This ** was to repair my home foundation after it was damaged from 2 vehicles that crashed into my home, 1st March 5, 21 and se**nd Sept 10, 21. Several large cracks appeared in the interior and exterior after all work was done. RW filled the exterior cracks but nothing was done about the interior cracks. When cracks **ntinued to get worse and more of them, I started calling RW without receiving returned calls. I didn't write down all calls but did document the following: On 10-26-22 & again on 10-29-22, I was told the owner, *****, would call me back but he didn't. I tried again on 11-3 and 11-5-22 when I was told workers would look at the work needed. Didn't hear anything else until they showed up without notice the Saturday after Thanksgiving @ 7:30 a.m. I had company so I showed Ta** the *********** said they **uld fix it. When I told the owner who I was, he laughed at me which I didn't find anything humorous about my situation. They never returned or called to schedule. I gave up. I texted ***** on 8-28-23 that I had no re**urse but to *** him if he didn't do something as I need to sell my home & move. He only then called & said he needed to **me by but didn't. Again, workers showed up w/o an appt & repaired my front porch only. I've texted for a status 9-6-23, 9-15-23 & on 9-19 was told someone would be here but evidently they called in sick on 9-21. I just today rec'd a message but I do NOT want them damaging my home any more than they have. I've been told the house was jacked up too high in front/back so the center is dropping which is creating horrible damage all throughout the house. I expect after paying that much $ & 2 supposedly successful repairs that my home should be very sound. It is not. I can't sell it and that situation has me in a very damaging financial crunch. The owner was told on 8-28-23 of the financial bind this has put me in w/o any sense of urgency. Told me he didn't HAVE to do anything. I don't want them at my home ever.Business Response

Please take in ************* house was hit hard by a car two times. It was first hit and then approximately one year later it was hit again repaired the outside of this house leveled. It never had a problem with *********** or the house then second time the car hit the house, knocked it right off of the pilings that we installed so we redid the job, all Misles problems stem from the foundation, settling in the interior, which I had no responsibility to repair, but had all intentions to help her and do the work. This is grossly exaggerated. We have made attempts to do this work even up till this week at some time, she never even read my text, but I have any text , I told her I would use foam and raise the center part of the house at no cost to her but Broadway foundation did no damage to this ladys house. Im not refunding her anything shes been a little hard to deal with to be honest, but I have no problem , she is under warranty. I hadnt been that long ago. We went out and adjusted a corner and no report of front sidewalk is certainly not the horror story that this ladies alleging I have no problem just like I told her of using the foam and raising the center part at no extra cost to her she knew that, but I do not plan on refunding anything , thank you ***********************, Riteway, FoundationCustomer Answer

I am rejecting this response because: Oh my gosh! I'm not believing this. Last night the owner told me I only paid him one check & they only did work for me ONCE (the first wreck)! Not correct!!! I have a cleared ck showing his nephew endorsed it as I was told I had to pay 15% deposit. I asked that the ck be held until my payday as I didn't just have an extra $1440. *** the nephew) said the office messed up when I saw it cleared my acct BEFORE my pay day. *** then brought me $1440 in cash and said he would get reimbursed by *****. As a result, I endorsed the entire ck of $9600 from my lender who had to endorse the insurance ck made payable to both me and my lender per their requirements, and gave it to Rite-Way when they came to get it. They were in such a hurry to get the check that I didn't have time to deposit it in my bank and write a personal check so I merely endorsed it. I'm trying to get a copy of the back of that check to see who endorsed it and where it was deposited from my lender. I recall providing that check clearly as I also pointed out the exterior cracks which were patched shortly afterwards. So now in the owner's response, he acts like they did work twice. He tried to tell me last night that I must have been mistaken and used someone else because they didn't do any more work on my house after the initial wreck!!! I have the text to prove this. He told me the initial fee that I paid from my own funds of $11,800 was payment for both all while he was telling me they didn't do further work...which is it? I've been plenty available except when I'm told someone is "on their way" without any scheduling or respect for the fact I work and can't just be at their **** and call 24-7 like he has done before. Twice when the workers (Taco) showed up was early in the morning and without any kind of scheduling. How unprofessional is that? No, I'm not happy and why should I be? I can't sell my home, the damage is horrible, and I don't have the money to fix it. I didn't cause this. They were hired TWICE to correct the foundation within a 6 month time, not a year, and it's a result of the foundation that