      I purchased a 2013 ****** Sentra S from a Copart auction on February 1, 2024(***************************************************). The auction listing clearly stated that the car was "Run and Drive." However, when the vehicle was delivered, it didnt start. I had to replace the battery, and while the car did start afterward, it wouldnt move at all. After consulting with a couple of mechanics, I was informed that the car needed a new engine.I contacted Copart's regional manager via email, and their response was as follows:"Hi,The vehicle was running in our pictures, and the 'run/drive' designation is determined at the time of inventory. You are more than welcome to preview vehicles and have them started before placing bids to ensure you're confident with your purchase.Thank you,"As a consumer, I would like to point out that for an online auction, they should update the details of the vehicle before the auction takes place, especially if they are conducting it remotely. The response I receivedsuggesting I should have previewed the vehicle in persondefeats the purpose of an online auction.I am concerned about the business practices where such discrepancies are overlooked, and consumer interests are not adequately protected.

      In response to the claim asserted by Shilabahen ********* that was purchased at Coparts auction was misrepresent as Run & Drive.  One of the prerequisites to establishing a member account with ********************** is agreement to Coparts binding Member Terms and Conditions.  Shilabahen Chaudharis member notes indicate that he consented to the Terms and conditions on 1/23/2024.  The definition of Run and Drive when you see it on the website advertisement states:
      At the time the vehicle arrived at Coparts location, Copart verified that the vehicle started, (ii)could be put into gear, and (iii) was capable of moving forward under its own power. There is no guarantee, representation, or warranty that the vehicle is in roadworthy condition or can be driven lawfully upon the highways of any state. There is no guarantee, representation, or warranty that the vehicle will start, (ii) drive, or (iii) move forward under its own power at the time the vehicle is picked up at Coparts location. It is the Members sole responsibility to ascertain, confirm, research, inspect, and/or investigate the vehicle prior to bidding on it. Once the vehicle is removed from Coparts premises, the Member accepts the vehicle as is         

      The R&D label does not guarantee that any vehicle is safe to drive without first undergoing repairs, nor does it guarantee that any vehicle will ever be roadworthy again. The R&D simply states that, at the time the vehicle was brought to a Copart yard to be prepared for auction, it could be started and moved forward a minimal distance under its own power. No guarantee is made as to the operability of an R&D vehicle at the time it is retrieved.
      Our T&Cs point out that the information we provide is for convenience only, and that burden is placed upon the member to gather information on the vehicle prior to bidding on it. This information can be found at section I.A of our T&Cs and reads:

           Copart and its vehicle sellers expressly disclaim the accuracy or completeness of any and all information provided to Members regarding vehicles, whether provided in written, verbal, or digital image form (Vehicle Information). It is the sole responsibility of the Member to ascertain,confirm, research, inspect, and/or investigate vehicles and any and all Vehicle Information prior to bidding on vehicles.

      Had Shilabahen ********* came out to inspect the vehicle before bidding he would have been fully aware of any issues associated with it. The webpage advertisement even provides a list of ******************* who for a fee will come out and inspect the vehicle and provide an in-depth report after the inspection. All these tools were available for ************ to utilize, but she failed to use any of them. Accordingly,Copart rejects any and all demands Ms. ********* has regarding a refund.

      I am rejecting this response because it appears to be a generic, copy-pasted reply. I am looking to file a claim in small claims court, but I am unsure if I should file it in *********** or *******
      Additionally, I would like to know why a clear photo of the dashboard was not uploaded in the auction listing. Ive attached a photo taken after replacing the battery, clearly showing that the engine light is on. However, I didnt see any mention of this issue in the original listing (**********************************************************************************).
      As a first-time buyer, I was unaware that there was a service available to inspect the vehicle before bidding. Can you clarify whether the auction company holds any responsibility for ensuring that the auction details are accurate and up-to-date before the auction occurs?

      I had already used the ** version of that image, and only the sunlight was visible, which you can also see. Based on your answer, it seems like you are not listening to or understanding consumer complaints. You are always in denial mode. Why would I lie? After the car was delivered, it was not running, and I received no positive response from your regional manager. The next day, after consulting with a couple of mechanics, it was determined that the car needed a new transmission. I couldn't afford the cost of replacing the transmission, so I had to list it for sale on ******** Marketplace and eventually sold it for $1,800. I ended up losing a lot of money due to unfair practices in the online auction.


      Can you please advise me on where I should file the case in small claims court? Should it be in *********** or ******? I want to make sure there is nothing in the contract that requires me to file in a specific location.

      On Sep 17, 2024 I paid for the membership that was advertised that I will be refunded within 7 days if theres no activity on the account. I had no activity on the account because I couldnt purchase through their site because apparently my state requires a broker. If I knew this I wouldnt have signed up. This it's false advertisement. I called them to request a refund and they told me they wont because its passed the 7 days. I told them that I should have had a refund automatically as their was no activity on the account because I CAN NOT BUY from them as they do not allow me to buy in the state of ******* without a broker.

