    On May 22, 2022, I purchased a True 12.2 ice hockey goalie blocker from United Sport & Cycle (the "Merchant") for the sum of $677.99.

    I completed the underlying purchase by entering into a ***ment Plan Agreement with ********* to make monthly ***ments on a contractual agreement. This foregoing method of ***ment is posted on the Merchant's website and it is an authorized ********* merchant.

    After I submitted an online Application to *********, I was approved and entered into a contract through the Merchant's website link.

    The next day I was contacted by the Merchant and advised that they were refusing to sell me the blocker unless I purchased the catcher for an additional $700.00, plus HST. This unscrupulous attempt to upcharge me is conspicuously unethical. Indeed, it was the Merchant's fault for not advising me before my purchase and my credit was pulled that the blocker would only be sold in a set with the catcher. By any objective measure, this was negligence committed by the Merchant and my credit score was lowered from 850 to 836.

    There was no notation or information provided to me by the Merchant that I had to order a blocker and catcher set if the items contained any colour. If this was in fact the case back in May 2022, my sale should not have been processed and my credit application not sent by the Merchant to ********* for credit report approval. My ******* and ********** credit bureaus took negative hit when my credit was pulled for account/ contract approval.

    In the end, I am the victim of a negligent misrepresentation made by the Merchant. By any objective measure, The Merchant has manifestly committed an unfair and deceptive business practice and ought to be compelled to honor its original representation and compensate me for my irreparably damaged credit bureau report.

    Hello, I talked with ******* immediately after I was made aware of his situation, he was very upset and frustrated.  I explained to him that unfortunately we only sell our custom colour goalie trappers and blockers as a set of both.  I have uploaded a screen shot of our website that states that very clearly.  Unfortunately ******* chose to *** with a financing option *** ****** and they have processed and ways they interact with their customer that we have no control over.  All of *** ******'s processes and policies are clearly stated in their application process.

    As indicated in my compliant, I was unable to purchase the underlying blocker from the business for the reasons comprehensively set out therein. Nevertheless, I have attached a photograph of the subject blocker as requested (taken directly from the business's website).

    In reply to the response of the business, it provided false, misleading and deceptive information to the BBB. In particular, the business's website notice about customers having to purchase both a blocker and catcher together was not on its website when I purchased the blocker. ********* even investigated and confirmed that there was no notice on the business's website about having to buy a catcher with a blocker purchase and vice versa on on or before the underlying transaction date of May 22, 2022. Indeed, it is trite to say that the business put up the notice that it attached to its response after this issue occurred and in any event, after the purchase date and contractual date of May 22, 2022. Therefore, the business has manifestly attempted to hoodwink the BBB and is dubiously relying upon something that was not on its website at the material time and was not posted until after this subject incident occurred (and very likely because of this incident having occurred). 

    Pursuant to *********'s Merchant User Agreement, the business agreed to its terms. These terms included, inter alia, that there are very limited reasons that an approved transaction can be cancelled (i.e. the subject merchandise became damaged, was lost or stolen, fire, etc.). The business's reason for cancelling the underlying already approved purchase that had already been the subject of a formal written contract was not one of the valid reasons for cancelling. Furthermore, the business had misled me, the buyer, and administered unfair and deceptive business practices in violation of the Consumer Protection Act. Because the business was in violation of *********'s terms of use and merchant contract, the business is ostensibly no longer permitted to use ********* and now uses ******.

    Other erroneous information contained in the business's response is the fact that it was not a customer blocker. Indeed, there were no customer specs as this was a stock 12.2 blocker with no customer options. Furthermore, black, white and red are standard Chicago colours and is also stock colours. 

    In the end, the business has conspicuously undertook deceptive and unfair business practices and I suffered and sustained damages to my credit score as a direct result thereof as the evidence clearly indicates. ************ * **** ******* *** *********** *********** ** ** **** **** ******* ** **** ******* Thank you.

    I purchesed a electric scooter january of 2022, with a 12 month warranty, i'm having trouble with my back wheel, as it's making a lot of noise, called but they were very uncooperative and will not return my calls and refusing to deal with the problem.
