    Alchemy Construction was contracted to complete renovation of our home. The ******** ** ***** ********* has not received the final schedule ** from the structural engineer. This document must be completed such that we may pass final inspection. This document has been outstanding for 18 months. For the past 3 months, Alchemy Construction, and specifically *******************, has ******* telephone calls and emails requesting this issue is addressed.

    ****************** & ****************** voided the terms of our contract when they ceased to pay the last invoices.  Despite the non payment we completed the job 100%.  A final meeting was held, with ***************** participating via phone, and ***************** suggested a 60k reduction in our billing, the full amount of our P&O, and which would leave us doing the entire job at cost. We were shocked by this suggestion and left the meeting in disbelief.  We sought legal advice and despite having a solid claim with a signed contract and good documentation it was suggested some form of settlement would be cheaper and easier than legal action.  We offered the clients a 20k discount on their billing and this was settled at 30k (roughly 50% of our P&O.)  Despite the language on our offer being very clear at a 30k lump sum ***************** paid it using her own calculations at 50% of our P &O or roughly 31-32k. 

    This ended our relationship with ***************** and ****************** Now months later it has surfaced that the schedule C-B by the structural engineer wasnt submitted and needs to be in order to finalize the district permit.  Rather than simply reaching out to the Structural Engineer and requesting the missing document ***************** and ***************** have embarked on a campaign of harassing myself and my staff.  We do not have this document in our possession to provide it nor are we inclined to provide any more unpaid time to assist in this matter.

    I am rejecting this response because: it is factually incorrect, as is implied by negotiated settlement. Breach of contract has occurred only on the part of Alchemy Construction, as it continues to fail to honour its warranty, and failed to submit necessary documentation required for permit issuance. Regular communication would have alerted ******************* that the structural engineer's contact information was incorrect, as were alternate options listed on the internet, and that the storefront has been closed. 

    The above is now immaterial, as we contacted another individual at CA **************** **** and the issue is now resolved. Of note, the document that would have precluded this interaction was submitted by the structural engineer to Alchemy Construction in January 2022. Submission of this document to the **** as per our contract, at any time in the past 18 months, would have made this complaint unnecessary. 

    I request no further action, but trust the Better Business Bureau to adjudicate as per its protocols, and provide an appropriate business rating.
