My car was mishandled by Copart on October 21, 2024, it was first placed on auction without my consent, and after begging them to be delivered to my address, they said it will be delivered within 48 hours but took 96 hours to be delivered and was delivered to wrong location with key inside without informing me, leading vehicle being stolen and later found with personal items being stolen and additional damages on my vehicle. Despite multiple follow-ups, no resolution was provided.

The business completely scammed me. I would Consider it as far as fraud. They sold me a 2016 Kia ******* with ****** miles. It was filed under normal wear and tare. I paid $6500 including shipping, taxes, and fees. I got the truck and it has a blow engine. On the copart sticker (which was not shown in any of the photos) it said mechanical issue. So they KNEW it had a mechanical issue and did NOT disclose it to the bidders. A blown engine on a 2016 car with only ****** miles is not normal wear. If they had disclosed the issue I never would have bid on the vehicle. I would like them to reimburse me at least the fees I paid to copart for this scam.

I am rejecting this response because:

They're taking NO accountability for mislabeling the vehicle. Even if I had come out and seen the vehicle, I would have found out that they had made an error in the listing but it doesn't change the fact that they made an error in the listing. This happened to me but it could have happened to anybody. Not everybody in the ************* can fly out to check the vehicle out or can afford to pay an outside person to do this. Some people are just normal people trying to get a good deal on a car and you guys should have some integrity and say you know what we made a mistake. You're right, we mislabeled the vehicle. Absolutely no integrity from your end. You're just passing the blame onto the consumer when it was your mistake. You guys specifically said normal wear and tear. A bad engine is not normal, wear and tear. No matter what you say. You cannot dispute that. You guys knew it was a mechanical issue as you can see in the picture, but you did not disclose that. You hide behind your terms and conditions and say oh well, you could come see the car anytime so then you can take no accountability for your actions and you can rip people off whenever you want and however you want. They're taking zero accountability. They're not even saying hey, you know what it was mislabeled that was our mistake. We apologize. What we can do is at least give you your buyer fee back of $1,000. We understand that it was mislabeled and the average person would see it and just assume it's a good running vehicle considering there's no mention of mechanical issue. If you had mentioned in the listing there was a mechanical issue with the vehicle and I got it and had a bad engine. I wouldn't be complaining about this. I am complaining about the fact that you guys specifically said in the listing normal wear and tear, I get the car and it has a bad engine, as well as a sticker that says mechanical issue, and you're not doing anything to help even though you guys made a mistake in the listing.

My car was damaged from the Hurricane ******.Geico contracted Copart to pick up my flooded car at my house. They trespassed on my neighbors driveway and swung the truck around my rental car and smashed into both sides of my ********* neighbor heard the crash and ran downstairs. Rather than wake me up to move the car behind mine, they tried an unprofessional tactic which caused damages to both sides of my garage. I called and was passed around a bunch of times. I purchased a 2018 ****** Pathfinder (Lot #********) , designated as run and drive from Copart ********************** on March 27, 2024. When the vehicle was delivered, I realized the vehicle had a bad motor and could not start let alone run and drive as the website indicated. All efforts to get Copart to help failed.I decided to sell it on the Copart platform, it was picked up and listed on Copart South Dallas yard. The listing lot #********. Unfortunately, the title got damaged, I mailed the damaged title to the Lebanon Tennessee yard to help process a duplicate title. The ***** tracking number is for the damaged title is ************. It shows it was delivered to the receptionist and was picked up by *. ********* (Please proof of delivery attached), notwithstanding, Copart, denied receiving the title. All effort to confirm the title was received and to determine next steps failed.Since the vehicle was still sitting at Copart South Dallas yard and Copart Lebanon Tennessee claims they never received the title, I had to take the vehicle back to prevent paying storage fees at the South Dallas yard (See owner retained receipt). I called the Lebanon Tennessee yard where I bought the vehicle but nobody was willing to help. The vehicle is still with me, I can't sell it and it doesn't run.I'm attaching a copy of the title I mailed to Copart ******* *********. The copy was taken before the title got damaged.Copart has not responded to the initial complaint I filed on the April 8, 2024. I have called many times and they are willing to help or provide any guidance. Copart has neither acknowledge receipt of the duplicate title request form nor processed a duplicate title.I need your help to ask Copart to process the duplicate or send the title back to me if the they can't process a duplicate I also need Copart to consider my request to return the vehicle and process a refund or a store credit.

