Hired them November, was told by lawyer that I could speak and work directly with him. Reached out for weeks to get educated and learn my options. Things began to happen in my case and I could not get any help. When I did speak to someone I felt judged and talked at. Signed up to use Allmand Law to file bankruptcy and when we terminated their representation of us they refused to refund 150$ although nothing was done on the case, ignored my calls in the day in question and did NOTHING on our case outside of collecting our payments I am seriously ill and this was not a good way to treat a ********* seems they do this to a lot of clients by merely reading BBBcomplaints and online commentsBusiness Response

We take all of our clients' concerns very seriously and a continued commitment to customer service is something that drives this firm in every aspect of our business. It is understandable that a client feels like "We have done nothing" when they cancel before their ultimate goal, which is the filing of their Bankruptcy Petition and the discharge of their debts, but this simply isn't the case. We have represented this client since November of 2024, provided the client with a letter of representation to field creditor calls and verify representation, processing incoming documents, and pulling the asset evaluation for the client's asset.
Our goal is to consistently provide a streamlined process for the preparation and filing of our clients' cases.
Although our attempts to contact Mr. ******* have been unsuccessful, we have provided a resolution in accordance with our Retainer Agreement and believe this will successfully resolve the matter. Complaint Summary: I am filing this complaint against Allmand Law Firm due to their handling of my case, poor communication, and lack of accessibility to legal guidance throughout the process. I entered into a payment plan with Allmand Law Firm, paying $300 monthly, and understood that they would not begin working on my case until I completed the payments. I made my final payment a month ago, after which they informed me that I needed to submit paperwork to proceed with my caseinformation that was not disclosed earlier. When I reached out to the firm with questions and concerns, (during thr payments) they refused to allow me to speak with a lawyer or even a paralegal. This lack of access to any legal professional during the process was frustrating and concerning, as I was left without adequate support or answers. After deciding not to move forward with the case, I was informed that I would only receive a $500 refund, as my case had been "open" for over a year. While I understand that I signed a retainer, the firm's statement that they had not actually worked on my case until I completed payments conflicts with their limited refund offer. This has led me to lose confidence in the firm. Resolution Desired: I am requesting BBB assistance to obtain a fairer refund. Given the firms statement that they had not begun work on my case, I believe I am entitled to a larger refund than $500. The lack of transparency and refusal to provide access to legal support have left me feeling unsupported and misled. I hope for a resolution that reflects fair treatment and accountability from Allmand Law Firm.Business Response

In May of 2024 I contacted Allmand Law after my business truck was picked up on repo. I was also late on my mortgage so after going through everything with the person on phone I hired them to file Ch 13. It all happened quickly & they took my down & filed right away for a "bare bones" bankruptcy so that I could get my truck back. Next, I was asked for documents. I told them I know my QuickBooks isn't accurate because I had to let my bookkeeper go. Didn't matter. Then I had a call with attorney to go thru everything and she gave me a payment. I told her I could not afford that right now. She yelled at me and said, "well, according to your p&l you can!" If they knew how to listen this all could have been avoided. I had to refuse to pay so it was dismissed. I had conf call with docket attorney next and it went well. I went ahead & decided since I had already gone this far, surely they wouldn't s**** up again. I was wrong. I will just end with the guy who calls you to keep you from leaving almost had me suckered. Then he scheduled for me to speak with a managing partner because of all the mess I went thru. The call never came. I called the next ******** apologized and said he accidentally deleted the appt! Needless to say, he didn't even try to talk me into staying any longer. You would think it would end there, but it didn't. I went & spoke to another attorney and found out that I qualified for a Ch 7 because more than 51% of my debt is from my business! I told Allmand Law this several times! I also told them that I had some money coming and I could get vehicle & house current. Never once did they acknowledge this was an option for me until the day I told them I was leaving. I would like my initial down payment of $1500 back. I don't want to hear about how much I owe for them to review things either. If they had just listened this could have ended so differently. I could have already been done with this mess. Allmand Law has reached out to Ms. ******* in an attempt to discuss the complaint that she has made here. Unfortunately, we have been playing some phone tag and the ball is currently back in her court to return so that we can resolve this matter. In advance of that, we do wish to convey our sincere regrets regarding any perceived customer service failings she may have experienced while a client of this firm. However, it should also be noted that the chapter she elected to pursue while a client of this law firm was not the product of any failure to listen on our part. As she states in her complaint, included in her goals at the time she hired this firm were 1) to retrieve a recently repossessed vehicle; and 2) get caught up on her mortgage. A Chapter 7 bankruptcy would not allow her to do either of those things if she had filed under that chapter from the outset. In other words, Ms. ******* seems to imply that the sole reason she pursued Chapter 13 relief was due to some misunderstanding on our part about her income. That is not true. Similarly, she seems to be taking the position that because her Quickbooks being out of order, that she could produce erroneous profit and loss statements to the Court. That is also not true. As we communicate both verbally and in writing, the information provided to this firm, the bankruptcy trustee, and the Court has to be true. While no one from the Court ot the trustee's office is likely to come check her submissions against her Quickbooks (and if they did, she would have a chance to reconcile them), they do have to be true and complete. We will continue our efforts to reach our former client and have a productive conversation about these topics and any other issues that she would like to address. Either way, we do wish her the best in her future endeavors and hope that her new attorney has made these basic points to her as she pursues relief under Chapter 7.Customer Answer

