      Date of Incident: 2024-05-27 Time of Incident: 12:15 AM Location of Incident: The back green space behind our yard Description of What Happened: Lawn mowers went through the green space shortly after 12 noon. around 12:15 my neighbor came to my door indicating that the City lawn crew knocked over my back fence. When I went to look I could see that they had bent over one cemented in post for my chain link fence ruining the fencing and the post. The lawn crew did not report anything and continued on cutting grass.. Description of Claimant's Injury, Property Damage or Loss: Chain link fence was knocked down and with no one stopping to let us know of the incident. 2 to 3 weeks of waiting for the City to respond to our complaint we were told that APX services were the contractor doing the work and that the City is not responsible for third party damages. We got 2 estimates for the repair and after 3 weeks with our dog locked in the house, with the help of a neighbor I fixed the fence myself. I contacted *** and they indicated the employee had been let go. However they refused to pay any damages. Type of City Vehicle: Lawn mower or support vehicle backed into our ******** neighbor witnessed the incident

      Per phone call discussion with ***** about the property damage (one fence pole) for *****************************************

      ***** is quite firm that he believes he is entitled t $1,260.58 quote for Lynx brand to come out, remove the damaged post, supply a new one and install, as well as new fittings and mesh included despite him simply bending the post back into position. His reasoning is that he performed the repair and that APX should suffer a penalty for the accident. To be clear, the fence has been fixed by himself, at no cost to him, other than his time.

      We attempted to explain to him that typically APX Services performs our own in house repairs and would probably be able to achieve a similar result if not something a little better than him with our experienced in house repairs division, and him doing it himself to a satisfactory level for himself does save us money that we would be willing to send his way as compensation, but he is against this idea, as that is a scenario in his mind where we stayed on site, contacted him directly day of incident and performed the repairs day of incident, not after the fact.

      We asked him for an amount that he felt was reasonable for the repair he performed but he refused to state anything below the lynx quote. He finally grew tired of APX explaining our position on the matter and told us to send him what we felt it was worth and if he didnt like it, he would continue to complain and escalate, and if he did like it then he would drop the issue. I informed him that we werent about to send him random amounts of money until this went away, to which he didnt like. 

      We advised ***** that the cost for us to perform the repair with a crew of 2-4 workers and truck was probably somewhere around the $200-400 ***** He felt that the penalty for his time should add somewhere between double to triple the amount, or that he could charge us his hourly fee as an engineer and charge us thousands. 

      That is where we ended the conversation.