      In response to the claim asserted by ******* **** about his Copart Membership and his suggested false advertising. One of the prerequisites to bid on prospective vehicles is establishing a member account with **********************. To become a Copart member, an individual must pay the non-refundable membership fee and agree to Coparts binding Member Terms and Conditions. ******* Shaws member notes indicate that he consented to the Terms and conditions on 9/17/2024. These Member Terms and Conditions state:

      IV. MEMBERS
      A. Member Eligibility. You may sign up as a Member at Copart if you are at least 18 years of age.  In addition,state-specific registration requirements and applicable laws, regulations, and restrictions may further limit Member sign up and vehicle purchasing eligibility. Copart reserves the right to deny member privileges to, or exclude from Copart facilities, any individual or entity, in its sole and absolute discretion.
      B. Member Types. 
      Registered Guests must register and provide first and last name, email address and phone number. Registered Guests have the option to submit a physical address and copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable, in preparation of becoming a Basic or Premier Member. Registered Guests may search inventory, add vehicles to a Watchlist and create Vehicle Alerts, but Registered Guests may not bid on or purchase vehicles unless their membership type is upgraded to either a Basic or Premier Membership.

      In order to bid on a vehicle, you must be a Basic or Premier Member in good standing:
      Basic Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Basic Members, must pay the initial Basic Member registration fee. A security deposit may also be required in certain cases in order for the Basic Member to submit a bid (see Section V.H. below).
      Premier Members must register and provide copies of current government issued photo identification as well as licenses and completed sales tax exemption certificates, if applicable. In addition, Premier Members must pay the initial Premier Member registration fee and security deposit.
      All Basic and Premier Members who purchase vehicles for resale must provide copies of current licenses and completed sales tax exemption certificates.  Basic and Premier Memberships must be renewed annually by paying an annual nonrefundable Member renewal fee and submitting copies of all current licenses (if applicable), and any information regarding change of ownership or address.  Copart reserves the right to increase or decrease registration and renewal fees at any time without prior notice to Members.

      By agreeing to these Member Terms and Conditions, ******* **** acknowledged that he understood that based on state specific registration requirements and applicable laws, he may not be eligible to bid on a vehicle in a specific state/location. The Copart webpage even provides a licensing overview page that shows the licensing requirements for each state.  Had ******* **** reviewed this information, he would have known which states he was eligible to purchase a vehicle in as an individual and which states required other licensing. To this affect, Copart did not falsely advertise anything and we ask the BBB close this case.

      Copart did shady business damages to my car and gave me a bad check

      In reviewing our records, Copart Direct had agreed to purchase the referenced vehicle for the amount of $331.31 once properly signed title and keys were provided. Additionally, our records indicate the referenced vehicle was gifted to him through a church acquaintance and he does not have any of the original title work for the referenced vehicle. Before Copart Direct can proceed with the purchase of this vehicle, Trevon Prince will need to have the referenced vehicle properly transferred and titled into his name.

      Copart respectfully request the BBB to close this complaint as Mr. Prince cannot legally sell a vehicle that is not properly titled in his name.

      09-19-2024 i won a bid on a vehicle for a total price of 1363$ i paid with my debit card in full. later they suspended my account and said that i had used another card besides my own for the purchase. i said how is that possible when the money came out of my account already. the manager at altoona copart yard told me she would look into it and get back to me. no answer. after spending closer to 5 hours on the phone with customer support out of *****. ive been hung up on while on hold 4 times and no one seems to have an answer if im going to recieve my refund and is it going to go into the correct account.

      Our security team has confirmed that we have a variety of compliance processes in place that screen Member activity across the platform,and depending on the type of activity detected, may trigger account restrictions. In this case, our systems detected the credit card ending in 9530was not authorized to make payment. The card owner, ****** J. ***** must take the credit card ending in 9530 along with a valid photo ID to the nearest yard to be verified by staff.  This individual is not authorized to make credit card payments via our website.  
      As a result, Copart has decided to suspend your account.This means that you will no longer be able to bid on vehicles on Coparts platform or otherwise be able to use Coparts products or services. You are also prohibited from creating a new account with **********************, from making any payments to Copart, and from using any other Copart Member accounts. This decision is final.

Additionally, the Copart purchasing location has completed a buyback of the vehicle referenced on 9/30/2024. The reimbursement will be completed at the Copart purchasing location as well as funds be returned to the cardholder name listed on the debit cards used for purchase.

      I renewed my membership with Copart after 4 years with intention on buying a car and was asked after paying the membership fees to provide proof of address so I did provide my German documents and next day as I was trying to bid my account was suspended claiming that my documents are not in English, although the German ID is in 3 languages (German, French and English) , so I asked to refund my fees 2 days after I initially paid , and was told a would get my money back within 2-5 business days but after 10 days I wrote to customer service again and they answered that renewals cannot be refunded ! Although my account was rejected and not renewed , this company is big scam I have had many issues before but now I cant keep quiet. Yes they are a big company and have fancy lawyers because they can afford it , but taking money and denying me the right to use their product is a total scam , and then when I told them to return my funds they left out 20$ so I told them to return theses funds also but said Id have to pay 35$ to return the 20$ !!!!

