    Hi,

    I live at ** ******* ******** *** ******* *** I had a completely finished yard (landscaping/drainage/fence). Completed Aug. 2019.

    There was an open lot beside my house. Homexx took my fence apart, used an excavator to rip up my landscaping/drainage/along side of home including down my foundation (all on my property) in order to dig the basement for their new home.
    Completed Aug. 2021

    Their home (** ******* *******) was completed Nov. 2022

    They have not paid for any of my damages.

    These are my costs:
    - Down spout Drainage $160
    - crush $120
    - creston Valley Rock $630
    - landscaping fabric $100
    - putting green pin (dropped fence gate on) $40

    I m having a tough time understanding that they can just come on my property and rip up my landscaping (and not replace it back to the original state).

    I would like to be paid in full to get my yard back to the way it was prior to them starting their project.

    When this complaint was filed we were already  in discussion with Mr. **** regarding compensation for the damage to his property while we were building next door.  We had made an initial offer which he rejected.  We pointed out to him the cost and delay to Homexx of waiting for him to cut his driveway because  he unlawfully poured on our property. We then countered with a higher offer of $900 with a stipulation that he sign a letter (attached) releasing us from further cost and liability.  He signed and returned this letter on  June 15, 2023 agreeing to the $900 offer.  I have also attached a copy of that email. We are in the process of issuing a cheque and should be mailed today or Monday.

    I have reviewed the response made by the business in reference to complaint ID 20184666, and find that this resolution is satisfactory to me. 

    I will update both *** and Homexx once I receive the $900 cheque. This case should remain Open until I receive it.