my house can't be sold. How interesting that he tried to tell me that because I had a lot going on, that I must have hired someone else? I want a second opinion which I've requested, from a REPUTABLE foundation company, as to what is causing these major racks and settling. That is scheduled for Oct 30. ***** has said he would come to my house to look at it and hasn't honored his word once. I'm not wanting further contact with him because I'm tired of now having to PROVE that his company was at my home TWICE, not once...he can't get his facts straight, and that I've paid someone from his company twice, a total of $21,400. If he thinks I'm making more of this situation than it deserves, or that he is responsible for, he is mistaken. I've lived in this home for 7 years as of the end of November and NEVER had these issues until now. I have no funds to repair the damage to my home and drastically need to be able to sell it and move or face financial ruin. I will provide the results of the second opinion once rec'd. I want a copy of the initial and subsequent graft showing what work was done in my home. I requested that from *** several times and never received it. I need a copy of BOTH as it's possible I'll need to hire a structural engineer who will want to see that information. How I'll pay for that I have no idea. There is no creditability with Rite-Way (***********************) as they don't even know they worked on my foundation twice. Nor do they know I was invoiced and charged/paid twice for their work, only to be told they don't HAVE to do any work on my house but out of the goodness of their heart they will come out with foam to try to fix the problems. How then, could I possibly be expected to have faith in their work ethics or creditability? I don't. Not because I don't want to, but because they have created this. I can provide more documentation to prove two payments once available. I'm almost 71 years old, raising a grandson by myself, work daily, and need assistance. This is shameful.

***** seems to be growing by the day she seem to add just whatever she wants to add plain and simple. We fixed her house in 2020 and then again in 2021. I never heard a word from her the whole time I sent men to her house she had the nerve to send them away just recently, my phone man was on his way to come to take care of the center part of the house, which is not included clearly by me or any other foundation contractor youre only responsible for the pairs you put in I never understood the terminology that she used which caused a lot of confusion she kept pressing the point of damage we did damage we never did no damage to her house I believe that the drought and just a plain and simple fact that the house was hit two times hard by a car caused the problem and then not being able to get together for adjustment inside is the issue here Im not refunding anything I clearly have no problem going out and continue And raise the inside hall. Mind me and said it only needed five pairs inside. I didnt want to tear up the inside of her house that I waited for a phone man to get free to come to do it. He was on his way and I called her and she refused Very much blow down in proportion here its just getting bigger and bigger. Thats my final Thang on this Im not paying her for another foundation company she thought shes got pierced all the way around the house she knows very well what she has but no inside like I said we paired the house on the exterior the first go around when the car went halfway through her house . Issue on both times she didnt call me from when I sent the men out on Thanksgiving morning or right after that because she called I wanted to help her right away. She ran Nowman off and I didnt hear her from her for six months I wondered what happened one day with the phone machine inside the hallway of the house and its fine when they take measurements there it wasnt but 3/4 of an inch down that house had cracks in the hallway when we did it and and the work was brand new. No shes already done what she can do damage me. Ive been in this business for 40 years and never had such a thing like this ever ever. She did everything she could so I have no issue with doing anything for her to help as far as the house goes Im not refunding her money after all of this that she did to me, **** is the phone man and he is a patient good man and she never gave him a chance. He thought she she made him turn around and then he got sick the next day with ***** and had to quarantine for two weeks his whole family. All of this is a bunch of back-and-forth stuff thats getting blowed out a proportion like all of these do, and at the end of the day I say the same thing all that I was trying to do to take the easiest route not to tear up her inside of her house and break out the floors thats why I wanted to use foam but its and she would never know we were there. I told her that shes got to where she takes everything wrong, so so be it I Texter and she never even return my text for four days and Im 71 years old myself 45 years never had anything close to this woman the way she has responded and acted she never did that prior to this. She told me her daughter had a lawyer and all of this threaten me L everybodys got lawyers it was up to us to make this right, and even though I have, just like every other foundation company. No responsibility to repair or adjust something thats not there clearly its an