I recently notice after viewing my consumer report inaccurate, unauthorized, incorrect information 6/13/2025.This account is reported as a charge-off, but it appears to misrepresent canceled or forgiven debt as income. Under FCRA 602(a), 607(b), and 623(a)(1)(A), this reporting is inaccurate and misleading. Additionally, under IRS Code 61(a)(12), discharged debt is considered income for tax purposes only and is not appropriate for credit report inclusion. Please remove or correct this entry to reflect only accurate charge-off status without implying income.Under 15 U.S.C. 1681, 1681i(a), 1681n, 1681o, and 1681s-2(a)(1)(A), the Fair Credit Reporting Act mandates that furnishers must report only accurate information and promptly reinvestigate any consumer disputes. Failure to comply with these duties can result in civil liability, including actual and statutory damages. Specifically, 1681i(a) requires consumer reporting agencies to reinvestigate disputed information within 30 days, while 1681s-2(a)(1)(A) prohibits reporting information known to be inaccurate. Violations may subject the responsible parties to penalties under 1681n and 1681o.Under 15 U.S.C. 6802, consumers have the right to opt out of the sharing of their nonpublic personal information by financial institutions with non-affiliated third parties. I noticed I had late payments from EXETER FIN on my credit report. During these months I did not receive anything stating I was late. As you can see, majority of my payments have been on time so I am requesting the removal of these late payments from my account. I am trying to increase my score to purchase a home and would greatly appreciate if you guys can submit a request to the credit reporting agencies to remove the late payments.Business Response

I have had the loan for about 3 years. I have been trying to change the due date for payment for long while. I now only get paid once a month and cannot change that fact. Everytime I call I am told that I cannot do it for one reason or another. This last time I was told they could, and would send me an email confirming the new due date to electronically sign. I never got the email, I called back and they said they couldnt do it because it was too close to the due date. They did not notify me of this. I have asked numerous times to be transferred to the local, in ***, branch to talk to. They tell me that they are not capable of doing that. In the mean time I keep getting charged over $60 in late fees. They are claiming it is TX laws that are prohibiting of making the change.Business Response

Exeter are criminals and scam artists. They should not be able to continue their shady tactics. I got laid off and fell behind a few months and they repossessed my vehicle. They charged acct off, but let me pay $3800 to "reinstate" the loan. Once paid, They called and harassed and threatened me daily. They said I could continue paying monthly to keep the car but since acct was charged off, Making payments monthly would continue to negatively impact my credit each month. They threatened weekly that if I didn't pay off the balance or refinance elsewhere, they could repo the car again. I've been paying and staying in communication with them each month. They were pressuring me to refinance but the amount they said I owed kept getting higher instead of lower after each payment. I explained with my credit tanking after the charge off that I could not find another finance. I told them I was trying to come up with a settlement cash payout but needed time. They called me every day threatening to come get car again. I sent my last payment on 4/15 and told them I'd send another and even prepay the next month or two. Could not refinance anywhere and that would've cost me another $30k for a 2014 Acura I financed in April of 2021 with a 32% APR. Why would I want to pay $60 grand for a car that was financed for $15k to start. The car was bought at ****** and has been a lemon and a money pit. They just repossessed it again this past Saturday and tell me I can't get the car back at all. Criminal, scam artists, predators! Run far far away. They should be put out of business. Now I've paid $39K to them and have nothing to show for it and I need the car to get to work. I have a physical disability and can't make long walks to take public transportation. I hope these b******* sleep well at night. I'm making it my mission to spread the word and to sue them.Business Response

Since I punched my vehicle with this finance company, every time I se.t a payment to them it has taken just about a month or longer for them to process my payment, many times putting my account late. I recently started to notice that I feel like I'm overpaying with the car note towards Exeter finance for example a couple weeks ago I caught my car payment up which should have left no balance for the time being but Shortly after, I login online to see a small balance and was told that it was a small late fees so I paid it. However, I called previously before spoke to someone made a payment and the account should've had a zero balance until the next car payment. Roday, I login online to see that I have six hundred almost seven hundred dollar payment that due but my car note is only 530. 00 There should not be a balance higher than that. What I think is going on is that customers are making their online payments but the online system isn't reflecting the current balance right away or at all and it's causing me and others to think that we still have balances which is making me and other people pay so I feel like I'm constantly paying overpaying Something isn't right with their online paying systemBusiness Response

Dates of Transition (Car Payments), range from May 2019 May 2015 Amount of money I have paid is approximately $29,500 within an 7 yr period Exeter Finance provided me a Simply Interest Load for a 2017 ****** Camry o 12/2018 The Nature of the DISPUTE is their Predatory lending - Their unscrupulous practices carried out by them the lender persuaded Me, borrowers to take this loans without fully explaining in detail the interest rate and payment processes for which over the course of these 7 yrs the $29,000 paid to them by, majority went toward interest payments and only @ $610.00 went towards my principal balance.. I took out the Loan for $17,813 and as of today I still owe $17,717. Which shows under this description, they knew I cannot pay back or must pay back at a cost that is significantly above the market rate.After numerous calls to CSR and speaking to many different Managers in various depts, they have not tried to resolve this matter with me so that it can be revised in their accounting payment system to reflect proper payments that I have made to go to both the interest occurred and the principal balance too. At this junction, I am at my wits end, severe emotional distress, anxiety and frustration that I have recently decided to turn the car back over to Exeter Finance since it seems I'll never pay it off even by its end date of March 2026 - I was informed by the *** there that even at that point I would still owe them $17,177 after pay what the agreed amount and interested would have been @ $35,860. I would like to report them and sue them under my rights as a consumer - "The Trust and Lending Act (TILA) is a legal directive passed in 1968 that requires lenders to be fully transparent in the terms and conditions of their products. This is not a duplicate complaint. This is the first time I am submitting a notarized Affidavit of Truth with specific demands and legal claims based on ****, ****, TILA, and contract law.Exeter Finance and Equifax reinserted a deleted repossession account onto my credit report without providing the required 5-day written notice as required under FCRA 1681i(a)(5)(B). I was also never provided a certification of accuracy by the furnisher at the time of reinsertion.Under contract law, I formally requested a copy of the original wet-ink signed contract, timestamped disclosure documents, and specifically, the clause that authorizes reinsertion of data after removal. No such clause or signed agreement has ever been provided.According to the Doctrine of Reasonable Notice, no contract terms can be enforced unless they were clearly disclosed, agreed to, and initialed or signed at the time of the agreement. Reinserting deleted information without my consent, without any legal basis or valid contract clause, is a material breach of contract.This complaint includes a notarized affidavit (dated May 7th, 2025), which both parties failed to rebut within the 15-day deadline.