On August 9, 2024 I purchased a vehicle from Copart Auto Auction that was listed as a Run and Drive for $26,400.50 Keys were locked in vehicle and when I got it to my shop the battery was not in the key fob. Once I got battery in key fob the vehicle would not start.I got vehicle pulled into Body shop and did repairs on the body of vehicle, once that was complete I had vehicle towed to Ram dealership where I was told the *** and was missing and the security modules were not the right ones for this vehicle. I was told by dealer there was no way Auction would have cranked this vehicle with these missing and wrong parts. So it is my opinion that these parts were altered and taken off at the auction.I paid extra for what I thought was a Run and Drive vehicle when it was ****** cost me $6,456.41 in parts and labor to get it running. This is the amount I feel Copart Auto Auction owes **** reached out to the Auction where I purchased vehicle and was told that they would not do anything about it.This is description that was on Vehicle listing at auction:According to the auction, at inventory, the vehicle was *********** meaning the vehicle: 1) Started under its own power or with the use of external jump box, 2) Was put into gear, and 3) Moved forward. This designation is no guarantee, representation, or warranty that the vehicle is roadworthy or will be able to start, be put into gear or capable of moving forward at the time of the sale.

In response to the claim asserted by ***** ******* that was purchased at Coparts auction was misrepresent as Run & Drive.  One of the prerequisites to establishing a member account with ********************** is agreement to Coparts binding Member Terms and Conditions. ***** McCrorys member notes indicate that he has consented to the current Terms and conditions. The definition of Run and Drive when you see it on the website advertisement states:
At the time the vehicle arrived at Coparts location, Copart verified that the vehicle started,(ii) could be put into gear, and (iii) was capable of moving forward under its own power. There is no guarantee, representation, or warranty that the vehicle is in roadworthy condition or can be driven lawfully upon the highways of any state. There is no guarantee, representation, or warranty that the vehicle will start, (ii) drive, or (iii) move forward under its own power at the time the vehicle is picked up at Coparts location. It is the Members sole responsibility to ascertain, confirm, research, inspect, and/or investigate the vehicle prior to bidding on it. Once the vehicle is removed from Coparts premises, the Member accepts the vehicle as is

The R&D label does not guarantee that any vehicle is safe to drive without first undergoing repairs, nor does it guarantee that any vehicle will ever be roadworthy again. The R&D simply states that, at the time the vehicle was brought to a Copart yard to be prepared for auction, it could be started and moved forward a minimal distance under its own power. No guarantee is made as to the operability of an R&D vehicle at the time it is retrieved.
Our T&Cs point out that the information we provide is for convenience only, and that burden is placed upon the member to gather information on the vehicle prior to bidding on it. This information can be found at section I.A of our T&Cs and reads:

Copart and its vehicle sellers expressly disclaim the accuracy or completeness of any and all information provided to Members regarding vehicles, whether provided in written, verbal, or digital image form (Vehicle Information). It is the sole responsibility of the Member to ascertain, confirm, research, inspect, and/or investigate vehicles and any and all Vehicle Information prior to bidding on vehicles.

Had ***** ******* came out to inspect the vehicle before bidding he would have been fully aware of any issues associated with it. The webpage advertisement even provides a list of ******************* who for a fee will come out and inspect the vehicle and provide an in-depth report after the inspection. All these tools were available for Mr. ******* to utilize, but he failed to use any of them. Additionally, our website includes a "HD" feature which allows our members to zoom in on images for additional details and a closer look. I have attached that view which clearly reflects the engine running. Accordingly, Copart rejects any and all demands Mr. ******* has regarding a refund.