interior problem. Oh of course now she says that it was jacked up to high and its been all over two years. Thats the first I hear of that and thats not true we took we took levels in that house the last time Tahco was there , hes been working for me 24 years. Hes not a dummy. I think we could set a date. She doesnt know **** hes a phone man he can come in with a couple of men fix the interior. Ill leave an offer to help her with her sheet rock repairs, even though ** clearly not responsible for them. Our work was around the exterior, but Delays us to rest. I will go that far but ** not giving her money back after we worked and installed, these peers leveled her house in short order for her helped her out when she was waiting for insurance money two times and then turn around and have a car hit it again , it wasnt a bumper little bumper it was a car went way into her house. Significant damage was done. Some of this could possibly be a result of that but you cant talk to her so thats my response I will put raise the hallway up and make the doors work and she can get her an estimate for repairs on the sheet rock and well go from there. I am rejecting this response because: As usual, this company doesn't seem capable of retaining any accurate records of their customers or of when OR IF they provided services. I'm tired of being called a liar when I have evidence of all my facts. He doesn't, he can't because he is relying on manipulating with words. He even stated on my ****** Review of his company, which again is all backed by documented facts "I'm sorry but we have record of working with you" Clearly, he meant to say we "don't". This kind of manipulation and bullying might have worked for him in the past but not with me. He is talking out of both sides of his mouth and I'm the one suffering. I've been nothing but professional with him UNTIL he wasn't returning my calls, requests to come look at my house (he actually told me he did come to my house and he didn't!)...but then he also told me I only paid him once, that they only worked on my house once, that I must have been confused and hired another company and "thought" it was them....on and on. I'm a licensed professional myself...for over 53 years....and I expect a professional level of communication, especially after paying them $21400 in a 6 months time frame. You don't call in the morning and tell your customer workmen are on their way. I have to work! I asked for the very reasonable "1 day notice" to schedule having people in my house so I could arrange my schedule to be here. But he claims the horrible ********** "ran" whoever Nowman is "off. You show up at my house at 7:30 in the morning directly after Thanksgiving without any scheduling, you bet you will be asked to schedule an appointment. Who does this??? Even then, I told him as long as they were here, to come in and look at the damage which ***** acknowledged so at least that could be accomplished. Never heard anything back for weeks and only when I asked for an update. Never heard back. How could I have "not given **** a chance" when 1. I never met the man 2. never communicated with him 3. I wasn't able to rearrange my work with NO NOTICE that he was on his way, but when he was supposed to be here the next day, which I did rearrange my business for, I was told he called in sick. I was then told they would have to work me in and he was going to stop by but again, never did. I didn't hear anything back until I again, requested a status 5 days later on 9-26-23 and again on 9-27 (Wed) and was told he would get back to me, On Oct 2, the following Monday, I told them I no longer wanted to have their company do any further damage to my home. His stmt that you can't talk to me??? Really? Actually, saying you will do one thing and then doing nothing causes me a problem. Telling me someone is on their way while I'm getting ready for work without any more notice than that causes me a problem. Having someone show up at my house without any notice at 7:30 a.m. directly after Thanksgiving, that causes me a problem (it's amazing that I was even home). *** center of my home sinking that distresses drywall/doors/jambs throughout my home so I can't list or sell it when I drastically need to, causes me a problem. Having to prove that your company was paid twice for two repair jobs causes me a problem. Telling me "Outside piers are lifetime they don't go nowhere" and telling me "*********** your not stupid you would've never paid that kind of money you didn't have it's just a mistake your over look something check & you will see I am sure" causes me a problem. If that is the case, refund the $9600 that was paid to you!!! I will send before the end of the day, a statement of where his facts are wrong per support documentation. Rite-Way was hired to correct my foundation....twice after 2 vehicle wrecks and were paid for both. Based on the owners aforementioned text, I shouldn't have paid the subsequent $9600 since per the invoice, re-working what was already in place shouldn't have totaled $9600. Foundations affect exterior AND interior if not done correctly. *** earliest I can get a second opinion is October 30 which is beyond 14 days. Is it possible to get an extension since it appears that could be crucial in determining the resolve of these issues that extends beyond my documented facts and the owners inaccurate statements? Please let me know at your earliest convenience. Thank you.
