      My husband and I rented an apartment from Goldleaf Development, LLC in ***********, ** (********* Apartments). We legally ended our lease early because we had purchased a house and the apartment was re-rented to new tenants. Upon receiving the security deposit reconciliation, we have been communicating back-and-forth with Goldleaf because we believe they are unfairly and illegally charging us for normal wear and tear to the apartment. They have billed us $1,064.62 in "damages" to the apartment (over $300 excess of our $700 deposit). We immediately emailed them because there were damages that were included in the Move In report or notified throughout the course of living in the apartment for two years. While they have conceded some error, they are still insisting that we owe them for $864.99 in damages. My husband and I have rented from 5 different properties in our rental history and have always received our full security deposit back. In particular, Goldleaf is charging for cleaning, carpet cleaning, laminate to cabinets, and a new microwave. The move out report indicates there was some dust, hair, or crumbs/debris but nothing of major significance. Even the pictures provided between Goldleaf seem to be nitpicky and represent normal wear and tear to us. We realize that we have a different definition of "normal wear and tear" and it is not defined in our lease - including the ************ Rules and Provisions - Wis. Stat. sec. 704.28(3), or ATCP 134.06(3)(C). The U.S. ********** of ******* and Urban Development specifically include examples of wear and tear as including fading, discoloration, wear, small chip/cracks/scratches, and other items attributable to routine use - which they are choosing to ignore to charge us excessively. We believe Goldleaf is capitalizing on the ambiguity in the law to maliciously overcharge residents and increase their profit - and frankly, it feels retaliatory because we ended our lease early as we are legally allowed to do.
