      I received a final notice regarding reference ******** in the mail (the letter was dated Feb 24, 2023). I was not aware of the first issue of this ticket (apparently on January 6, 2023) and I checked my vehicle dash and never found any sign of a ticket issued. Therefore I had no time to review this ticket. I now have the final notice and I have to pay more than the original ticket amount. I'd like to at least be given ***** on the extra administration charge as I did not have a chance to pay the original ticket at the time of issue.I've already paid the final notice (confirmation code 230228-64227570643) and the confirmation PDF is attached but I would at least like to have the administration charges refunded to my credit card.

      Please note the notice was issued to the windshield (as per the photos) on January 6, 2023.  We then sent out a Past Due notice on February 7th and a Final Notice on February 24th.  I have reviewed your online appeal stating you had no knowledge of the notice prior to your last letter.  I have taken this into consideration and as a courtesy will offer a refund of the late charges.       I parked in lot WT38 on 2/17. Immediately walked to the pay kiosk, and paid $17.55 for parking. This was a pay-by-plate kiosk, and I entered my license plate. I was not given a printed tag or receipt for the transaction, but that is normal for a license plate based pay system. I returned from my meal, to find a ticket (ref# **********) on my vehicle despite paying immediately after parking. I filed a dispute for the unwarranted ticket with Diamond's online tool, and also provided a PDF of my bank statement showing the charge that indicated both the date, charge, and lot number. 48hrs later, the dispute was rejected stating I did not provide documentation-- which is untrue. I've attached a copy of the statement to this complaint as well. I expect this fraudulent citation to be removed.

      I visted the parking lot at *****************************************. I frequent this lot often and always pay via pay by phone. I have never had an issue. on Feb 10th I parked there when my friend was visiting from **********. We went to eat at oddfellow across the street. I arrived at the lot around 11:12 and exited my vehicle to pay for parking when we sat at our table. The cell service was slow and I was not able to get the payment to go through until 11:35. My ticket was issued at 11:14. How is this enough time to get payment situated? It seems predatory that someone just waits in the parking lot to catch anyone that hasnt paid for 2 minutes worth of parking. I have disputed and gotten no response. As a nurse that often goes to oddfellows for an after shift breakfast and always pays. It is unfair that slow service and predatory parking attendants would cost me $100 + $10 parking fee that I did pay. Ticket reference #**********

Failure to pay in advance to park in this location has resulted in a parking owed amount of $65.50. As you said, you were having problems using your cell service to make that payment on time, as a courtesy we have reduced your parking notice to $16.32.

      Hello,Diamond parking services is a private parking ticket issuing company. Today I parked in a lot of theirs (A369 - *************************************) that was marked for customers of dicks drive in with intention to purchase food, eat it and then leave.in the same lot is a pet store, which i stopped into before heading over to ****'s.Upon walking across the lot, I see that they have issued me a parking ticket, and I spoke to the person issuing it. She was in plain clothes sitting in her car. She told me that she or the security guard was watching me park and that the rule is that i cant step foot off of the property and so she waited until I did in order to issue me a ticket. This rule is not posted anywhere in the lot. The ticket itself does not show my car in the lot at all, it just has a picture of my license plate. I have a receipt from the ****'s drive in and submitted it to their company Their intention is to charge me $65, which will eventually be sent to collections. I looked online and there are a lot of people who report that this company has hidden rules and unmarked patrols to hand people invoices and threaten collections (damage to credit) to people. They have no physical proof that I was even there, but also no postage of the rules and no way to record or know my intention to use the lot properly.Both of the customer support people i spoke with said "yeah we know that this lot is particularly strict". The point being, I as a person who could be subject to that have no way of knowing that.I feel like i have no way to defend myself and my credit and that im being backed into a corner to pay for something that I thought I was obeying the rules for. This is unfair and I think if this is a common experience with this company they should be investigated and prosecuted for dishonest business practices. Even if I get this case cleared and their bill cancelled, I would still like to report this company.

