    In November 2023 TMC Construction and Excavating was contracted to build a fence along the east side of our property from the rear property line of the yard to a point part way into the sideyard, approximately 60 feet in length. We could not extend the fence further towards the front yard because of trees and large stumps on the adjacent lot. The agreement was to build a six foot high treated wood fence along the property line. TMC was shown the existing surveyor's pins at the front and rear of the lot at the property line. Construction began on November 14 and was completed on November 17, 2023. In April, the following spring, the adjacent lot was further cleared of trees and stumps for development, it then became apparent that the fence did not follow the property line. Using the original surveyor's pins as reference a string line was run from the front to the rear of the property. It was determined that the fence angled from the rear of the property to a point 24 inches inside the property line where it terminated in the sideyard. On May 1, 2024 Tyler ****, the owner of TMC, was contacted via text message to advise of the problem. His immediate response was to blame me as I had approved the location of the last fence post. I explained that if I had been in agreement with its location it was because I had trusted that it was on the property line. At the time the fence was completed the past November, visually it was not possible to confirm that it was on the line. I requested that he attend hoping that we could find a solution, he agreed that he would stop by. After a number of weeks and messages it became obvious that he had no intention of showing up. In mid July 2024 another company was contracted to dismantle and relocate the fence to the property line at a cost of $****. plus GST. On July 24 I contacted Tyler requesting compensation for 50% of my cost, $***** He refused, ** **** *** ****** **** *** ** ******** ******* ****
