District of Columbia v. Express Homebuyers

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.


 


On December 22, 2022, Express Homebuyers entered into a Consent Order with the Office of the Attorney General of the District of Columbia (OAG). The Consent Order settles allegations that the business violated the DC Consumer Protection Procedures Act prohibiting the use of misleading statements in the marketplace and the DC Home Equity Protection Act prohibiting the offering of for-profit foreclosure rescue services.  Specifically, the OAG claimed that in a recent marketing campaign, Express Homebuyers sent letters to DC homeowners stating they were delinquent in their property taxes, urged homeowners to take action immediately, and if they did not act, the government could take their property.



Under terms of the Consent Order, the business agreed to no longer advertise their services by stating the consumer owes unpaid property taxes; any statement that would mislead the consumer regarding the sales of tax liens, the foreclosure process, government ordered auctions of real property, or implying any association between the business and the District of Columbia; and any statement implying that foreclosure will result from failure to use the businesses services. Additionally, the business was fined $70,000 to resolve this litigation.  The Consent Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