      I am sorry for your frustration . Our intent is not to frustrate parkers at Dicks but to rather enforce the Rules, the Landlord has chosen for the property.
      One of those rules is not to walk off the Lot to conduct business elsewhere ,as the parking Lot is exclusively for Dicks Diners.

      It is unfortunate that some businesses do not provide parking for their customers , such as the pet store.
      However, I do feel your frustration and will provide a one-time courtesy void on your Notice but please be aware that you could potentially receive additional Notices in the future if parking for any other reason than dining at Dicks.

      There is plenty of paid parking in the vicinity such as A184 , just about one block south on the same side of the street or A487, a parking garage , accessed via the alley on ********************.

The sign said parking is allowed for 90 minutes which is less than I parked. No 30 minutes sign was clearly stated. I tried to dispute it with Diamond parking but they refused it.       Hi,

      This location is private property and has the parking rules posted.  It is to be monitored at the request of the property manager, and Diamond Parking is provided a list of specific rules and is contracted to enforce by ticketing and/or towing based on the challenges the location faces due to unauthorized use.  I have reviewed your ticket and see it was issued for unauthorized parking as you were parked in a stall reserved only for 30 min *** and exceed the time.  All the 30min stalls have the sign on the curb which would have been noticed when pulling into the stall.  Please see attached picture.   Diamond Parking must uphold our contractual obligations, however, I have reduced this notice to $25 as a one-time courtesy.  To receive this reduction please contact our office within 5 business days and quote your reference number.  Thank you!

      Dear Sir/*****,I went to ****************** in ********* for shopping and the supermarket allows customers for free parking if customers purchased items from them. The parking lot is private and on its signage it said $70 if leaving this property without your vehicle. I parked my car there for about one hour. There might be two minutes during which I went to another place, and for all other time I was in the supermarket. I got a parking penalty notice (reference # ********) for leaving two minutes not in the market. Is this legal?Also, on your signage, the penalty is $70 plus applicable taxes, but even after taxes. However, on the penalty notice, it stated the base fee is $80 including GST and another $6.5 for handling fee, so the total I need to pay is $86.5 which is much higher than $70. First, what kind of GST is $10 for a $70 penalty? Second, on the signage, it doesn't mention the handling fee. Is this legal?When I asked the company customer ********************** about the amount of the penalty? I was told that the penalty is final and I cannot ask them questions about this penalty, and I just have to pay the penalty. I don't have the right to ask questions when the amount is different? Is this legal?

      Please be advised I have reviewed your case and the numerous interactions with our staff.  The reasoning and validity of the notice has been explained multiple times.  In final, please note all parking facilities have signs posted that meet requirements of each municipality. Locations would have been inspected and approved by the city in order to grant ******** licenses.  The unauthorized use of parking on the facility are the issues on this location which result in notices to vehicles and/or towing.The base rate includes direct and indirect costs incurred in order to enforce payment (GST, Admin etc).  This is also on signage.

      I am rejecting this response because:

      First, I asked multiple times about the amount, but it was because your staff didn't explain it well. I explained my question again below. Also, your staff were so rude and arrogant. I have tried the best to be patient and friendly when asking questions but your staff kept telling me not to contact them after my first-time inquiry. I don't understand what makes your staff so arrogant and rude? Why do your staff think you have the right to ask me not to contact any department or areas of diamond parking? I pay money for the notice to your company, but I cannot ask what I am paying for? I think I have the right to know what every ***** I spend is for! By reviewing your company's ratings on ****** Review, you may become aware of the negative behavior exhibited by your staff.

      Second, your staff said "the fee includes ****% Translink and GST tax" and "$6.5 for handling fee". The fee includes ****% Translink and GST tax is not correct as explained by your staff. Either your explanation is apparently not right or you didn't provide enough information. The reason is taht based on the information you provided, i.e., ****% tax, the amount is not correct: ****% * $70 is equal to $21.14, but the tax you charged was $10 for $70 penalty.

      Third, since you charge the handling fee for alll notices, why don't you just put the exaxt number or percentage of the handling fees and tax on the signage? Your signage just says the vehicle owners need to be responsible for all indrect or direct cost on the signage, which is so ambiguous and it could be any kind and any amount of fees. This is not fair for customers.

