    On January 28, 2025 I received a text inviting my twin sons to join a Select ( top performance) football team that was written from the coach of the team that was expressed to me at the time that he was a board member of the association. I agreed to them playing on the select team. I paid for both twins on February 4, 2025 $493.20 plus a $60 fee to attend a tournament in *******. On March 13, 2025 I brought the twins to there first practice and it was very apparent when I asked to ensure that this was not a Select team and was told that it was a bring your own team and they no longer associate with that term. I emailed the association right away as the pretense of the team was misrepresented and the president of the association emailed me back and agreed that the wording of the invitation misrepresented the product. The president said he did not have the authority to give me a refund and would bring it to the board. I shared my concern with the conflict of interest and he said they would vote at the meeting on Wednesday March 19, 2025. I emailed the president at 4:55pm today March 20, 2025 and he let me know that they voted no and are well within there rights to self govern. Given the false information that was given to me regarding the product and the agreement by myself and the president of the association that I was mislead I would like have help to pursue a refund. I paid for a product that was falsely represented to me and if it was authentically represented I would not have agreed to the purchase.

    Firstly, we are a non-profit society for youth sports. The complainant has attached the email thread where I point out all the choices she made to opt to be on this team. She was not forced to be on this team, or misled to say this was any sort of all-star team. She also has included where I say this is not a "select" team as in a *** team as in other sports. The complainant misunderstood the use of 1 word, and never asked anyone for clarification prior to registering. The person (coach) that sent her the text, is not a member of our Association Board, as she claims, but a parent that just wanted to enter a Flag team into our Association and offered them a spot. When she signed up her kids, it is very clearly stated that by accepting all terms of our registration, there are no refunds. It is that simple, it says No Refunds, and she must accept it. As President, I offered to at least possibly break protocol and ask for a refund from the Board for her, it was put to vote, and voted NO. The only reason she wants a refund, which she states, is that she feels the team is not high enough of a skill level for her children. Nothing was done wrong by our Association. This is strictly based on the parent feeling her children are better than their teammates. Now because of that, she is demanding a refund, even though she has acknowledged and accepted the terms of No Refunds. This is not something we can accept, as it sets a precedent, that any parent going forward could then ask for a refund after we have ordered jerseys and shorts for these players, paid the City for fields, etc.

    I am rejecting this response because: as indicated in the response and in the body of the communication with the president, we are both in agreement of the misuse of the one word Select, which is the primary misleading description of the product sold. This is the singular word that described the kind of team that I was misled to believe I was paying for the kids to attend. The agreement by both of us that this was misleading, was enough for the president to bring it to the board to vote on a refund because there should be a refund because I was misled on the type  of team/ product this was by the use of the one word in the description.

    As the complainant has said, I, as President, empathized with her regarding the misinterpretation of the word Select. But the complainant made no effort to clarify, prior to making her choice. And, as I mentioned previously, had this discussion with someone not from our Association Board. So it had nothing to do with our Association. Then accepted the terms of No Refunds, but when things were not to her liking, asked for a refund anyhow. All I was doing was trying to be nice and seeing if anything could be done. The answer was no, and that was the end of the discussion. As far as we are concerned, this matter is closed, and there is no further need to go back and forth because the complainant will not accept the facts. The complainant is hanging her entire complaint on the misunderstanding of 1 word, yet I have pointed out over 6 times where she made a choice to join and accept our terms.

    I am rejecting this response because: The misrepresentation of the product was clear. When there is an invitation to a select team, that is a clear statement of a specific product. Asking the consumer to clarify the specific description does not illuminate the fact that it was misrepresented. There has already been an acknowledgment to the fact that the wrong word was chosen to describe this product which was the misrepresentation itself . The way it was described to me was very clear and specific as a select team. Giving a clear misrepresentation of a product, owning the fact there was a misrepresentation of product by using the wrong word to describe the product and then refusing to reimburse for the product purchased based on misrepresentation is an infringement of my consumer rights.
