    We had an agreed upon quote, signed an authorization of work, and re-stated the numbers with the go ahead e-mail, but they sent us a bill for a different amount. They still have not finished the job.

    The homeonwer Received a payout from insurance for hail work on his home.  ********************* told us to invoice the homeowner based on his payout amount, but the homeowner believes he should be able to cash in on the difference from the original estimate which is less than the final approved estimate from insurance.  He wants us to inoivce him for the original estimate which was a lower amount than what insurance approved in the end.  ********************** allows us to reprice for inflation on exterior claims and charge accordingly.  He was paid out according to the repriced estimate, but does not want to pay for it.

     

    It is illiegal to profit off insuranc claims but that is what he is trying to do.

    I am rejecting this response because: We are not profiting from this insurance claim. As explained to **** ***** multiple times, we had costs involved with getting additional quotes. We told **** ***** that we received a payout and to proceed based on the numbers. We signed a work authorization based on the approved amount, and later after the work was nearly complete we received an invoice for a substantially increased amount. We accept that there was a long time between the work being started and the initial quote, so the increase from $********* to $********* seems okay (but by law should have been expressed at the time of the project beginning). We do not agree whatsoever with **** Davis increasing their invoice to match a quote from another company that was quoting more work. **** Davis cannot charge for work not done.

    Good Afternoon;

    I offered the insured a mutually beneficial lowered amount to pay $******.  I also decreased this amount by the cost of the work unfinished ($*** for painting not done) as they asked for this not to be done.  This settlement amount was to be in "addition" to the deposit he already paid.  However, the insured decided to adjust this amount unilaterally and took the $*** already paid into the equation and took $*** off the settlement amount vs $***.  The insured neglects to inform you that he was paid out $******+ in hand, plus he owed $**** more in his deductible. It doesn't matter how I explain the numbers to him, he wanted to leverage the larger payout he received against our lower estimate to the insurance company.  It was a convoluted mess but I gave the insured numerous calculations showing how things were calculated.  With regard to insurance claims, there are different procedures and contract procedures and we were the contractor on record that was to do the work with the insurance company; so we knew and were owed the larger payout.  If the insured had gone with another contractor he was free to pay whatever he negotiated.  As mentioned before, I have tried to explain and make offers, to which the insured has rejected.  I have told the insured that he can pay whatever he feels he wants to, however, it may affect his warranty until the full amount is received. We have tried to be respectful and explain but the insured has not cooperated.  Again, we offered that he can pay what he wants but it will affect his warranty.
