      I am rejecting this response because:

      While the rental was returned late, during previous conversations, *********************** was told by *************************** that it was ok to return the rental late.


      As I said previously, I have carefully reviewed the terms and conditions, including section 8 of the terms and conditions. Section 8 is written as follows:


      8. Care of the Rental Equipment: Customer shall be responsible for any and all damage to any of the Rental Equipment not caused by ordinary wear and tear. "Ordinary wear and tear" shall mean only the normal deterioration of the rental equipment caused by ordinary, reasonable and proper use of the rental equipment. Customer shall be liable to Lessor for any and all damage which is not "ordinary wear and tear" in an amount equal to the replacement value listed on the front of this Agreement. Damage which is not "ordinary wear and tear" includes, but is not limited to, cutting or tearing of vinyl or netting, damage due to overturning, overloading, exceeding rated capacities, breakage, improper use, abuse, lack of cleaning, contamination of or dirtying of rental equipment with non-approved items such as chemicals, non approved food, paint, silly string (see Paragraph 10), mud, ***** or other materials.


      Section 8 indicates customer responsibility for damage to the rental equipment. Section 8 does not indicate any liability regarding soaking wet or unbelievably dirty. As the item was returned without damage, the customer obligations under section 8 have been fulfilled. 

      The total cost of the invoice has already been paid, including an additional 22% for a cleaning deposit. This additional charge is not lawful, and puts La Promotions in contravention of paragraph 8(3)(f) of the Business Practices and Consumer Protection Act. La Promotions can return to compliance with this section of the Act by withdrawing this additional charge.

      Again, it is requested that La Promotions withdraw this unlawful charge.

       

      ly reviewed the contents of the of the rental agreement and to the best of my knowledge there is nothing in the rental agreement which indicates that we could or would be subject to additional fees for cleaning.I do not believe that the company has legal grounds to charge this fee, and fear that we may be being taken advantage of in this situation. The resolution that I am seeking for is to have LA Promotions withdraw this additional cleaning charge.In addition to this message, I have uploaded the following documents: 1.) A copy of the invoice that was sent to *********************** 2.) A copy of the rental agreement

      The rental item was returned late (for which we could have charged another rental fee but didn't), and the item was returned soaking wet and unbelievably dirty. Our units are not meant to get wet. The threads start to break down, which is a safety concern, and causes a smell. Dirt is abrasive to the fabric as well. It took 30 hours of the unit being inflated for it to fully dry, at which time multiple staff had to meticulously clean it. In the agreement the customer provided to you, section 8 outlines how the customer is responsible and liable for this. The customer is unhappy with the invoice for cleaning, however, we are within our rights to invoice them. We will NOT be cancelling the invoice, and should the customer not pay, they will be added to our do not rent list, and the invoice will be submitted to our collection agency.