Additionally, our records indicate Mr. ******* deposit of $500.00, $979.39 and $20.61 was refunded back to the original payment method on 9/16/2024. As stated in the terms and conditions, that *** ****** agreed to, the annual membership fee is non-refundable. We ask the BBB to close this case.

      There is a vehicle at they're ************** 69 sublot (Lot #*** 543 63 ) that has been shown on their website for almost a year now. The car has been open to pre-bidding since April yet has not bee assigned a bid date. It's beyond ridiculous how long this car has been open for pre-bidding, yet has not been assigned an auction date yet. It's completely misleading to have the car open for pre-bids but not tell the prospective bidders when the bid date will be. Every time you inquire with them about this vehicle, they say they're still waiting on the title work. How long does it take to get a salvage title? My complaint is that it's misleading to offer the vehicle for pre-bidding, accept those bids, but not provided a bid date. The bids on this vehicle go up and down repeatedly and seem to reset after a week.

      In reviewing the referenced vehicle, our records indicate the title work for this lot was submitted to the *** for processing at the end of April 2024. Unfortunately, the sale title documents have not yet been received from the state to officially assign this vehicle to an auction. The Copart selling location is exhausting all efforts with the state to obtain the sale document; once received the referenced vehicle will be assigned to the next available auction. Copart respectfully requests the BBB close Mr. ******** complaint, as it does not relate to a consumer transaction, and is merely a critique on how our system notifies our members on upcoming vehicles for auction.

      The State of New Jersey *** has confirmed to me on multiple occasions that the title had been completed and mailed to Copart. Copart denies this but does not seem to be making an effort to follow up with the *** or to locate the title. Its been 5 months of waiting for the title from the ***? I find that hard to believe.

      I am rejecting this response because:   They are not being honest with their response. Ive spoken to the ** *** several times and each time they assure me they mailed the salvage title back to Copart. Yet Copart denies this. They keep saying theyre still waiting for the title. They never seem to just call the *** to find out for themselves. They are not being truthful and quite honestly, 5 months for a title is ridiculous. They are stonewalling the sale of the car to likely sell to a friend of someone at Copart. I have offered several times to purchase the car outright and they reject the suggestion each time.

      May 2, we sold our disabled car to Copart ******, **. They would only purchase with notoriety signature when we sign. ( not required in AZ but we complied giving it to driver who picked it up. We were paid. They did inquire by text or stated with inference to the title needing 2 signatures (only need one as it was or not and with my husband and I. My signature was notarized. They wanted us to copy a picture of signed title print and have husband sign. We said it was legal title and it was notarized as such. Sept 6th this year by *** couldnt get license thay called car abandoned.

      In reviewing the referenced VIN, our records indicate the original Arizona title received was signed by ***** E ********** in one of the required portions of the reassignment of title. Unfortunately, Ms. ********** did not complete the signature section in the release of vehicle ownership section.The Copart facility where Ms. *********** vehicle was located worked with Copart Direct to obtain the necessary documentation to complete the title transfer.  Ultimately, Copart and Copart Direct was unable to obtain the necessary documents to transfer ownership, therefore completing the abandonment process in the state of ******* to obtain the documents to sell the vehicle.

      The funds in the amount of $925.00 was paid to Ms. ********** for the purchase of her vehicle.

      Copart respectfully request the BBB to close this case as we have exhausted all efforts to transfer ownership if this vehicle.

      I am rejecting this response because:   DMV of Arizona says they are wrong our title was as it should be and Notarized as they requested. He did not mention they turned it in as an Abandoned Vehicle knowing they had the legal title in hand. I do not know why they feel the title was not useable but I will and have spoke to DMV and what you asked us to do to fix it was absolutely not legal and I believe you would have blamed that on us. Once again we had it notarized as you asked and not mentioned that. And you received $500 dollars back for towing. Id appreciate a different response before we seek legal counsel!

      We have been advised to sue although I believe I will advise their Corporate before suing. We have shown all the proof to *** and contacted the company that picked up the car. Statements from all and proof on this site that they paid us for the car. I thought this would stay on BBB so would like that copy. Once again I would like to go through their company local. Our title was legally signed so I do not know why they chose this route but I would like to advise anyone selling a car please check with your state and list it as sold. Our only mistake n

      **** ***** is not a customer of **********************. **********************'s customer in this matter is ************, who assigned Codys vehicle to Copart as part of an insurance claim. If **** has any issues regarding their vehicle while it was at Copart, they should address them with ************ who requested the vehicle be brought to Copart. As this is not related to a marketplace issue, Copart respectfully requests the BBB close this complaint.
