman Family Flooring stands by our assessment of the floor as stated.   Weightman Family Flooring found no issues at the time of install through the one year warranty period included with the sale of the home.   The only issue brought to our attention was the single nail that penetrated the *** after backing out of the subfloor.  During the time of this repair no other installation issues were observed or reported.  Alignment issues with the boards would have been observable from a standing elevation and obvious to a ******.  Original installation photos confirm no alignment issues at the time of the repair.   At the One Year for the residence provided by the builder no issues with alignment were observed or reported.  It is the opinion of Weightman Family Flooring that these alignment issues evolved over time due to the pinch points locking parts of the floor in place and not allowing the free movement required with a floating floor application.   It should noted that after the 1 year warranty period alterations to the subfloor and joist below the residence were conducted by others that did not include Weightman Family Flooring.    

      We continue to offer a discounted rate for the repairs requested by the owner as do the manufacture of the flooring materials.

      Once again, under section 2 of the independent reviewer, "End joint creases consistent with installation damage/misalignment were
      observed throughout the installation." This implies that you installed it incorrectly which led to the damage over time. It is not reasonable to charge me 20k dollars to repair it when you failed to follow the installation guidelines, as noted by, "These issues are clearly addressed in the installation instructions for the product involved as well as discussed in the Installation Pitfalls video that is posted on our
      website and must be addressed/corrected as part of the replacement process."

      Once again, the issues were not present at the time of the orig. installation nor at the One Year provided by the builder.   These issues were only observed and reported to Weightman Family Flooring in Late 2024 when our Project Manager met with you at the residence on November 4th to evaluate the floors.  At this time Weightman Family Floors contacted our vendor and manufacturer to set up the 3rd party inspection.  The date for this inspection was outside of Weightman Family Flooring and we were not present for this evaluation.    These floors only come with a One Year Warranty Period through Weightman Family Flooring. 

      To assist with the cost of the replacement, Weightman Family Flooring offered a substantial discount that we are under no obligation to provide.  The Manufacturer of the floor also offered a 60% discount on cost of materials to assist further.  Note they were also under no obligation to provide a discount.  At this time the current bid is the best and final offer to repair.

      I am rejecting this response because:

      There is an implied warranty that guarantees that the work was done correctly and meets industry standards. This was clearly not the case. Under negligence laws, the contractor is solely responsibly, and any bond taken out against the project should be defaulted to pay for the errors. This is the sole responsibility of the flooring company, as has been demonstrated repeatedly in many lawsuits across the country wherein improper installation resulted in damaged floors (even years later), but ultimately, the installer was found to be liable for failing to meet the industry standards. These defects were noted and brought up well within the statute of limitations as well as the ** statute of repose, which we believe the delay was intentional to avoid taking responsibility under the later.
