  I hired Mr. Cavanaugh while I was in the process of deciding whether or not to file for a personal bankruptcy. I was happy with his presentation during our initial meeting and so I decided to pay the full retainer he requested up front, before receiving any services. Mr. Cavanaugh sent me an information packet to fill out, and I informed him that I needed time to make a decision.
  Fortunately, after several weeks of negotiating on my own with creditors, I was able to work out an alternative path to bankruptcy.
  Unfortunately, despite not having provided any services, Mr. Cavanaugh refused to refund any portion of my retainer, relying on a clause in his contract that classifies the "retainer" as a non-refundable fee. Never in my life have I dealt with a business that has non-refundable retainers. A retainer is an advance payment for services that gets used up as the services are performed.
  Needless to say, I cannot recommend him. Any business that prioritizes profits over customer satisfaction is not worth your hard-earned dollar.

  Mr. ******* is incorrect on several counts. My fee is a flat fee for representation. Mr. ******* hired me on May 10th. On August 10th, he requested a refund. My contract specifies that the fee is non-refundable. A retainer also serves the purpose of "hiring" an attorney. As an attorney, you are bound by duties to your client. Mr. ******* alleges that he received no benefit from my services, but this is simply not true. In general, creditors are far more likely to negotiate when there is a credible threat of bankruptcy. It is clear to me that Mr. ******* viewed me simply as a means to an end, and that he had no intention of paying me after 3 months of representation. He is upset because he is being held to his contract. It is notable that my fee is very low relative to other attorneys. I generally represent poor people who can't pay very much. I gave Mr. ******* my standard rate. I actually do prioritize customer satisfaction, and I treated Mr. ******* very well. He says that never in his life has he seen this. All of the other attorneys that I know have a "non-refundable" clause in their contract. If he had hired another attorney, the fee would have been higher and would not have been refunded.