I am rejecting this response because: I called the person back this morning and after being on hold for 18 minutes I was told I would get a return call, which I never got. The assumption that I elected to do a Chapter 13 is misleading as this was the only option given to me. Had the numerous people I spoke to listened to me at all there should have and could have been another plan to resolve the matter since I told anyone who would listen I had revenue incoming by August that would get my mortgage and personal vehicle current. There was a huge disconnect there. The fact that I told anyone and everyone that I needed more time to get my books in order is also my duty. To tell. Nobody and I mean nobody seemed to care. I was given no preparedness for what to expect going into this and the only reason I filed to start with is because of incorrect information I was given by whoever I spoke to from the start that said I could cram down the payment on my business lease vehicle, which I found out only halfway into this that this information was incorrect. It was literally the reason I filed so soon. The final straw was the appointment to retain them after all of this fiasco accidentally was deleted from the calendar so no call every came from the partner I was expecting. This was a colossal joke from the start and when so much is at stake I would expect much better experience than what I had. Period.Business Response

Date of the transaction: July 3, 2024 The amount of money you paid the business: 2998 What the business committed to provide you: chapter 7 bankruptcy What the nature of the dispute is: scammed. Told originally I could file chapter 7, then after almost three months of no communication outside of telling me to submit documents over and over, told I could only do a chapter 13. Whether or not the business has tried to resolve the problem: they offered to refund the filling fee since I didnt actually file bankruptcy but refused to refund further. So, refunded a total of 300 some odd dollars out of $3200 total saying that I had a credit if I changed my mind and wanted to do chapter 13, even though I advised I did not and will not do a chapter 13. They told me they would not refund, only leave a credit for a service that I will never want and that I dont have to get a breakdown of why the refund is only 300 some odd dollars out of 3200 when they literally did nothing but tell me to submit documents over and over and over for months. I am rejecting this response because: It is not addressing the fact that I was told that I would be eligible to do a chapter 7 and then after paying, told I can only do a 13 because I make too much. I answered those questions before I paid about my income. Nothing changed. They literally got me to pay, stalled for almost 3 months asking me to resend the things that I had already sent to prolong the process, and then once I figured out I was being lied to, told me they had done too much work to issue any substantial refund.Business Response

Our office received a cancellation request on October 3rd via a phone call with our receptionist. On the same day, we promptly returned the call but were unable to reach the client. We made a second attempt later that day, but once again, contact was not established. Additionally, we sent an email on October 3rd to inform the client that we had initiated the case closure process. A manager was set to review the file and complete the close-out procedure, which includes evaluating billable hours. If a refund is applicable, it is critical that we speak directly with the client to confirm payment arrangements.
The following business day, we received this complaint through the BBB. Since then, we have successfully communicated with the client and have provided a resolution that we believe meets their satisfaction. We wish the client the best as they continue their legal journey.Initial Complaint

I signed a contract with Allmand law on September 20th 2024 and attempted to cancel the contract on September 23rd 2024 as per the 3-day clause in the contract. Allmand law is refusing to honor that right to cancel the contract and issue a refund of my $300 deposit. Their system deliberately is built to prevent you being able to cancel the contract. Not only did I call and speak with a front desk receptionist on multiple occasions, I sent text messages, left voicemails for a ticket, and was required to have two phone conferences about canceling my contract. They drew the process out until October 1 2024 in an effort to avoid returning my deposit. A company that is doing business legitimately has no need to keep money that did not earn. Despite my every effort to comply with a three-day cancellation clause I could not do so because of their own system preventing it. I hereby request and immediate refund back to the original card for the $300 I paid.Business Response

I have paid $1500 for them to handle my chapter 13 BR. I only went ahead past the consultation, because I was told multiple things regarding my bankruptcy. Now that Ive sat down with an attorney who told me they could care less and the amount doesnt matter to them the whole thing just gives me bad feelings.Its misleading to tell someone one thing in consultation make them pay the full amount before they talk to an actual attorney just for the attorney to Sidestep and change the information that was told to you within the same company. When asked for a new lawyer - I was blown off. I recently filed a Chapter 13 bankruptcy with Allmand Law Firm. We had a consultation via telephone and upon paying the deposit that was required, that is when the process was scheduled to begin. This was in April 2024. I was assured on multiple occasions by their legal team that they could protect my vehicle and home. Due to being laid off for several months, I obtained a title loan that I ultimately could not pay back. The legal team assured me that they could protect my vehicle from getting taken and that they could work with the lender to come to a payment agreement. They even encouraged me to pay the deposit quickly to get protection on my vehicle. I am a single mother of four children, who had been laid off and actively trying to find another job, with no luck thanks to the current job market. I scraped together the deposit and paid the law firm to get the bankruptcy started. It took them months to even get the documentation filed, despite me completing everything and submitting required documents in a timely manner. I would speak with their staff every month just to ensure that my vehicle was protected because I was getting telephone calls from the lender daily. They assured me that they were actively working with the office and that I was fine. Well, that was all lies. My vehicle was taking on the SECOND day of my new job that I started August 2024. Mind you, payments were already being sent to the trustee at this point, so why were my assets not being protected as promised? Once I informed Allmand Law about what happened, I will admit, I was upset and requested a partial refund. They stated that they would not issue me a *****. They stated that they would get me vehicle back. Fast forward to the end of September, I still have not gotten my vehicle back and after speaking with the lender multiple times, Allmand has not even contacted them, NOT ONCE! If you are considering filing bankruptcy, please find a better solution, because Allmand Law is no help.Business Response
