    I rent a unit at ********** Apartments and up until this year my landlord was Tiffany S******** who works for the business in question. They sold my unit in March to someone else but on April 1st they withdrew another rent payment from my bank account causing my account to be in overdraft. The withdrawal was eventually reversed by my bank but they still charged me a $45 overdraft fee. This payment should obviously have never been taken and they should be responsible for crediting me the overdraft charge I incurred. For the past 3 months I have been attempting to contact them about this. I have tried emailing Tiffany S********, submitting a contact form on their website, and calling their phone directly with the details of my issue. Every time they either ignore me or someone tells me they will be sending the issue to Tiffany who will contact me directly but that is never done. They seem entirely unwilling to resolve this issue which was a result of them taking money from me they were never entitled to in the first place. The amount owed to me is minor but a business taking money from someone that doesn't belong to them and then refusing to make it right is extremely poor practice in my opinion.

    I have attached the statement from my chequing account showing the rent payment that was wrongfully withdrawn and the resulting overdraft charge.

    Hello, I had responded to the Tenant when the issue was brought to our attention. Unfortunately the property owner did not inform our company of the sale until it was too late to cancel the tenants pre-authorized payment for the month (it was on the 1st of the mounth), and his rental payment went through. This is because the owner, or tenant did not inform us to cancel the Pre-authoirzed payment. 

     

    We could reach out to the seller (current owner when this happened), and ask if he can reimburse the tenant $45?

    Yes, that would be great if they can do that. That's what they told me many months ago but there was absolutely no follow up done or response to any of my attempts to follow up. This should be the responsibility of the buyer and seller to sort out since it was their breakdown in communication that caused me being wrongfully charged in the first place. It should not be expected of me to contact my brand new landlord to tell him that he owes me money for something when I have no idea how this process of selling an apartment unit works in the first place. So if they can take the onus of resolving this situation for me it would be very appreciated.

    I wish to re-open claim # ******** as the business in question has still not done a single thing to rectify the situation as they said they would or provided any followup whatsoever. They owe me $45 for taking money out of my chequing account that did not belong to them forcing my account to go into overdraft and incur an overdraft fee.
