USA v. Platt

Nicole Platt, owner and operator of Milwaukee-based Broadway Construction, is charged with one count of giving false information to obtain a loan from the Small Business Administration, a plea agreement filed Wednesday showed.
In 2022, federal agents investigated Broadway Construction and its owner for allegedly posing as a Black disadvantaged business owner to score contracts for her family’s company. Between 2019 and 2021, Broadway Construction won $7 million for various HVAC and renovation contracts for the U.S. Army, investigators said.
Broadway Construction applied for loans under the Historically Underutilized Business Zone (HUBZone) program, administered by the SBA, court documents showed. Platt didn’t disclose her company’s affiliation with Platt Construction when she applied for HUBZone, court documents showed. Platt Construction didn’t qualify as a HUBZone contractor and if it was mentioned in the application, then both companies wouldn’t have qualified for government contracts. In 2021, investigators filed a warrant application to find information stored by an IT company that both Broadway and Platt Construction used. Information included messages, emails, records, logs and filed still available to the provider. While under the program, Platt applied for 15 HUBZone set-aside contracts and won seven worth $4.7 million, which she wasn’t eligible for, court documents showed. After subcontractor costs were paid, her company made $323,492.
Platt faces up to two years in prison and will have to pay restitution, the plea agreement showed. The final amount will be determined by the court at a later date.
On April 7, 2025, Platt pled guilty to Providing False Statements To Obtain Federal Set-Aside Contracts. Platt was sentenced to 4 months in federal prison, 1 year of supervised release and ordered to pay restitution.
