    The company H.N.Funkhouser overfilled our home oil tank. The results were oil spilled over belongings and on our basement floor. It also flowed into a drain in our basement. The smell has been unbearable and my wife and kids were forced to stay in a hotel the first couple of nights. The company is refusing any responsibility in thier negligence. We still have standing oil in our drain and it still stinks in our basement.

       This was a very unfortunate situation for a rental house tenant where the heating oil tank and fill lines have not been maintained fuel tight as required.

    This tank was in a basement and the landlord had a third party doing maintenance on things at the house. This particular tank had surface perforations that H.N. Funkhouser was unaware of, as well as bad fill lines that were not properly thread sealed as required for fuel. In the state of VA *** requires that homeowners assume responsibility for maintenance of their heating oil tank and responsible for cleaning and reporting any leaks. This was not a spill situation as the claimant states. The customer ordered 100 gallons, which was much more than their tank would hold. H.N. Funkhouser had to fill from the outside of the home with no visibility of the tank level, and the system had no working alarm or tank gauge visible outside the home. When the tank reached capacity well before the 100 gallons ordered the system leaked out of the fill pipe joints in the tank system which caused the overspray of fuel to get on very nearby stored items. I have attached tank owner responsibility statement that the VA *** has on their website. The amount of fuel leaked was very minimal. estimated at less than 8 gallons which H.N. Funkhouser personnel came on site as a courtesy and helped clean up. H.N. Funkhouser also reimbursed the customer the amount they had pre-paid for fuel which was also not required, but done as a courtesy to help the customer. In situations like this where poor equipment causes a leak the homeowner can use their insurance to replace items lost or damaged, but the fuel supplier can not take responsibility for tank system failure. We have notified both the tenant and the homeowner that tank system repairs or replacement must be done before further fuel deliveries can be made at this home.