      References Ticket # ********** - I was ticketed at 6:20 pm on 1/30/2023, 10 minutes after I parked, for non ***************** Advance Payment with park mobile for the free period. The ticker cost is $66.50 or $103.00 after 15 days. I parked in the lot at the ***** Bldg in ******************************* ********** NE ********, **) . The building uses Diamond Parking mobile app to check the lot. The lot allows free parking for the first 2 hours. No advance payment is required.I attempted numerous times to register my car for the free parking on the Diamond App. The App, clearly shows that no funds were due for my parking limit. However, the App will not allow me to register my vehicle for free - it requires me to provide my credit card information and address. There is no where to sign into the lot for free (no sign in sheet in the lobby or with the Mosaic businesses) without providing my credit card information and other personal information. In the 4+ years that I have been a customer of the *************, I have never stayed park longer than 90 mins. Notably, Diamond Mobile Parkinghas a history of having its computer systems hacked and consumer information being stolen. It also has a history of making illegal charges to consumers credit cards that it has in its records. I do not park in any other Diamond Parking lot due to the lack of safety of my online information.The Diamond Mobile Parking could easily program its application to provide a means to register my vehicle for the free parking period without me having to provided my credit card and other personal information. Not doing so is just a means to collect undue fees.I believe your company is ripping off consumers by requiring credit card and personal information to park for free. This activity is fraudulent and violates my rights and privacy. I submitted my dispute of this ticket to Diamond Mobile Parking Services.

Im sorry to hear that you had difficulty using the *********** app. Please understand that we made the move to *********** as the vendor for this garage based on the service needs of the garage. Please note that while you are asked for your credit card information and a $.70 fee might appear,once you process the free time there is no charge applied to your card.Furthermore, if you decide to stay longer than the free time the app makes it easy to extend because your information is already there. I understand your concern with inputting your information regardless and I want you to know that we work very closely with our vendors that we use to ensure all privacy and protection meets our standards.

      We have voided the notice # ********** and no further action is necessary. We hope that this doesnt discourage you from using this garage or any other Diamond Parking lots in the future and again we apologize for the bad experience and inconvenience.

      On January 30, 2023, I parked my vehicle in a Diamond parking lot in **********. I went to their machine, scanned the ** code and paid $1.25 for one hour of parking. When I returned to my vehicle I was shocked to receive a parking ticket stating I had not purchased parking. On reviewing the receipt I received, I realized that somehow the parking had defaulted to a lot in *********, **. Clearly I was in CA as that was where the ticket was issued with my vehicle, and I was not in **, nor had ever been there. Assuming it was a simple call to Diamond and they would cancel the ticket I was astonished that they said NO. I had shared my receipt for payment, and it was clear to me that there system was at fault.I have paid the fine today of $36.50 plus $1 handling as I don't want to appreciate late fees, but this is clearly a fault of the company and their systems and not me and I should not be responsible for this charge and would like a full refund of all monies paid.

      Entrapment of parking ticket at Diamondparking located on ***************************************** **.There's no visible signs entering the parking lot, only when leaving the lot. They have a security guard that hides rather then warn unaware customers to what a scam that this is. and now they are demanding $80 for a customer that shopped at the location.

