In August of 2019, BBB staff became aware of certain terms and conditions contained in Move America a/k/a Railvan LLC’s contract that were disparaging for consumers. BBB staff engaged Mr. Howard Grad, owner of Move America, in conversations and email exchanges regarding our concerns related to the typesetting of both the arbitration clause and the boilerplate language of the contract, as well as the limit placed on an arbitration award.
Specifically, the arbitration clause does not meet the conditions required by BBB’s arbitration statement. The clause is to be set out from the rest of the contract by a box, bold printing, etc., separately signed by the consumer, and state the standards and nature of the arbitration.
Most concerning is the $100 limit on any arbitrated award, which is less than the filing cost of arbitration with either the American Arbitration Association (AAA), stipulated as the arbitrator in the contract, or the BBB. Removal or modification of the award limit was formally requested on February 24, 2020.
In an email sent to BBB staff on March 12, 2021, Mr. Grad asserted they would not comply with our requests for changes to his contract. Consumers are encouraged to read the fine print of any contract they intend to enter, and may find BBB’s tips for Hiring a Mover helpful.