      Customer Answer

      Date: 10/24/2024

I am rejecting this response because:   Your response was nothing less than a bunch of legal loopholes. The very pictures that you sent in your  response is what I based my decision on to purchase this vehicle. When a vehicle is listed as run and drive it should be exactly that! Due to your additional fees you add on to the bid why would I want to spend even more money to have it inspected before auction? The truck was locked with key fob in it when I picked it up. That is my fault for not having someone unlock it but had I hired a transported it still would not have been opened. The key fob was inside with no battery in it. So this had to be done after Coparts Atlanta made pictures with it running. After not being able to get vehicle to start I took it to a Ram dealership where they found all kinds of interesting things wrong with it.

      1. The *** was missing, like not there at all.

2.The two security modules was not the original ones assigned to this vehicle. They had an entirely different VIN than my vehicle VIN. Dealership said there was absolutely no way this vehicle could ever be started with this missing part and parts with foreign VIN.

So my big question to you is how did parts with VIN# ***************** get into my vehicle modules with my VIN# is ***************** after you took pictures of it running at your yard. Finding out who did this is as simple as doing a VIN check to see who it belongs to.

I know the answer and I know you know the answer too. You have a thief inside of your Copart Atlanta auction that helped themselves to parts on a vehicle that you listed as run and drive that made it not run and by no means able to be driven.

To get this vehicle to run and drive status cost me $6,163.91 to have *** and 2 security modules replaced including labor.

I have bought cars from Copart for 20+ years and have always gotten exactly what the description was and have been well pleased. I placed my trust in your pictures and description when it was totally false on auction day.

Had Mr. ******* came out to inspect the vehicle before bidding he would have been fully aware of any issues associated with it. The webpage advertisement even provides a list of Inspector Services, who for a fee will come out and inspect the vehicle and provide an in-depth report after the inspection. All these tools were available for Mr. ******* to utilize, but he failed to use any of them. Additionally, the Copart website at the time of auction advertised the physical location of the referenced vehicle. Accordingly, Copart rejects any and all demands Mr. ******* has regarding a refund.

I purchased a 2013 ****** Sentra S from a Copart auction on February 1, 2024(***************************************************). The auction listing clearly stated that the car was "Run and Drive." However, when the vehicle was delivered, it didnt start. I had to replace the battery, and while the car did start afterward, it wouldnt move at all. After consulting with a couple of mechanics, I was informed that the car needed a new engine.I contacted Copart's regional manager via email, and their response was as follows:"Hi,The vehicle was running in our pictures, and the 'run/drive' designation is determined at the time of inventory. You are more than welcome to preview vehicles and have them started before placing bids to ensure you're confident with your purchase.Thank you,"As a consumer, I would like to point out that for an online auction, they should update the details of the vehicle before the auction takes place, especially if they are conducting it remotely. The response I receivedsuggesting I should have previewed the vehicle in persondefeats the purpose of an online auction.I am concerned about the business practices where such discrepancies are overlooked, and consumer interests are not adequately protected.

In response to the claim asserted by Shilabahen ********* that was purchased at Coparts auction was misrepresent as Run & Drive.  One of the prerequisites to establishing a member account with ********************** is agreement to Coparts binding Member Terms and Conditions.  Shilabahen Chaudharis member notes indicate that he consented to the Terms and conditions on 1/23/2024.  The definition of Run and Drive when you see it on the website advertisement states:

      Customer Answer

I am rejecting this response because it appears to be a generic, copy-pasted reply. I am looking to file a claim in small claims court, but I am unsure if I should file it in *********** or *******
Additionally, I would like to know why a clear photo of the dashboard was not uploaded in the auction listing. Ive attached a photo taken after replacing the battery, clearly showing that the engine light is on. However, I didnt see any mention of this issue in the original listing (**********************************************************************************).
As a first-time buyer, I was unaware that there was a service available to inspect the vehicle before bidding. Can you clarify whether the auction company holds any responsibility for ensuring that the auction details are accurate and up-to-date before the auction occurs?

Coparts position is unchanged in this matter and we stand behind our previous response.

However, our website includes a "HD" feature which allows our members to zoom in on images for additional details and a closer look. I have attached that view which clearly reflects the engine running.