      At 12:55 on 20**-02-04, we parked our vehicle at ************* in ********, **, in a lot managed by Diamond Parking Service, to dine at *************** in the Centre. The spaces at the eastern end of the lot were restricted to 30 minutes per posted signage, so we parked at the western end where the signage stated "90 MIN *** unless otherwise posted...violations $70.00..." We parked at space #**, directly facing such a sign, checked all signs in the area and they all said "90 MIN ***." At 14:25 we returned to our vehicle to find a H3336343**73**73434H Payment Notice demanding $86.50 ($80.00 plus a $6.50 handling fee) for "30 Minute Exceeded Time." We checked again for any postings referencing a 30-minute time limit in this section of the H3139333**633313****2H lot and could find none. We took photographs of the the signage and how our vehicle was parked. The photograph that H33303333343**9333433H took at 13:41, which photograph was included on the H3336343**73**73434H Payment Notice, showed the same scene with no 30-minute signage to be found. Their photograph also showed a white van in space #**, and the van was still there at 14:25 and it had not been given a Notice. We submitted an appeal, per the instructions on the back of the H3336343**73**73434H Payment Notice, together with our photographic support, on H33303333343**9333433H's website on 20**-02-05. On 20**-02-06 we received an "Appeal Denied" e-mail with what is clearly a pre-written response, saying in part that the location provides ample H3139333**633313****2H with time limit greater than 30 minutes, and again demanding payment for something that is false. We feel that this company is just trying to grab money based on a trumped-up allegation that we have photographically proven to be untrue. Furthermore, the company is demanding an amount greater than what was disclosed on their signage. We are submitting this complaint to protect the rights of fellow consumers to fair and non-predatory business practices. We would appreciate the H363137393**8313831H's assistance in resolving this matter.

      Thank you for your email.  Please note that this location is private property and all parking rules have been created by the property owner(s).  Diamond Parking has been hired to enforce these parking rules as posted on the property, due to the unauthorized use on the facility.  The lot in which you were ticketed has stalls allotted for certain lengths of time.  The stall where you were parked is one of the 30 min stalls.  Each of these stall has a sign on the sidewalk (please see picture of the stall you were parked in).  The photos you took were of the general parking area signage. Our patroller has no way of discerning how long your vehicle would remain parked past the permitted time in that stall.  I have however, reviewed your case/appeal and reduced this notice as a one-time courtesy $50.  To receive this reduction, please contact our office by Feb 15th, 2023 and quote your reference number.  Have a great day!

      We appreciate your prompt response, pointing out the obscure signs and offering to reduce the Payment.  However, being hired to manage the ************* Parking Lot behooves Diamond Parking Services to clearly and consistently communicate the Rules of the Parking Lot to the visitors/customers.  We submit that Tiny Signs on the edge of the sidewalk, especially with the other Proper Signs (photographs of which are attached) and the General Signage being up on poles, are not consistent with vehicle operators' expectations of access to the Rules.  In other words, drivers would not be expecting to find time-limit signs on the edge of the sidewalk where they are impossible to see when a vehicle is already in the stall (just vacating and still blocking the Tiny Sign); after driving around the Parking Lot and seeing the way that 30-minute sections are designated by signs up on poles, drivers would not reasonably expect to have to scrutinise the edge of the sidewalks for signs.  Perhaps drivers who have had experience with getting a Parking Payment Notice in the past and have thus been made familiar with these Tiny Signs would know to look down at the edge of the sidewalk, but first-time or infrequent visitors would not know this.  Additionally, there is no way for a driver to correctly verify his/her compliance with the Rules after parking, as the vehicle obscures the Tiny Sign.  Thus we also submit that the Tiny Signs are an unfair and perhaps predatory tactic designed to generate Parking Payment Notices and ****** payments from visitors/customers to this parking lot.  We request a courtesy cancellation of this particular Parking Payment Notice and that Diamond Parking Services improve and make consistent the parking-rule signage in the ************* Parking Lot.  This was an honest mistake due to what we hope is an honest oversight in the design of the signage.  Thank-you in-advance.

      Please be advised our locations are checked for sufficient signage.  We understand you did not notice the sign on the curb while checking the stall for availability, space, and obstacles before entering,however, feel the courtesy reduction is more than a fair compromise while still honoring our contractual obligations.  I will provide one final courtesy regarding this matter and extend the reduction to end of day Friday.

      The operator of the vehicle had no reasonable expectation of signage being on the ground, and certainly could not have verified compliance with the ground-mounted signage after parking the vehicle.  We shall take all necessary actions to dispute this matter to the fullest extent of applicable laws.  Thank-you, and please consider making the signage consistently accessible throughout this parkade and cancelling the Parking Payment notice.
