    Due to COVID we postponed ******* wedding catering services and, in an email, back in 2021, ***** agreed to honor our deposit with no time limit indicated. I have been unable to find a time limit in our contract after putting a deposit down. I recently reached out to ***** to book his catering services in hopes of an anniversary celebration as we ended up having a tiny safe distance wedding with a few people outdoors during COVID. ***** informed me their services are fully booked for this year. I attempted to book for 2025 but was declined because they were fully booked for corporation bookings. I attempted to book for 2026 and was refused by ***** as he stated they no longer providing wedding catering and proceeded to inform me they are removing wedding services from their website. I have attempted to come to some form of resolution but have encountered either silence or aggressive emails from *****. I requested our deposit back but was refused claiming we canceled his services, and his deposit is nonrefundable. I have in an email his agreement in honoring our deposit with no indication of time limit and a request to postpone his services not cancel. As it stands, I have been refused services and my deposit kept. I feel that I have been respectful in my communication with ***** and feel no reason to be refused services. In being refused services, then I feel I am in every right to request my deposit back or further communication on how to resolve this situation without being ghosted by a professional company. Please see my email encounters with ***** attached with this complaint.

    #1- we were hired to do this persons wedding catering and not a anniversary celebration over 36 months later, I agreed to postpone her wedding for a later date, the minute she had her wedding  she forfeited her deposit,,   I did not hear one word from this customer for over 30 months, #2 -  Alberta has a statute of limitations of 24 months and this agreement is well over 24 month ago.  according to my legal council;  we did not have to refund nor postpone any deposits for functions during partial lockdowns during covid, I agreed to postpone her wedding yet she chose to get married some other way, #3- if this customer will not stop harassing us we will take legal action to stop the harassment.

    Good Morning, 

    Is it possible for the Better Business Bureau to advise how to move forward with this catering company. 

    By no means have I harassed this company. I have had no contact with them since my last email in the document I provided. I can assure you there has been no harassment and only respectful behavior from my end. I feel that I have experienced dishonesty and hostility from this company.  

    I contacted Better Business Bureau for help in finding a peaceful resolution.  

    I simply just wanted to use this catering service with the deposit we had originally provided. I was prepared to pay for his service. Instead of being upfront and honest with me, he kept saying he is too busy and then said he no longer does weddings. I never wanted the deposit back till he refused to provide me with an answer why he would not provide us with his catering service.  No where in the contract did it indicate if we got married the deposit would be forfeited. I had no idea that my deposit to a catering company would full under a statute of limitations. We were provided with no time limit on the deposit. I tried googling statute of limitations, but I was unable to find what he was referring to. 

    Could you please advise how to proceed.
