) We paid $252.00 on 2020-10-05 in advance for yoga sessions. There was a shut down during COVID. Our instructor no longer worked there. We were told by one of the Yoga in Bowness representatives that our money was still there and not to worry. Yoga in Bowness is closing. We asked for a refund and were refused.

    Business Response

    Date: 27/09/2023

******************* requested a refund on the basis of not receiving a service that was paid for. The pass was purchased March 2021 and expired in September 2022. Company policy indicates that any remaining classes on an expired passes may be reactivated by purchasing a new pass. The expired classes may be added to the total classes available on the new pass purchased.

A public announcement was made August 9, 2023 that Yoga in Bowness was due to close at the end of September 2023. On September 6, 2023 ******************* requested a refund for the expired pass. All Pass purchases at Yoga in Bowness are non-refundable, as indicated on the Passes Page of our website. The purchase receipt also indicates purchasers should be aware of the expiry on their purchase.

As a gesture of goodwill, an exception to company policy was offered. Whereas normally a new pass purchase would be required in order to reactive expired passes, we offered to simply reactivate the expired pass so that it may be used for classes - without the purchase of a new pass. ***** did not attend any classes. He declined our offer to reactivate his pass for use and declined our available services.

There is no basis for a refund.

I am rejecting this response because we made a payment in good faith. Interruptions as a result of  COVID and some difficulties with my wife's health meant we were

unable to do yoga. If a customer acts in good faith and prepays for a service is it not expected/required that a business act in good faith?

    Sincerely,
