On March 19, 2012, the BBB contacted the company to discuss its promotional mailers. The BBB is concerned that the layout of these mailers, sometimes falsely, gives the impression that consumers owe a balance on a line of credit. The BBB is also concerned that the use of the terms "final notice" and "second notice" within the mailing would likely create a false sense of urgency.
The Basic Principles of the BBB Code of Advertising state that advertisements that are "untrue" or "misleading" shall not be used. The Basic Principles also state that, "An advertisement as a whole may be misleading although every sentience separately considered is literally true."
The BBB discussed some of its concerns with the company. The BBB also asked the company to provide all of its mailers, in succession, to see that they were, in fact, "final" and "second" notices as claimed.
To date, although the company did discuss the matter with the BBB, the company has failed to provide copies of all of the mailers. The company has also not addressed the BBB's concern with regard to the false sense of urgency.
