    I hired Accurate Bailiffs to evict a tenant that was not paying rent.(Invoice enclosed)The agreement was that on July ******* , Accurate Bailiffs would remove tenants and their belongings.I met with Accurate Bailiff that morning at ************************ (rental property address) the Bailiff entered the premises and explained the situation to the tenant. The Bailiff reported back to me and advised me to stay away because the tenant had made threatening remarks to assault me. The Bailiff went on to say he could have the tenant arrested for uttering these threats but the Bailiff chose not to because he felt sorry for the tenant.(who was intoxicated) I would have been okay with this except for the fact that this unit was partially furnished by myself and I also had belongings(building materials and tools) inside the garage that were mine. I was not able to attend and view what was taken that was owned by me. If the Bailiff had had the tenant arrested or removed I would have been able to supervise and ensure that none of my belongings would be taken . So I am asking for a partial refund of the cost to compensate for items that were removed from the premises by Accurate Bailiffs. It has taken over a year to make this complaint because I was trying recover the cost of the Bailiff from the evicted tenant but that did not happen. When I complained to Accurate Bailiffs about my dissatisfaction they didn't follow up.

    The billing adjustment  amount I am seeking is $1000.00 for the items that were removed by mistake.

    First off, we are very surprised to receive this complaint after nearly 1.5 years since the enforcement.

    The bailiff would not have said he could have the tenant arrested, as we have no authority to arrest.

    In actual fact the police did attend on site, and they found no reason to arrest the tenant.

    The complainant provided us with a list of goods the complainant owned.

    The only items on the list provided by the complainant were furniture items e.g. 2 pc. hutch, dining table & chairs, bed frame & mattress, etc.

    There was no mention, written or verbal, of building materials or tools.

    I suggest that if the complainant provides tenants with furniture, ****** the future they should take pictures & keep a proper list of items & have the tenant sign off on such and keep for their records.

    There will be no adjustment

    I am rejecting this response because:

    I feel Accurate Bailiffs didn't provide the service they were hired for by not 
    wanting me to be on the premises during the eviction, as this was a 
    furnished rental I was not able to view what was taken at the time. 
    Accurate Bailiffs also just moved the tenants onto my driveway with 
    all the moving boxes, where they camped for 3 days. It seemed as if the Bailiff was making friends with the tenants. The tenants had been given 3 months notice to move out so it was hardly a shock for them. 

    The picture included shows how the bailiff okayed the tenants to leave their things on the premises(driveway)

     If the Bailiff had done his job correctly, he would have taken measures to remove the aggressive tenant(s) allowing me to make sure only the tenants belongings were being removed. 

    Giving them 3 days to leave their belongings in the driveway seemed to have been a violation of the contract with Accurate Bailiffs. I've enclosed a copy of the agreement.

    I am rejecting this response because:

    I have spoken with LandlordBC and they said that a bailiff has the power to call a sheriff to have the tenant removed from the premises if they are uncooperative (as mine was with verbal threats and drunken behaviour)during the eviction process.

    Landlord BC also said they were very surprised to hear that the Accurate Bailiffs bailiff gave the tenants permission to leave their stuff on my driveway  from Thursday morning until Saturday afternoon. The tenants then ended up camping with their belongings (to protect the belongings ) and later at night broke into the garage to sleep in it.

      It was a very tough situation because I'd already paid Accurate Bailiffs a $1900 deposit and there are only 2 other  Bailiff Companies that do this kind of work to choose from. Then they requested an additional $1500 on the day of the eviction. There was no going back or cancelling the services of Accurate Bailiffs.
