We purchased a townhome and signed the contract with builder(Sage Hill Garden) mainly due to they promised to add the divider and extend the walkway on May 29, 2023, they promised the job will be completed within 2 months. The job is still not happening as of today after 14 months. After numerous follow *** and extremely frustration, we asked the builder to refund $5000.00 and they are not responding. The builder still builds townhome and condo in the same area.

    Hi ****,

No, we did not pay CAD $5K.

Originally the builder provided us incorrect sales amount - $5K over the purchase price, They refused to compensate adding air conditioning for entire townhome but offered and confirmed adding the divider and extend the walkway for us to finalize purchase and sales agreement back in May 2023.

They promised to start the work last summer, after numerous follow **** we still have no divider added and walkway extended.

    The builder is not responding,

    Thanks,

    Hello,

We intend to extend the concrete walkway and install the divider as agreed. This job will require a concrete truck, which must be ordered along with a pump, and concrete finisher as well. Prior to that, the dirt needs to be cut away, rebar installed, and prep for concrete forms must be in place. This is not feasible as a standalone job and must be coupled with other concrete work in the nearby area. That being said, we do apologize for the delay in addressing this.

I am rejecting this response because: their excuse is not acceptable. It's agreed in May 2023 that adding the door divider and extend concrete walkway will complete in July 2023. After numerous follow *** and the work hasn't even started after 2 summer passed, the door divider does not need any concrete work and besides, this builder continuing construction and build townhomes next to our building. It's getting extremely frustrated and stressful that the builder kept failing to do the work they agreed on and so, we request refund of $5,000.

They can have all excuses but the fact is they haven't started the work they agreed on for past 18 months and as customers, we felt being treated unfairly and very disrespectful. They should not overstated the sales price at the beginning and promise for work they can't perform.

It's extremely ***etting to know we are being completely ignored after requested of $5,000 refund on August 26, 2024.

The builder did not respond even after being served.

This small builder is extremely unreliable and can't be trusted.

    Sincerely,

    ***** ****