I am rejecting your response because:

I had already used the ** version of that image, and only the sunlight was visible, which you can also see. Based on your answer, it seems like you are not listening to or understanding consumer complaints. You are always in denial mode. Why would I lie? After the car was delivered, it was not running, and I received no positive response from your regional manager. The next day, after consulting with a couple of mechanics, it was determined that the car needed a new transmission. I couldn't afford the cost of replacing the transmission, so I had to list it for sale on ******** Marketplace and eventually sold it for $1,800. I ended up losing a lot of money due to unfair practices in the online auction.

Can you please advise me on where I should file the case in small claims court? Should it be in *********** or ******? I want to make sure there is nothing in the contract that requires me to file in a specific location.

On Sep 17, 2024 I paid for the membership that was advertised that I will be refunded within 7 days if theres no activity on the account. I had no activity on the account because I couldnt purchase through their site because apparently my state requires a broker. If I knew this I wouldnt have signed up. This it's false advertisement. I called them to request a refund and they told me they wont because its passed the 7 days. I told them that I should have had a refund automatically as their was no activity on the account because I CAN NOT BUY from them as they do not allow me to buy in the state of ******* without a broker.

      Business Response

In response to the claim asserted by ******* **** about his Copart Membership and his suggested false advertising. One of the prerequisites to bid on prospective vehicles is establishing a member account with **********************. To become a Copart member, an individual must pay the non-refundable membership fee and agree to Coparts binding Member Terms and Conditions. ******* Shaws member notes indicate that he consented to the Terms and conditions on 9/17/2024. These Member Terms and Conditions state:

      IV. MEMBERS
      A. Member Eligibility. You may sign up as a Member at Copart if you are at least 18 years of age.  In addition,state-specific registration requirements and applicable laws, regulations, and restrictions may further limit Member sign up and vehicle purchasing eligibility. Copart reserves the right to deny member privileges to, or exclude from Copart facilities, any individual or entity, in its sole and absolute discretion.
      B. Member Types.
Registered Guests must register and provide first and last name, email address and phone number. Registered Guests have the option to submit a physical address and copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable, in preparation of becoming a Basic or Premier Member. Registered Guests may search inventory, add vehicles to a Watchlist and create Vehicle Alerts, but Registered Guests may not bid on or purchase vehicles unless their membership type is upgraded to either a Basic or Premier Membership.

In order to bid on a vehicle, you must be a Basic or Premier Member in good standing:
Basic Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Basic Members, must pay the initial Basic Member registration fee. A security deposit may also be required in certain cases in order for the Basic Member to submit a bid (see Section V.H. below).
Premier Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Premier Members must pay the initial Premier Member registration fee and security deposit.
All Basic and Premier Members who purchase vehicles for resale must provide copies of current licenses and completed sales tax exemption certificates.  Basic and Premier Memberships must be renewed annually by paying an annual nonrefundable Member renewal fee and submitting copies of all current licenses (if applicable), and any information regarding change of ownership or address.  Copart reserves the right to increase or decrease registration and renewal fees at any time without prior notice to Members.

By agreeing to these Member Terms and Conditions, ******* **** acknowledged that he understood that based on state specific registration requirements and applicable laws, he may not be eligible to bid on a vehicle in a specific state/location. The Copart webpage even provides a licensing overview page that shows the licensing requirements for each state.  Had ******* **** reviewed this information, he would have known which states he was eligible to purchase a vehicle in as an individual and which states required other licensing. To this affect, Copart did not falsely advertise anything and we ask the BBB close this case.

In reviewing our records, Copart Direct had agreed to purchase the referenced vehicle for the amount of $331.31 once properly signed title and keys were provided. Additionally, our records indicate the referenced vehicle was gifted to him through a church acquaintance and he does not have any of the original title work for the referenced vehicle. Before Copart Direct can proceed with the purchase of this vehicle, Trevon Prince will need to have the referenced vehicle properly transferred and titled into his name.

Copart respectfully request the BBB to close this complaint as Mr. Prince cannot legally sell a vehicle that is not properly titled in his name.
