We purchased a container pool from 204 Container Homes and Pools from the owner KURT ******. After contacting him, I went to his shop in the spring of 2021. They were pool plants there. There was a welder working on site on a container. It all looked legit. After doing renderings and drawings, I signed the purchase agreement on 10 June 2021 and put a down payment of $20,000. The other half was supposed to be paid after inspection and prior to delivery. Delivery was supposed to be 3 months. Due to Covid according to him there were some delays. The delivery was postponed. He came to have a look at our home to see where the pool site was and gave me the measurements for the gravel pad that had to be built for it. I spent $2500 to get that done. Then came spring. There was a lot of rain so he mentioned that he couldn't be delivered. He contacted a crane company from Portage so that this person got involved. The crane operator contacted me to look at the site as well and came which still made it look legit. We picked the date of July 29 for delivery. Everybody was ready including the crane operator. He still mentioned that his yard was too wet. So I decided to go to his yard. The shop was empty and the neighbouring offices mention that nobody has been there for a long time. As an excuse he told me that he changed site but still wouldn't give me the new address after several text messages. His Instagram and website have not been updated since summer of 2021 ********************************************************************************************* He will not send me pictures of the pool I have no proof that he's been built so that in my opinion there's no pool existing although he still insists that there's just a few items missing. Last time I contacted him he said he couldn't meet me because he was at the lake. I wish I could be at the lake but he's sitting on my money. I hope that you can help me get at least my down payment back *************** Sincerely Bernard

Business Response /* (1000, 5, 2022/08/05) */ We have been in contact with the customer, We have explained that we are having labour shortages and issues. We are running quite behind in our build schedule and are trying to get caught up as soon as possible. We have also just moved our offices to another location as we were growing out of our current space, We have already notified the customer that once we are settled that we would invite the customer to come down and seek out his pool Consumer Response /* (3000, 7, 2022/08/08) */ To whom it may concern, The response is unsatisfactory as the business still doesn't mention any address for the business office and there is no proof that any pool is being worked. Yes, he has contacted me and has given me excuses after excuses. ****************** the address on his website is an empty office and still no new address. Our pool was supposed to be done in August-September 2021, 9-12 weeks from the day of signed contract which was in June 2021. That's when I wired $20000. To me this business still doesn't exist until there is an official address and I can see my pool or a pool. ******************************************************************************** ****** Business Response /* (4000, 9, 2022/08/09) */ When the pool is completely ready to go that is when we can ship the pool to the customer. The pool will be ready when we finish its last coating for the interior.
