We hired Evolution Mechanical and their plumbing division for a project, but they have not completed their scope of work, despite our repeated requests over the past three months. Additionally, much of the work they have completed, particularly on the plumbing side, has been done poorly or incorrectly, requiring further corrections.Evolution Mechanical had also failed to pay their main supplier, resulting in a lien being placed on our landlord's building. This lien has significantly delayed the release of our tenant improvement (TI) funds, which directly impacts the payment process for Evolution. Over the last month, we have been requesting a detailed and accurate invoice, but they have failed to provide one. The invoicing process has been highly disorganizedjust last week, they inaccurately claimed we had only paid $68,000, when we had actually paid $173,000 to date.Their behavior has not only been unprofessional but also aggressive. Evolution Mechanical has repeatedly sent harassing and bullying text messages demanding payment, even though they have not fulfilled their obligations to complete the work or provide accurate invoicing. In addition, they falsely claimed to have contacted our engineers in an attempt to have our occupancy pulled by the city. After speaking with our engineers, we confirmed that they have never been contacted by Evolution ************************* is important to note that we have every intention of paying the remaining balance once the work is completed to our satisfaction. To date, we have already paid $183,000, including a $10,000 payment made in good faith last week. However, until the outstanding work is completed, the quality issues are addressed, and a correct invoice is provided, we cannot issue further payments. We are seeking a resolution that includes the completion of the work, accurate invoicing, and a halt to the unprofessional conduct we have experienced.

    Business Response

    Date: 16/10/2024

Hello, the work was completed in MAY and there were a few minor deficiencies that were our scope. They have been completed without disrupting their operations. Work was completed on weekend and off hours. Hard to coordinate as customer does not communicate easily (ghosting, out of office replies, redirecting contact person +lack of payment = frustration). We also did additional freebie of insulating in branches in the water line, that were not in job scope. Upon completion, reached out for feedback and got no response as to if anything else they needed. They had some confusion on who's scope of work was out of sorts and wanted completion of areas of work that were not our scope and wanted us to do additional work that we quoted but the offer expired due to no approval being received. It is understood the expired quote for additional work will be performed by others and the same company will also be inspecting our work done before Produckidivity will pay us for our MAY invoices.

The concerns surrounding the lien were addressed as soon as possible but the vendor took a month to process our payment (citing an ongoing list of necessary people being in meetings, at conferences, on holiday, sick). Our office worked with **** and her contact with that vendor to get the payment processed.  The Vendor further delayed removing the lien which was also out of our control.

Our invoicing is issued separately by HVAC work and Plumbing work. Invoices show separate HVAC progress and Plumbing progress with a history of all invoices issued with the % corresponding completion billed. We've never had a problem. Statements for both aspects are also separate for easy cross reference. After **** gave the same paperwork to their accounting personnel, the confusion was gone. We were hired and have the original PO for this project with ****** husband's company *******************. We expected history to repeat itself with a good project, contract and completion of work with payment. Oddly Produckidivity requested we redo/rename all our invoices to Produckidivity and they re-issued a PO in Produckidivity's name. I was told it was because they were paying us directly instead of via Orchard Contracting. Unusual.

We are hoping for payment from Produckidivity in the first week of October to complete all amounts owed for completed work. We hope for an amicable conclusion.

    Thank you,
    Kelowna Evolution Mechanical Ltd
